We are requesting a Variance. Plat review to be completed if variance is granted.
We are requesting a variance from the requirement for 75-foot lot width for two-family
dwellings in R2 zone and a variance from the requirement for 9000 square feet lot size.
Request: Lot 3A to be 51.88 feet wide with 8,415 square foot lot size, and Lot 3B to be
51,87 feet wide with 8,715 square foot lot size.
The variance 'requested is due to the client proposing a replat of the property for two-
family dwelling construction.
Currently there are no existing structures on the property.

SUBJECT: 413 NORTH 14TH ST (LOT 3, BLOCK 5, MURTA ADDITION)

PURPOSE: The applicant wants to subdivide the existing Lot 3 into two lots which
will allow the construction of two duplexes. There is not enough land area
in the existing Lot 3 to create two conforming lots in an 11-2 zoning
district.
APPLICANT: WD Builders LLC —Willie Mooney
ZONING: R-2 Family Residential District
SETBACKS: Front Yard: 25 feet or 50 feet from C/L of street whichever is greater
Side Yard: 7 % feet
Rear yard: 20 feet
Side yard: 15 feet from street property line or 35 feet from C/L of
street
LOT WH)TH: Single family: 60 feet; Two family: 75 feet
LOT AREA: Single family: 7,000 square feet; Two-family: 9,000 square feet
VARIANCE REQUEST:
From 75 feet minimum lot width to 51.87 feet for Lot 3B and 51.88 feet for Lot 3A
From 9,000 square feet minimum lot size to 8,415 square feet for Lot 3A and 8,715
square feet for Lot 3B
BOARD OF ZONING ADJUSTMENT POWERS:
Article VIIL Section 5 (3) Zoning Ordinance: To hear and decide applications for variance from
the terms of this Ordinance in cases where a specific place of property characterized by
exceptional narrowness, shallowness or shape was a lot or record at the time of adoption of this
Ordinance; or where by reason of exceptional topographic conditions or other extraordinary or
exceptional situations or conditions of a piece of property; provided that such relief may be
granted without substantial detriment to the public good and without substantially impairing the
intent and purpose of this Ordinance as specifically authorized in Article VI, Sections 1 and 3.
COMMENTS: Article III, Section.) of the zoning ordinance states: No lot shall be
reduced in area so that yards, lot area per family,, lot width, building area, or other requirements
of this Ordinance are not maintained.
The City Attorney has provided an opinion that a variance can be requested from this section but
"only17 if exceptional conditions exist as described in Article VIII, Section 5 of the Zoning
Ordinance.
