BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963
VAN BUREN MUNICIPAL CODE NO.14.04.01) FOR THE
PURPOSE OF REZONING CERTAIN PROPERTY IN THE
CITY OF VAN BUREN, ARKANSAS, AMENDING THE
ZONING MAP OF THE CITY OF VAN BUREN,ARKANSAS,
AND FOR OTHER PURPOSES.
WHEREAS, the City of Van Buren,Arkansas, is duly incorporated under the law of the State
of Arkansas,with all powers, authority, and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van
Buren(Ordinance No. 7-1963); and
WHEREAS, a request has been made by Cox Investment Properties,LLC to rezone certain
property within the city limits of the City of Van Buren; and
WHEREAS, notice of a Planning Commission Public Hearing was'duly published in the
Southwest Times Record, and the public hearing was conducted as required by
law(A.C.A& 14-56-422) on May 2, 2023; and
WHEREAS, as a result of this hearing,the Planning Commission recommended that certain
property within the city limits of the City of Van Buren be rezoned from its
previous classification to the following:
Property Zoned New Zoning
C-2 Thoroughfare Commercial District R-3 Multi-Family Residential District
Legal Description:
See Exhibit"A" attached to this Ordinance.
WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire
Planning Commission, in accordance with A.C.A. & 14-56-422.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The above-described property is hereby rezoned from C-2 to R-3 and the Van
Buren Zoning Map is amended to reflect this rezoning.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council, did
pass, approve, and adopt, by a vote of 5 for and 0 against,the foregoing Ordinance at its
regular meeting held on the 22°a day of May 2023.

The City received a rezoning application to change an 8.02-acre tract of land from C-2
Thoroughfare Commercial to R-3 Multi-Family. The property is at the end of the 2000 block of
Cedar Street;the 2100 block of Williams Street and the 400 block of North 24th street(see
maps).
The existing zoning is part of the larger strip of C-2 zoning which parallels Alma Highway. This
property,however, is separated from Alma Highway by Town Branch and is next to several
residential neighborhoods all zoned R-2 Family Districts.
This property seems to make more sense that it be zoned Residential than Commercial. The
property is significantly impacted by the Floodway and Flood plain. Also,there are numerous
utility easements that will be required which will significantly impact the developable area(see
maps).
The applicant indicates the multi-family development will be comprised of duplexes.
Linda Patton of 2018 Cedar Street, spoke to the Planning Commission stating that she has
concerns about traffic if a multi-family development is built but she also added that she would
prefer residential over commercial.
The Planning Commission agreed that the development plan will need to be reviewed for fire
department access and the existing streets, flood plain,floodway and utility easements before
any construction can be approved.
After listening to the testimony and reviewing the staff reports,the Planning Commission voted
unanimously to recommend approval of the rezoning request for the land which does not include
approval of the development plan.

The application and accompanying emails indicates a multifamily development comprised of
duplexes is the purpose of this rezoning.

The Master Land Use Plan classification for this property,does not currently support an R-3 multi-
family zoning.
The density of duplexes is limited to one per 7,000 square feet of land area.
The property has access or frontage on three streets..Cedar St.,Williams St.,and North 23rd/2e
Street:Access and use of the individual streets will need to be evaluated for fire department access
and existing conditions.North 231a and North 2e are very narrow streets.
VBMU has indicated there is an existing sewer line on this property that is not shown on the
survey.
A.plat needs to be submitted and completed on this property to show all utility and drainage
easements,tights of way,etc.
The tezoning review is not a complete review of the development plan.
The zoning change and proposed use of this property seems to be compatible with surrounding
zoning and land uses.
