JULY 2022 REGULAR MINUTES OF THE VAN BUREN,ARKANSAS t CITY COUNCIL MEETING DULY 25,2022 The City Council of the City of Van Buren,Arkansas met at 5:30 p.m.Monday,July 25,2022 at the Van Buren Municipal Complex. The meeting was called to order by Mayor Hurst. On roll call,the following Council members answered as their names were called: Council Member Gifford,Kneeland,Petty and Wood, absent were Council Members Bell and Dodson. City Clerk Phyllis Thomas was present.This made a total of four(4)present. A quorum was declared. The invocation was given by our City Attorney,Jacob Howell. Mayor Hurst then led the Pledge of Allegiance. Chief Hammond stated that Captain Daniel A.Perry is retiring from the City on June 30,2022,after 25 years, 11 months and 14 days of service as a Van Buren Police Officer. We appreciate your service to the city and all the citizens of Van Buren. The city's appreciation of his service was expressed. Captain Perry accepted the award and expressed his appreciation to the city and citizens of Van Buren. Mayor Hurst asked if there was any discussion.There was none. The Council followed with a unanimous vote. The Cleric then read the Ordinance the third and final time. Mayor Hurst asked Mr. Steve Dufresne with Van Buren Municipal Utilities to speak. Mr.Dufresne stated that the prices for fees and charges for taps and connections were set in 2002, obviously cost have increased since that time. The Municipal Utilities does not make any net off the fees. These fees are to cover the cost of someone connecting to the system. We are just wanting to bring our cost up to date. Council Member Petty asked if the new fees include the meter or does not include the meter? Mr.Dufresne stated that normal tap fees do include the meter. Council Member Petty asked with cost going up will this increase be sufficient? Mr.Dufresne stated it's hard to determine with cost of material continuing to increase. The Mayor asked if there was any further discussion. There was none. Motion was made by Council Member Petty and seconded by Council Member Gifford to adopt the Ordinance as amended. The Clerk read the Ordinance in its entirety. Council Member Kneeland moved that the rules be suspended,and the Ordinance be placed on its second reading. The motion was seconded by Council Member Petty. The Council followed with a unanimous vote. The Clerk then read the Ordinance the second time. City Planner, Wally Bailey explained that proposed planned zoning district or PZD will allow for flexible zoning of properties. The PZD will allow for enhanced development characteristics not currently included in the City's standards and will help to mitigate impacts on a street corridor or a neighborhood. A PZD zoning establishes or creates a special or planned zoning district for a development that may not fit one of our conventional zoning districts. A PZD include provisions that can enhance a development by including special design characteristics that include items such as building height,building setbacks land uses permitted on the property,landscaping,building design standards,buffering/screening and requiring a specific development/site plan to approved. Planned Zoning Districts are an option when conventional district regulations do not work for a neighborhood or a corridor. Planned Zoned Districts are used in many Arkansas cities as a means of providing flexibility and enhancing developments. Council Member Kneeland asked as an example,if a neighborhood has a nice view of a valley or similar and someone came in and wanted to build a high rise six story building. Would this planning zone help that neighborhood? Mr.Bailey stated that it could help,the zoning districts help determine what height or how big a development can be. Mrs.Martin stated that Mr.Wally Bailey, City Planner,is working with the shelter on updating our dog ordinances for Van Buren. A handout sheet was provided showing that since 2017 to present that 1768 dogs have been saved. The shelter has given out close to 500 lbs. of dog food to families that are struggling to pay their own bills. While our mission is to save the abandoned/unwanted dogs of Van Buren,we also do our best to support families who love their dogs. Almost Home held a Free Chip Clinic in which 75 dogs were microchipped. This is planned to be an annual event. Van Buren Golf Course Council Member Kneeland asked for an update on the golf course. Mayor Hurst asked City Attorney, Jacob Howell to respond. Mr.Howell stated that recently the present proprietor of the golf course has acquired Attorney Rex Chronister."In March,we started tallying about a potential resolution to the matter. They had some demands and some requests. My last communication with Mr. Chronister was last week. He was supposed to meet with his client but unfortunately,he got sick and was in quarantine, We have made an offer of resolution that we're simply waiting for a response,"explained City Attorney Howell.
