COME Petitioners, William Dean Gaither, Thelma Sharlene Gaither, and James David
Garner, by their attorneys Bagby Law Firm, P.A., and for their Petition for Annexation, state:
1. Petitioners are the majority owners of the following described real estate located
in Crawford County, Arkansas, to -wit:
Gaither Tract: The fractional NW/4 SW/4 of Section 7, Township 9 North,
Range 31 West and the NE/4 SE/4 and that part of the SE/4
NE/4 of Section 12, Township 9 North, Range 32 West,
Van Buren, Crawford County, Arkansas, more particularly
described as follows:
Beginning at the Southeast corner of said SE/4 NE/4; thence
N 89013'51"W along the south line of said SE/4 NE/4,
1043.90'; thence N 00124'38"W 1060.61'; thence S
89032'42"E 1043.40' to the east line of said SE/4 NE/4;
thence S 00027'59"E along said east line, 1066.64' to the
Point of Beginning containing 116.70 acres more or less.
Garner Tract: The S/2 of the fractional NW/4 and the NE/4 of the
fractional SW/4 of Section 7, Township 9 North, Range 31
West, Crawford County, Arkansas, containing 132.33 acres
more or less.
2. The above -described property is contiguous to property located within the city
limits of Van Buren, Arkansas.

3. Petitioners desire that the above -described property be annexed to the City of Van
Buren, Arkansas.
WHEREFORE, Petitioners, William Dean Gaither, Thelma Sharlene Gaither, and James
David Garner, respectfully request annexation of the above -described property to the City of Van
Buren, Arkansas.

AN ORDINANCE ACCEPTING THE ANNEXATION OF CERTAIN TERRITORY TO
THE CITY OF VAN BUREN, ARKANSAS, AND MAKING SAME A PART OF THE
CITY OF VAN BUREN, ARKANSAS, AND ASSIGNING ZONING DESIGNATIONS TO
SAME.
WHEREAS, A Petition was filed with the County Clerk of Crawford County, Arkansas,
by the majority of the real estate owners of the hereinafter described
territory praying that said territory be annexed to, and made a part of the
City of Van Buren, Arkansas; and
WHEREAS, On March 4, 2004, the County Court of Crawford County, Arkansas found
that the petition was signed by a majority of the real estate owners in said
territory; that said territory was contiguous and adjoining the present
corporate limits of the City of Van Buren, Arkansas; that an accurate plat
or map of said territory had been filed with and made a part of said petition;
that proper notice had been given for the time and in the manner prescribed
by law, and that all things pertaining thereto had been done in the manner
prescribed by law, and that said lands and territory should be annexed to
and made a part of the City of Van Buren, Arkansas, subject to the
acceptance of same by the City Council of said City at the proper time, as
provided by law; and
WHEREAS, The time fixed by law for appealing from said order of annexation made by
the County Court has expired and no appeal has been taken from said
order.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN, ARKANSAS:
SECTION 1: That the following described lands and territory contiguous and adjoining
the City of Van Buren, Arkansas, be and the same is hereby accepted as
part of and annexed to and made a part of the City of Van Buren:

Range 31 West and the NE/4 SE/4 and that part of the SE/4
NE/4 of Section. 12, Township 9 North, Range 32 West,

the south line of said SE/4 NE/4, 1043.90 feet; thence N 00

police and fire protection, and this is necessary for the public peace,
health, safety and welfare, an emergency is declared to exist. Therefore,
this ordinance shall be in full force and effect from after the date of the
passage.
