PC Minutes 04-04-2023J PLANNING COMMISSION MINUTES April f, 2023 1. Call To Order. The Van Buren Planning Commission held its monthly meeting on Tuesday, April 4, 2023, at 5:30 P.M. The meeting was held at the Municipal Complex in the City Council Chambers, 2. Roll Call. The following Commissioners were present: Chairman Andy Dibble, Mark Evans,. Missy Hefner, Jason Myers, Mason Shirey, Tiffany Webster, Jay White, and Nathan Wilson. Vice -Chairman Philip Bagby was absent. City staff present were Planning Director Wally Bailey, City Inspector David Martin, Secretary Jennifer Willoughby, and City Attorney Jacob Howell. Present for Agenda Item #4: Jackson Corbit of God's Anchor Church, Keith Burkhart of 1502 Elm Street, and Patrick Sanford of 120 N. 15a' Street. Present for Agenda Item 45: Andrew Erickson and Misty Riggs of Schwob Building Company representing Southeastern Freight Lines, Kevin Bell of Jimmy Bell Real Estate, and Randy Scott of Scott. Enterprises, Inc. Present for Agenda Item #8: Mike Overzat and Zack Jones of Luck Roofing, 3. Approval Of Minutes From March 7, 2023. A motion to approve was made by Commissioner Jason Myers and seconded by Commissioner Tiffany Webster. The motion was approved unanimously. 4. CUP #1-2023 206 N. 15�h Street�Tackson Corbit/God's Anchor Church; Requesting Conditional Use Permit For Church In 114. A motion to approve was made by Commissioner Mason Shirey and seconded by Commissioner Tiffany Webster. The motion was approved unanimously. Members of the public that spoke regarding this Conditional Use Permit Application were: Keith Burkhart, who owns the property next to the church, stated his concern is that the wooden privacy fence between their properties may not be secure or safe if children climb on it. Patrick Sanford asked what the church capacity is and where will the congregation park if the church surpasses its current capacity. Mr. Corbit responded to Mr. Burkhart that most church activities will be indoors, they will keep children away from the fence, and that the church is more than willing to help with repairing the fence if needed. Mr. Corbit responded to Mr. Sanford that currently there is more than enough parking but, if necessary, would ask the library if the congregation could use their parking lot on Sundays. 5. Variance #4-2023—Bekaert Drive— Schwob Building Company/Southeastern Freight Lines; Requesting Variance From Minimum Street Standards. A motion to approve with conditions was made by Commissioner Tiffany Webster and seconded by Commissioner Jason Myers. The motion was approved unanimously. The request is that Southeastern Freight Lines be able to match the existing road construction as it currently exists from Lee Creek Rd to the west Bekaert driveway and defer the full Collector road improvements to the master street plan/minimum street standards requirements until such time as more development occurs on the 350 acres 1 of2 that would require the improvement of Bekaert Dr to a Collector street. The variance will allow a street to be constructed to the width of 26 feet without curb and gutter and without sidewalks. The variance was approved with the following conditions: that it is for the initial development of 60 acres that includes development by Southeastern Freight Lines, that the issue of the future road design and construction will need to be revisited on a case -by -case basis for any future development of the remaining 290 +/- acres, and that these conditions be recorded in the county's public land records. 6. Woodrow Addition Lots 1-6—Preliminary Plat Review —Satterfield Land SurveyorslWoody Nelson. Applicant withdrew this agenda item prior to the meeting. 7. Building Code Amendment —Adoption Of 2021 Arkansas Fire Prevention Code. A motion to approve recommendation to City Council was made by Commissioner Nathan Wilson and seconded by Commissioner Mason Shirey. The motion was approved unanimously. S. Building Code Amendment Re -Roofing Requirements Of Damaged Roofs. A motion to deny the recommendation to City Council was made by Commissioner Nathan Wilson and seconded by Commissioner Jason Myers. The motion to deny was approved unanimously. A presentation was made by Michael Overzat of Luck Roofing made a presentation asking the City to institute a rule that would require any roof damaged by 25% or more be required to replace the entire roof not just the damaged portions. The Planning Commission suggested this proposed amendment should be proposed to the State Fire Marshal's office for inclusion in the Arkansas Code and not an amendment to the city's ordinance. 9. Building Code Amendment —Establishing Penalties For Failing To Obtain A Building Permit. A motion to approve recommendation to City Council was made by Commissioner Mason Shirey and seconded by Commissioner Jason Myers. The motion was approved unanimously. The Commission recommends that a penalty be assessed to a building permit when work was started before first obtaining a building permit; and that the penalty be established as a $250 penalty plus the cost of the building permit fee or double the building permit fee whichever is greater. 10. Old/New Business. 11. Adjourn. A motion to adjourn was made by Commissioner Mark Evans and seconded by Commissioner Mason Shirey. The motion was approved unanimously.
