ORDINANCE NO. -1999
AN ORDINANCE AUTHORIZING THE MUNICIPAL JUDGE, MAYOR AND CITY
CLERK TO ENTER INTO A LEASE AGREEMENT FOR THE PURPOSE OF
LEASING COMPUTER SOFTWARE AND HARDWARE FOR THE VAN BUREN
MUNICIPAL COURT, AND FOR OTHER PURPOSES.
WHEREAS, The Municipal Court is in great need of a new computer
system, both hardware and software; and,
WHEREAS, A diligent search, including newspaper advertising, has been
made for appropriate court software, and evaluation has been
made of various software systems, and proposals have been
received and the software system owned by ASTI of Fort
Smith. Arkansas has been determined to be the best suited
software system for the Municipal Court and also at the best
d w and,
WHEREAS, It an is the lo Court est cost; and the City's desire to acquire a turn -key
installation by authorizing ASTI to also provide the
necessary, compatible hardware and to install and maintain
the entire computer system; and,
WHEREAS, 1t is the Court and the City's desire to lease the entire
computer system, in a manner authorized by law; and,
WHEREAS, There is a time limitation in that it is unknown whether the
Court's current software or hardware is Y2K compatible.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
SECTION 1: That the Municipal Judge, Mayor and City Clerk are hereby
authorized to enter into a lease agreement with ASTI of Fort
Smith, Arkansas, for the furnishing, turn -key installation, and
maintenance of a complete municipal court computer system,
both hardware and software, and for providing the necessary
training and periodic upgrade for the most efficient use of
the system. Said lease agreement shall be for the amount of
not more than $22,000.00 per year for a total term of not
over five (5) years, with appropriate other terms to make the
0 lease agreement compatible with current state law.
SECTION 2: That due to the necessity of utilizing a software system which
best meets the needs and procedures of the Municipal Court;
and due to the necessity of the computer hardware being
compatible with, and adequate to operate, the software; and
due to the time limitations necessitated by the need to have
the new computer system operational before January 1, 2000,
it is determined that a unique and exceptional situation exists
and formal bidding for the computer system is not feasible or
practicable, therefore, the requirement of competitive bidding
is waived.
SECTION 3: That the immediate acquisition of the municipal court
computer system is necessary for the system to become
operational prior to January 1, 2000, and that an operational
municipal court system being necessary for the preservation
of the public peace, health, comfort, convenience, safety and
welfare of the citizens of the City of Van Buren, Arkansas, an
emergency is declared to exist and this ordinance shall be in
full force and effect from the date of its publication.
