The Van Buren Plaruung Commission held its monthly meeting on'I'uesday, May 3, 2022, at 5:30 P.M. The meeting was held at the Municipal Complex in the City Council Chambers, 2. Roll Call. The following Cornmissioners were present: Acting Chairman Philip Bagby, Nlarl, Evans, Missy Hefner, Mason Shirey, John Symonds, Tiffany Webster, and Jay White. City staff present were Planning Director Wally Bailey, City Inspector David Martin, Fite Marshall Stanley Clark, and Secretary Jennifer Willoughby. Commission Chairman Andy Dibble and Commissioner Jason Myers were absent. Present for Agenda Item #4: Craig Ballegeer of 811 Powderhorn Circle. Present for Agenda Item #5: Ricky Hill of Satterfield Land Surveyors. Present for Agenda Item #6: Dewayne and Cindy Stone of 408 Sandstone Drive. Present for Agenda Item #7: Chad Brixey of Brixey Engineering, Cliff Cabaness of MGC Kibler Construction, William Loyd of Abilities Unlimited, Cathy Johnson, Daniel Johnson, and Steve Gann. Present for Agenda Item #8: Amy Sights of 617FR, LLC; Steve and Loti Griffin of 700 Hynes Street. Present for Agenda Item #9: Marlon Bonilla. Present for Agenda Item #10: Ricky Hill of Satterfield Land Surveyors. 3. Approval Of Minutes From April 5, 2022. A motion to approve was made by Commissioner Jay White and seconded by Commissioner John Symonds. The motion was approved unanimously. Recess Planning Commission Convene Board Of Zoning Adjustment 4. Public Hearing For Variance #3-2022-811 Powderhorn Circle —Craig Ballegeer; Variance From Maximum Driveway Width Requirements In R-1. A motion to approve an additional 20 ft of driveway on the west side was made by Commissioner Mark Evans and seconded by Commissioner Mason Shirey. The motion was approved unanimously. 5. Public Hearing For Variance 444-2022-1537 Northridge Drive East —Satterfield Land Surveyors; Variance From 1) Minimum Width Requirements Between Buildings and 2) Address Ordinance Requirements Concerning Placement Of Addressing Numbers In R-3. Ricky Hill of Satterfield Land Surveyors asked to withdraw the Agenda Item to allow time to make changes and resubmit at a later date. 6. Public Hearing For Variance #5-2022-408 Sandstone Drive—Dewayne Stone; Variance From Fence Ordinance Concerning Facing Of Finished Surface In R-2. A motion to approve was made by Commissioner Tiffany Webster and seconded by Commissioner Marl, Evans. The motion was approved unanimously. Acting Chairman Philip Bagby asked that River Vally Fencing Company be noted on record as the company that knowingly disregarded the fence ordinance by placing the finished fence surface facing inward of the property instead of facing outward as required. Recess Board Of Zoning Adjustment 1of3 Convene Planning Commission 7. Public Hearing For Rezone #3-2022-3409 Kibler Road—Brixey Engineering; R-2 To 11-3. A motion to approve recommendation of Rezone with conditions to City Council was made by Commissioner Jay White and seconded by Commissioner Mason Shirey. The motion was opposed by Comnssioner Mirk Evans but approved Lunanimously by remaining Commissioners. 1'he rezone request was approved with the following conditions that were added to the development plan by the applicant: • All structutes to be 1 story. • No structures will exceed 2 dwelling units. • Front facades will be 100% brick. • The eastern privacy fence and the Kibler Road frontage privacy fence will be 6' tall wood with brick columns at 24'+- spacing. • The northern and western privacy fences will be 6' tall. • The entrance will have a decorative brick wall on each side. • All waste and trash collected will be collected inside and placed by the curb on collection days. • All mechanical equipment, heating/cooling systems, trash receptacles, and utility boxes shall be completely screened from adjoining properties and street right-of-way utilizing opaque fencing of a height sufficient to completely screen the item from view. After more of the same discussions that were held last month between the Commission, developers, and surrounding neighbors Chairman Bagby directly asked the public in attendance whether they want 15 higher quality duplexes, or 9 lower quality duplexes built at this site. Cathy and Daniel Johnson, of 3 N. 35"' Street, both responded that they don't want the rezone approved because they want less buildings. 8. Public Hearing For Rezone #4-2022-619 Fayetteville Road-617FR, LLC; R-2 To C-2. A motion to approve recommendation of Rezone to the City Council was made by Commissioner Mason Shirey and seconded by Commissioner John Symonds. The motion was approved unanimously. Amy Sights, of 617 FR, LLC; stated that the purpose of the rezone request is to clean-up the non -conforming zoning to match the surrounding conunercial property, also owned by 617FR, LLC. Steve Griffin, of 700 Hynes Street, voiced his opposition to the rezone because he fears what type of commercial business may go in and how it would affect the property value of his residence. 9. Hilltop Way Development Request —Marlon Bonilla. Mr. Bonilla requested to develop the property on Hilltop Way and requested a waiver from the requirement to construct the road per the Master Street Plan. Mr. Bonilla's plan is to build soccer fields with concession stands and parking areas. The Commission stated the need to stay consistent with how they review issues involving the Master Street Plan; requiring the same from all developers. The Commission's decision is that the request can only be approved if the development follows the Master Street Plan. 10. Gilstrap Tracts 1-4—Preliminary Plat —Satterfield Land Surveyors. A motion to approve based on conditions to be added on the final plat was made by Commissioner Muk Evans and seconded by Commissioner Tiffany Webster. The motion was approved unanimously. This property straddles the planning jurisdiction line with. part outside the. planning jurisdiction; the developer intends to comply with the. City Planning requirements for all 4 tracts. Ricky Hill,. of Satterfield Land Surveyors, stated they 2of3 created the 40' private road and utility easement (Norris Road) to meet State Fire Code requirements and that City Fire Marshall Stanley Clark had approved the road. The Fire Marshall also informed Mr. Hill that the owner must install a private fire hydrant to meet State Fire Code requirements. 11. Public Hearing To Present Ordinance Defining Salvage Regulations. A motion to recommend the Zoning Ordinance Amendment to the City Council was made by Commissioner Jay White and seconded by Commissioner John Symonds. The motion was approved unanimously. 12. Public Hearing To Amend Access & Driveway Ordinance Allowing Cornmercial Ox Industrial Driveway Access Into Residential Neighborhoods. A motion to recommend the Access & Driveway Ordinance Amendment to the City Council was made by Commissioner John Symonds and seconded by Commissioner Jay White. The motion was approved unainously. 13. Public Hearing To Discuss The Addition Of Planned Zoning Districts To The Van Buren Zoning Ordinance. A motion to table to allow the Commission time to review the proposed addition of PZDs to the Zornng Ordinance was made by Commissioner Tiffany Webster and was seconded by Commissioner Missy Heffner. The motion was approved unanimously. 14. Old/New Business. a. Planning Director Wally Bailey told the Comnussion aUout a new and updated City of Van Buren Zoning Map being prepared by Tina Thompson of WAPDD; Also, Mr. Bailey stated the need for getting the correct legal description on record for city ordinances. 15.
