ORD NO 23-1998 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. a2 3 -1998
AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN FIRE FIGHTING
EQUIPMENT.
WHEREAS, The City of Van Buren has certain EDA funds which can be
utilized in the purchase of fire fighting equipment, said
equipment consisting of air packs and turnout gear; and,
WHEREAS, The suppliers for such equipment are very limited and are
not located within an area in which an advertisement for bids
in the local newspapers would be noted; and,
WHEREAS, Informal bids have already been received from the two
known regional suppliers for the air packs and also from the
one known regional supplier for the turnout gear; and,
WHEREAS, There is a time limitation in which said EDA funds can be
used for the purchase of this fire fighting equipment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
SECTION 1: That the Mayor and Fire Chief are hereby authorized to
purchase six air packs for Ferrara Fire Apparatus, Inc. for a
total purchase price of $9,633.00 and to also purchase ten
sets of turn out gear from Casco of Arkansas for a total
purchase price of $10,087.19.
SECTION 2: That because of the shortage of suppliers and the reasonable
expectation that no bids would have been received had a
notice for bids been published in the local newspaper and
also due to the time limitation for use of the EDA funds
which would expire if the purchase were delayed by a formal
competitive procedure, a unique and exceptional situation
exists and bidding by the City of Van Buren is not feasible or
practicable, therefore, the requirement of competitive bidding
is waived.
SECTION 3: That the acquisition of the fire fighting equipment described
above being necessary for the preservation of the public
peace, health, comfort, convenience, safety and welfare of the
citizens of the City of Van Buren, Arkansas, and' emergency
is declared to exist and this Ordinance shall be in full force
and effect from the date of its publication.
