ORDINANCE NO. -1998
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A SECOND CHANGE
ORDER FOR THE 1997 STREET IMPROVEMENT PROJECT, PHASE II.
WHEREAS, The City of Van Buren desires to continue with a program of
street repairs and improvements and as a part of that
program advertised and accepted bids for the overlay of
portions of Azure Hills, Pointer Trail East (24th Street to the
Tennis Courts) and Skyline Drive; and,
WHEREAS, It has been determined that additional work consisting of
drainage improvements along Skyline Drive, Westward Drive,
and Dark Hollow should be added to the previously approved
contract; and,
WHEREAS, The City Council has previously authorized a change order
for the estimated amount of $59,500.00 and it is now
determined that the actual cost of the additional work will be
an additional $29,054.75; and,
WHEREAS, Because of the previous bidding and acceptance of bid for
the overall overlay project in the Skyline Drive area, use of
the formal competitive bidding procedure would not be
feasible and would unnecessarily delay the completion of the
required improvements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
SECTION 1: That the Mayor is hereby authorized to execute a second
change order in the 1997 Street Improvement Project, Phase
1I, for the purpose of adding drainage improvements on
Skyline Drive and Dark Hollow, for drainage improvements
on Skyline Drive and Westward Drive, and to increase the
contract time 90 calendar days to May 22, 1998.
SECTION 2: For the purpose of implementing the change order, the
Mayor and City Clerk- Treasurer are hereby authorized to
enter into an agreement with the contractor for said
improvements at a cost of up to the additional $29,054.75.
SECTION 3: That because of the previous advertising and acceptance of
bids for the overall overlay project in the Skyline Drive area,
and the delay which would be necessitated by the formal
competitive procedure, a unique and exceptional situation
exists and bidding by the City of Van Buren is not feasible or
practical, therefore, the requirement of competitive bidding is
waived.
SECTION 4: That the improvements desired being necessary for the
benefit of the driving public and also the residents of the
area and this Ordinance being necessary for the preservation
of the public peace, health, comfort, convenience, safety, and
welfare of the citizens of the City of Van Buren, Arkansas, an
emergency is declared to exist and this Ordinance shall be in
full force from the date of its approval.
