BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE AMENDING ORDINANCE NO. 15-1972;
AND FOR OTHER PURPOSES.
WHEREAS, Parking on certain streets within the City of Van Buren poses a danger to vehicles
utilizing the roadway and impedes access of emergency personnel; and
WHEREAS, The Planning Commission held a public hearing regarding restricting parking on
certain streets in addition to those listed in Ordinance No. 15-1972, as amended,
within the City of Van Buren; and
WHEREAS, After the public hearing, the Planning Commission recommends that parking on
additional streets in the City of Van Buren be prohibited; and
WHEREAS, Ordinance No. 15-1972, as amended, was previously enacted limiting parking on
certain streets within the City; and
WHEREAS, Ark. Code Ann. Section 27-49-106 provides that the City Council has the authority
to regulate the parking of vehicles on the streets and highways within the City and
to provide signs notifying the public of the regulation, and
WHEREAS, the City Council for the City of Van Buren desires to limit parking on additional
streets within the City to protect the health,safety, and welfare of its citizens.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: Section l(b): Pursuant to the authority granted by A.C.A. §27-49-106, adds the
following streets that parking is prohibited on within the City of Van Buren:

remainder of this Ordinance and to that extent the provisions hereto are declared to
be severable.

SUBJECT: PROHIBITED PARKING ON THE STREETS

The Planning Commission reviewed a proposal,from the City staff to add more streets to the City
Ordinance that prohibits parking on the street.
This list of additional streets is a result of'citizen concerns about difficulty maneuvering on'the
streets,.blind spots created by cars parked on curves and hills,public safety concerns by the
police department, inability to traverse the streets with fire department equipment and problems
for other emergency service equipment.
The original ordinance prohibiting parking.is Ordinance No. I5-1972, which was amended with
Ordinance 22-2020.A copy of the previous ordinances are enclosed.
The Planning Commission held a public hearing on September 6,2022. Charlotte Mizell of 2316
Pearl Circle (vhich is on the corner of Sandstone and Pearl Circle) spoke with concerns about
losing,the ability to park on Pearl Circle since Sandstone was also listed as a street with
prohibited parking. After significant discussion the Planning Commission felt it best to remain
consistent and to prohibit parking on the entire street.so that emergency vehicles could reach.all
the properties on Pearl Circle.
After the public hearing,the Planning Commission voted to recommend the streets to the City
Council.
A legal notice was published in the Press Argus on September 17,2022,that included a complete
list of all the.streets being recommended to the City Council for prohibited parking.

1. Call To Order. The Van Buren Planning Commission.,field its monthly meeting on
Tuesday,September 6,2022,at 5:30 P.M. The meetingNvas-held.at the i'vlunicipal Complexin the City
Council Chambers.

2. Roll Call. The following Commissioners were present: Chairman Andy Dibble,.Vice-
Chairman Philip Bagby, Mark. Evans, Tiffany Webster,Jay White; and.Nathan Wilson. City staff
present were Planning Director Wally Bailey, City Inspector David Martin; Secretary Jennifer
Willoughby, City Attotney Jacob Howell,and Fite Chief Titn Arnold. Cointnissioners Missy Hefner,

3. Approval Of Minutes From July .5, 2022. A motion to approve was made by
mi Comssioner Jay White and seconded by Commissioner Tiffany Webster. The motion was approved
unanimously.
4.Rezone 45=2022—Lot 2 PBGH (Parkview)/Parcel #700-09530-002—Satterfield
Land Surveyors;From Cm2 To A-11. A motion to recommend rezone to City Council,was made by
Vice-Chaiunan.Philip Bagby and seconded.by Commissioner Mark Evans. The motion was approved
unanimously:
Chad Cox,of Empire Construction'stated he.wants to use the property to build multi.-family duplexes,
similar to what he built,`on Nortli:20"' Street across.from Twig Elementaty'School. Patricia Sehnan,
706 Parkview Street, asked..if het,.property would be included in the rezone; Chairman Andy Dibble
explained to .her that the pk: perty being rezoned is across the street and her property will not be
affected. Jerry Johnston,823 Harrell Street,stated that she is concerned about more traffic and asked
if they could get a traffic light installed at Hwy 59/17ayetteville Rd and Parkview Street. Wally Bailey,
Planning Ditectot,mentioned that there is a future ARDOT project planned for that section of Hwy
59 and that the city can ask whether installing a traffic light there is an option.
5. Ordinance Amendment—(Ord..22-2020) Restricting Parldng On Certain Streets. A
motion to recommend amendment to City Council was made by Commissioner Jay White and
seconded by Commissioner Tiffany Webster. The motion was approved unanimously.

A list of streets where parking needs to be prohibited was created by the staff of the Fire Department,
Police Department, and Street Departmment. These streets are locations that have been identified as
problems for.mototist to get through and as problems for emergency responders to pass through.in
an emergency. fire Chief Tim Ainold spoke to the commission explaining.the issues and the need to
keel) the street clear for their fire equipment vehicles and ambulances. Charlotte Mizell, 2316 Peal
Circle, addressed the corrnnission with concerns about losing the ability to park on.the cul-de-sac of
Pearl Circle. She stated that her driveway is shorter than most,her garage is too full to park cars inside
of,and that they have nowhere else to park their third vehicle other than on the street. Her dilemma
was discussed;but it was decided that the need to enforce the same rules for everyone and to ensure
emergency vehicles can reach their destination in an emergency is the priority.

6. Street .Abandonment Request—North 22"d Street; East Of Lots 1-9 Block 1
Stevenson's Addition—Satterfield Land Surveyors. .A iiio'ron to recommend abandonment to
City Council was made by Vice-Chairman Philip Bagby and seconded by Commissioner Jay White..
The motion was approved unanimously.
Planning Director Wally Bailey spoke to the commission stating that the,40'-platted street has never
been,developed and has no utilities within it. The abandonment is being requested so that the owner,
Cox Investment Properties, can replat the lots and the abandoned street.area into one lot with the
intent to build duplexes. Ricky Hill of-Satterfield Land,Su:vey.ors noted that the abutting property
owner is the Van Buren School District. The_school agteed.=t m o the abandonment with the condition
that a privacy fence is built along the property line and thaf as many trees as possible are saved to
preserve the natural barrier between the"tw_o properties. Vice-:Chairman Philip Bagby asked if the
abutting property owner(Van;IDren School_District)'will,deed their:56rdon of the abandonment over
as required by law. Mr. Hill.said-,yes, they can.get a deed for.tlie abandoned:street property from the
school.

CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: Section I of Ordinance No. 15-1972 is amended to add the following:
Section I(a): For the purposes of this Ordinance,the following definitions apply:
Cul-de-sac—the portion of a street(as defined by this ordinance)that is within
twenty feet of and including the circular turnaround at the end of a dead-end
street. Street-the roadway -portion of a public street right of way that is
designed to accommodate traffic flow.
SECTION 2: Section 1 of Ordinance No. 15-1972 is further amended to designate the former
Section I as Section I(b),and,pursuant to the authority granted by A.C.A. §27-49-
106, to add the following streets that parking is prohibited on within the City of
Van Buren:

"Appropriate signage shall be placed notifying the public of the restriction. After
signs prohibiting parking are erected upon said streets,boulevards or highways,no
person shall park avehicle in any of the above designated places. Streets with City 1
designated parking spaces are exempt from the on-street parking prohibition." !

SECTION 5: That Section 3 of Ordinance No. 15-1972 shall be amended to substitute fine
ainount of"not more than twenty-five dollars"with"not more than two hundred
and fifty dollars."
SECDON 6: The various provisions and parts of this Ordinance are hereby declared to be
severable,and,if any section or part of a section,or any provision or,part of a
provision herein,is declared to be unconstitutional,inappropriate,or invalid by
any courL of competent jurisdiction, sudh holding shall not invalidate or affectthe
remainder of this Ordinance and to that extent the pro-visions hereto are declared to
be severable.
