ORD NO 36-2022 CITY OF VAN BUREN,ARKANSAS ORDINANCE N031, -2022 BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN, ARKANSAS,AN ORDINANCE TO BE ENTITLED: AN ORDINANCE ADOPTING THE REVISED 2020 NATIONAL ELECTRICAL CODE WITH LOCAL AMENDMENTS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City Council adopted the 2014 version of the National Electrical Code with Local Amendments pursuant to Ordinance No. 18-2014: and WHEREAS, a more current edition is available that would better serve the needs of the City of Van Buren; and WHEREAS, notice of a Public Hearing was duly published,and a Public Hearing was conducted by the Van Buren Planning Commission to consider these proposed amendments; and WHEREAS, the proposed changes herein were recommended by a majority vote of the entire Planning Commission. NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT: SECTION 1: There is hereby adopted by reference the 2020 National Electrical Code as adopted by the Arkansas Board of Electrical Examiners,.together with local amendments. The provisions of Section 210.8(F)of the 2020 National Electrical Code dealing with the GFC I requirements for Heating,Ventilation and Air Conditioning are excluded from the adoption of the National Electrical Code.Three(3)copies of the referenced regulatory code,together with the local amendments,is now on file in the office of the Van Buren City Clerk and the same are hereby adopted by reference and incorporated as if set out word for word herein. SECTION 2: All Ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict. The various provisions and.parts of this Ordinance are hereby declared to be severable,and, if any section or part of a section,or any provision or part of a provision herein,is declared to be unconstitutional, inappropriate,or invalid by any court of competent jurisdiction, such holding shall not invalidate or affect the remainder of this Ordinance and to that extent the provisions hereto are declared to be severable. SECTION 3: It is of the utmost urgency that the City of Van Buren,Arkansas has an up-to-date Electrical Code to protect its citizens. I have attached the notice from the Arkansas Department of Labor and Licensing,Electrical Section,as well as an excerpt Rom the July 31,2022,Administrative Rules of the Arkansas Board of Electrical Examiners.The 202U National Electrical Code is now the statewide standard for the performance of electrical work.The administrative rules specify one exception to the adoption of the 2020 NEC which is, "The pror,islons of,Section 210.8F of the 2020 National Electrical Code, dealing with the GFCI requirements for Heating, Ventilation and Air Conditioning are excluded fi-oln the tdoption of the 2020 Mationurl Electrical Code. .In addition to the National Electrical Code,the City of Van Buren has"local requirements"to the adopted electrical code.Some amendments are proposed to the"local requirements" including the amendment to section 210.8r mentioned above.A copy of the"local requirements" is attached with the proposed amendments highlighted. The Planning Commission held a public hearing at their regular meeting on October 4°i,2022. The Planning Commission voted unanimously to recommend the City Council adopt the 2020 NEC and the amended local requirements as recommended by city staff. The Board hereby adopts and incorporates herein the National Electrical Code, 2020 edition of the National Fite Protection Association. B. The National Electrical Code,2020,shall be the standard for the construction, installation,repair,and maintenance of electrical facilities and the performance of electrical work. 1. The provisions of Section 210.8F of the 2020 National Electrical Code, dealing with the GFCI requirements for Heating,Ventilation and Ai Conditioning are excluded from the adoption of the 2020 National Electrical Code. In the event there are updates and new editions to the National Electrical Code, the Board shall,after notice and public hearing,adopt such changes and editions which it determines are necessary to insure the public health and safety. (National Electric Code)the following Local Electrical Requirements for the City of Van Buren,AR shall apply. Definitions > 1. Temporary Service Poles: An electrical service connected for the use of electrical power during the construction or reconstruction of a structure. Temporary service shall not exceed 8 months without approval from the building official. All temporary service poles set and used in the City of Van Buren must be inspected before connected to the power company. 2. Circuit: For the purpose of counting circuits for fees the following shall constitute a circuit: Every current carrying conductor connected to a fuse or circuit breaker in an electrical panel. General Requirements 1. Meter base height measured to the center of the meter. a. OG&E requirements; Min. 48 inches, Max 66 inches, 60 inches is preferred. b. Arkansas Valley Electric requirements: 5 feet min., 6 feet max. c. All underground service risers for PVC shall be Schedule 80 PVC. d. No Connections, breaks, or splices may be made in the Power Company Supply Linevithout written permission of that Power Company. if allowed an electric power supplied tamper proof box must be used. e. Risers shall be a minimum of 2"rigid metal conduit, 2. All premise wiring shall be copper conductors not less than 12 gauge. 3. Electric shall not be bonded to water lines. 4. Equipment disconnects shall not be installed on the equipment to be disconnected. 5. Electrical panels shall not be installed within 48 inches of combustible material, in rooms with flammable liquids or vapors, in bathrooms, or within reach of plumbing fixtures or appliances 6. Only one electric meter is allowed at each address unless approved by Fire Marshall and Building Official. 7. Bathroom exhaust fans shall be sized to a minimum of 0.75 cfm per sq. foot of floor of floor space of the bathroom. All bathroom exhaust fans must be vented to the outside air and meet the manufacture installation instructions. 8. Circuit continuity shall be continuous and not depend on a device. Feed through receptacles and lighting fixtures are prohibited. Exception: GFI receptacles may be used to protect other receptacles downstream in kitchens and bathrooms only. 9. All electrical work shall be performed by an Arkansas licensed electrician. Only master electricians may take out an electrical permit. Exception:A homeowner living in their home, may get an electrical permit and do the wiring themselves for that home. Wiring will have to meet the adopted codes. 10.The provisions of Section 210.8F of the 2020 National Electric Code, dealing with the GFCI requirements for He Ventilation and Air Conditioning are excluded from the adoption of the 2020 National Electrical Code: Commercial Industrial Wiring All wiring-in structures built or remodeled in a Zoning classification of Commercial, Industrial,or Government: and all structures used for anything other than; Single family, two family or multi-family dwelling shall comply with the following: 1. All conductors shall be-in conduit and/or an approved raceway.: 2. Flexible Metallic tubing.or MC Cable maybe used as a final connection to a light fixture not to exceed six feet or it may be used as a conductor if it contains a 12 gauge or larger copper ground. 3. There shall be a maximum of eight openings (lights and receptacles)on each 20-ampere circuit. i 4. Where the distance from the meter base or C.T. cabinet to the distribution panel is more than five feet, a means of disconnect shall be required within twelve inches of the meter base, C.T. cabinet, or point of termination of the electric power company. The type of disconnect may be either a fused disconnect or breaker. l Residential Wiring 1. All residences shall have a minimum 200-ampere service installed during new construction, upgrades or repair that involve or require an electrical service upgrade. 2. 110 Volt smoke and carbon monoxide detectors shall be wired and installed to Code with the issuance of all electrical,permits and be installed by an Arkansas licensed electrician. One carbon monoxide detector must be installed within 20 inches of the floor on each floor level. 3. Ceiling boxes shall be installed in ceilings where light fixtures and ceiling fans will be installed. As a minimum, the ceiling boxes must be rated to carry at least 40 lbs. of weight. All ceiling boxes must be wired for both light and fans 4. 20 Ampere circuits shall have a maximum of 10 openings (lights and receptacles). 5. Kitchen countertop receptacles shall have a maximum of two duplex receptacles on one circuit and shall be protected by ground fault interrupting (GFI) devices. 6. Whirlpool tubs shall be protected by ground fault breakers. (GFI) 7. All outside receptacles shall be GFI protected. a. All special appliances shall be on a separated circuit to include but not limited to reffigerators, freezer`s, washing machines, microwaves ovens, garbage disposals and dishwashers. 9. .Each-bathroom countertop or cabinet-,drawer receptacle shall be on an individual circuit for that receptacle and shall be GFI protected. -No other outlets or lights shall be-on-that-circuit.All path-Min heaters shalt be on a separatelndivtdual..ci_rcuit. I O'Any equipment 30 ampere or above shall be on a 4-wire receptacle. Fees for extra trips and temporary services Extra tip fees and temporary service inspection fees shall be fortft '($40) per trip or inspection.
