ORD NO 35-2022 CITY OF VAN BUREN,ARKANSAS ORDINANCE NO.3-2022 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 VAN BUREN MUNICIPAL CODE NO.14.04.01) FOR THE PURPOSE OF REZONING CERTAIN PROPERTY IN THE CITY OF VAN BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN,ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, the City of Van Buren,Arkansas,is duly incorporated under the law of the State of Arkansas,with all powers, authority, and duties of a city of the first class; and WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren(Ordinance No. 7-1963); and WHEREAS, a request has been made by 820 West LLC to rezone certain property within the city limits of the City of Van Buren; and WHEREAS, notice of a Public Hearing was duly published in the Press Argus Courier on August 20,2022, and a public hearing was conducted as required by law(A.C.A 14-56-422)on September 6,2022; and WHEREAS, as a result of this hearing,the Planning Commission recommended that certain property within the city limits of the City of Van Buren be rezoned from its previous classification to the following: Property Zoned New Zoning C-2 Thoroughfare Commercial District R-3 Multi-Family Residential Legal Description: Lot 2,PBGH(Parkview) Subdivision WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire Planning Commission,in accordance with A.C.A. 14-56-422. The property is legally described as Lot 2,PBGH(Parkview) and is located between the new Dollar General at 601 Parkview Street and the.entrance into Parkview Elementary School. The rezoning application was submitted by Satterfield Land Surveyors as agent for the property owner 820 West LLC. The purpose of the rezoning is to,facilitate the development of a multi- family development consisting of 8-duplex buildings.A copy of the development plan is attached. The Planning Commission held a public hearing on this application at their September 6,2022, meeting.Patricia Selman asked how this would affect her property which was across the street. Ms. Selman wanted to be sure the rezoning did not change the zoning on her property. Jerry Johnston asked about a future traffic signal light at Parkview and Fayetteville Rd. After discussion the Planning Commission voted to recommend this rezoning to the City Council. The motion was approved unanimously. The motion was approved unanimously: Chad Cox of Empii 6,,Constructior stated he wants to use the property to build multi.-family duplexes, similar to what he Built on North,- 0`h Street across from King Elementary School. Patricia Selman, 706 Parkview Street, asked f hok property would be included in the rezone; Chairman Andy Dibble explained to her that the property being rezoned is across the street and her property will not be affected. Jerry Johnston, 823"Harrell Street,stated that she is concerned about more traffic and asked if they could get a traffic light installed at Hwy 59/Fayetteville Rd and Patkview Street. Wally Bailey, Planning Director,mentioned that there is a future ARDOT project planned for that section of Hwy 5.9 and that the city can ask whether installing a traffic light there is an option. 5.
