ORD NO 42-2022 r CITY OF VAN BUREN,ARKANSAS ORDINANCE NO. -2022 BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN, ARKANSAS AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 VAN BUREN MUNICIPAL CODE NO.14.04.01) FOR THE PURPOSE OF REZONING CERTAIN PROPERTY IN THE CITY OF VAN BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN,ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, the City of Van Buren,Arkansas,is duly incorporated under the law of the State of Arkansas,with all powers, authority, and duties of a city of the first class; and WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren(Ordinance No. 7-1963); and WHEREAS, a request has been made by First Assembly of God of Van Buren to rezone certain property within the city limits of the City of Van Buren; and WHEREAS, notice of a Public Hearing was duly published in the Times Record on November 20, 2022, and a public hearing was conducted as required by law(A.C.A 14-56- 422) on December 6,2022; and WHEREAS, as a result of this hearing,the Planning Commission recommended that certain property within the city limits of the City of Van Buren be rezoned from its previous classification to.the following: Propelly Zoned New Zoning C-2 Thoroughfare Commercial District R-3 Multi-Family Residential &R-1 Single Family District Legal Description: First Assembly of God Van Buren Lot IA WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire Planning Commission, in accordance with A.C.A. 14-56-422. The purpose of this rezoning application is to clarify the zoning of the property at 1014 Fayetteville Rd. During a recent review of the zoning map and previous ordinances,we discovered an error or omission in the rezoning ordinance for this property. There has been an assumption that this property was already zoned R-3 since 2005. The legal description within the ordinance did not include all the church property but the City's zoning map has shown this property to be rezoned since 2005. When this was discovered,I discussed the matter with the church and we subsequently worked together to correct the record related to the zoning of the church property. The Planning Commission held a public hearing on this application at their December 6, 2022, meeting. We had no one present at the meeting objecting to the application. After discussion the Planning Commission voted to recommend this rezoning to the City Council. The motion was approved unanimously. N/A STAFF COMMENTS During atecent review and updating of the city's zoning snap we discovered an error that has existed for quite some tune.The existing zoning map shows this property as zoned Residential-3 -27 9 from Ordinance -2005.How�aierwheinwelpol�!--dattl-latzonin ordinance the legal description did not include this.property. It has been recognized as having a Residential-3 zoning,for several years,because of die zoning map.We also recognized this property as R-3 when we reviewed two planning commission discussion earlier this year. After discussing this witli the Church representatives they agreed they want the property to have the Residential-3 zoning.classification.This rezoning application is our effort working with the church to have the official records snatch the city's zoning map.
