This lot has numerous easements of significant widths that greatly reduces the buildable area on the lot. To construct
four residential duplex buildings, the applicant proposes to replat Lot 15 Legacy Valley VII into Lots 15A and 15B.
This will also require .5-foot side yard variances for the two western most buildings, from 7.5' to 7.0' for each building.
Chairman Andy Dibble asked Ms. Cox if he can shave the size of the buildings down. Mx. Cox replied no that he and
Ricky Hill of Satterfield Land Surveyors had tried numerous times to get the duplexes to fit but could not because of
the many easements on the lot. Mr. Cox stated that he would put in double fire wall protection and that the Fire
Marshall had approved the plan. Commissioner Mark Evans stated that he is against the side yard setback variance
because the request is out of convenience to the developer and not out of hardship. Commissioners Mark Evans, Jay
White, and John Symonds voted to deny the side yard setback variance. Vice-chairman Philip Bagby and
