The Van Buren Planning Conunission held its monthly meeting on Tuesday, June 7, 2022, at 5:30 P.M. The meeting was held at the Municipal Complex in the City Council Chambers. 2. Roll Call. The following Commissioners were present: Chairman Andy Dibble, Vice -Chairman Philip Bagby, Mark Evans, Mason Shitey, John Symonds, and Jay White. City staff present were Planning Director Wally Bailey, City Inspector David Martin, Secretary Jennifer Willoughby, and City Attorney Jacob Howell. Commissioners Missy Heffner, Jason Myers, and Tiffany Webster were absent. Present for Agenda Item #4 and Item # 5: Dana Roza of Satterfield Land Surveyors and Chad Cox of Empire Construction. Present for Agenda Item #6: Lisa K. Robinson of 816 N. 7`h Street, Debbie Faubus-Kendrick, Maurie M. Moore, Ross Robinson, Terri Jo & Ralph Little of 719 N. 9" Street, Raymond Morgan of 721 N. 9" Street, and Patricia A. Selman of 815 N. 71h Street. Present for Agenda Item #7: Dana Roza of Satterfield Land Surveyors and Brunchel Gilstrap. Present for Agenda Item #8 and Item #9: Chad Brixey of Brixey Engineering and Steven Franklin of Franklin Construction. 3. Approval Of Minutes From May 3, 2022. A motion to approve was made by Commissioner John Symonds and seconded by Commissioner Jay White. The motion was approved unanimously. Recess Planning Commission Convene Board Of Zoning Adjustment 4. Public Hearing For Variance #4-2022-1537 Northridge Drive East —Satterfield Land Surveyors; Variance From 1) Minimum Side Yard Setback Requirements and 2) Address Ordinance Requirements Concerning Placement Of Addressing Numbers In R-3. A motion to deny variance from 1) minimum side yard setback requirement was made by Commissioner Mark Evans and seconded by Commissioner Jay White. The motion to deny side setback variance was made by a 3 to 2 vote. A motion to approve variance 2) address ordinance requirement was made by Commissioner John Symonds and seconded by Vice -Chairman Philip Bagby. The motion to approve address variance was approved unanimously. This lot has numerous easements of significant widths that greatly reduces the buildable area on the lot. To construct four residential duplex buildings, the applicant proposes to replat Lot 15 Legacy Valley VII into Lots 15A and 15B. This will also require .5-foot side yard variances for the two western most buildings, from 7.5' to 7.0' for each building. Chairman Andy Dibble asked Ms. Cox if he can shave the size of the buildings down. Mx. Cox replied no that he and Ricky Hill of Satterfield Land Surveyors had tried numerous times to get the duplexes to fit but could not because of the many easements on the lot. Mr. Cox stated that he would put in double fire wall protection and that the Fire Marshall had approved the plan. Commissioner Mark Evans stated that he is against the side yard setback variance because the request is out of convenience to the developer and not out of hardship. Commissioners Mark Evans, Jay White, and John Symonds voted to deny the side yard setback variance. Vice-chairman Philip Bagby and Commissioner Mason Shirey voted for the side yard setback variance. 1of3 5. Public Hearing For Variance #6-2022-1536 Northridge Drive East —Satterfield Land Surveyors; Variance From Address Ordinance Requirements Concerning Placement Of Addressing Numbers In R-3. A motion to approve was made by Conniiissioner Vice -Chairman Philip Bagby and seconded by Commissioner John Symonds. The motion was approved unminiously. Recess Board Of Zoning Adjustment Convene Planning Commission 6. Conditional Use Permit 414-2022-816 North i Street — Lisa Robinson; Request To Allow Pigs In R4. A motion to approve three pet pigs was made by Vice -Chairman Philip Bagby and seconded by Commissioner Mark Evans. The motion was approved unanimously. Lisa Robinson stated that the three Juliana pigs are pets, not hogs, were raised in the house and are for her health/therapy (physicians' letter was provided). The pigs are two and three years old; are fully grown at around 30 lbs. The pigs have never gotten lose or escaped from the property. Ms. Robinson also stated she has moved the pigs to the back of her 3-acre property and put up a small fence to block all view of the pigs. Patricia Selman, neighboring property, addressed the Commission stating that she had her house for sale and that her realtor told her the pigs devalued her property. Ms. Selman noted that Ms. Robinson did good by moving the pigs out of view and away from the property line between them. Vice -Chairman Bagby asked Ms. Selman if she had any objection to the pigs as things are now. Ms. Selman replied that the pigs are not interfering with the sale of her house as is now. Terry Jo Little, 719 N. 9" Street, spoke up in defense of the pigs saying she has no problem with them. Raymond Morgan, 721 N. 9" Street, asked the Commission about precedent being set for future request and that if the pigs were large hogs he would have a problem, but since they are smaller pet pigs, he does not. Chairman Dibble stated each Conditional Use Permit request is handled on case -by -case basis. 7. Gilstrap Tracts 1-4—Final Plat Satterfield Land Surveyors. A motion to recoxninend the final plat to City Council was made by Vice -Chairman Philip Bagby and seconded by Commissioner John Symonds. T'he motion was approved unanimously. 8. Legacy Creek I —Final Plat—Brixey Engineering. i1 motion to recommend the final plat to City Council was made by Commissioner Mason Shitey and seconded by Vice -Chairman Philip Bagby. The motion was approved unanimously. 9. Legacy Creek II —Off -Site Easements—Brixey Engineering. A motion to recommend the southern off -site easement with a corrected exhibit to the City Council was made by Vice -Chairman Philp Bagby and seconded by Commissioner Jay White. The motion was approved unanimously. The land between Phase I and Phase II will be the future Legacy Creek Phase III. Some franchise utilities have requested utility easements that will be necessary to connect their infrastructure. Offsiteeasements axe required to make that connection. The easements are written such that the City of Van Buren is the grantee of the easements. The Planning Commission will review the easements and then make recommendation to City Council. Vice -Chairman Bagby asked if the developer understands that once the easements are recommended to City Council the easements cannot be modified. Chad Brixey of Brixey Engineering stated they need the southern easement and will wait to be sure on the other casement. Brixey Engineering will provide a correct easement exhibit. 2of3 10. Planned Zoning Districts —Public Hearing To Discuss The Addition Of PZD's To The Van Buren Zoning Ordinance. A motion to table again for more time to review and to get input from all Commissioners was made by Vice -Chairman Philip Bagby and seconded by Commissioner Mark Evans. The motion was approved unanimously. 11, Planning Commission Board Term Appointment/Reappointments. The mot on Ln recommend to City Council the reappointment of Commissioners Mark Evans, Jason Myers, and Tiffany Webster; and the new appointment of Nathan Wilson to the Planning Commission was made by Vice -Chairman Philip Bagby and seconded by Commissioner Jay White. The motion was approved unanimously. Cossioner John Symonds has decided to end h s t me ou the Plam uig Commission after 16 years of sen rice. He nominated Nathan Wilson, P.E. of I IAS Engineering. 12. Old/New Business. 13.Adjourn. A mot on to adjourn was made by Commissioner John Symonds and seconded by Commissioner Jay White.
