Dear Member ofthe Board of Adjustment;
I am respectfully requesting a variance to the ordinance for the width of my driveway entry
from Powderhorn Circle. My single-family residence sitting at 811 Powderhorn Circle, Van
Buren, AR, lot 85, Oliver Springs Subdivision IV, parcel number 700-05130-219, with a total
living space of 2178 square feet was built in 2009 with a 3-car garage. Since ownership of the
property improvements have been made not limited to fencing the backyard and widening the
driveway. Future improvements will include an unattached garage as well. To ease congestion
onto my property, I would like to widen the driveway entry from its current width of 40 feet to
60 feet.
The property west of mine has powerlines running across it and is planned to be part of a Van
Buren City walking trail in the future. There are city vehicles, including tractors, that would
benefit from the widening of the driveway entry to my home as it could be used to more easily
access the city -owned property adjacent.

VARIANCE REQUEST: A request from the Driveway/Access Ordinance to allow the existing
driveway to be widened to 60 feet in width. The Ordinance allows a
30 feet wide driveway.
REASON FOR VARIANCE: NIr. Balleger's has submitted a letter explaining his reason
foI this variance request. See attached packet of
information from Mr. Balleger.
BOARD OF ZONING ADJUSTMENT PURPOSE:
To hear and decide applications for variance from the terms of this Ordinance. in cases where a
specific place of property characterized by exceptional narrowness, shallowness or shape was a
lot or record at the time of adoption of this Ordinance; or where by reason of exceptional
topographic conditions or other extraordinary or exceptional situations or conditions of a piece of
property; provided that such relief may be granted without substantial detriment to the public
good and without substantially impairing the intent and purpose of this Ordinance as specifically
authorized in Article VI, Sections 1 and 3.
STAFF COMMENTS: Mr. Ballenger indicates his existing driveway is 40 feet wide and he
wants to widen it to 60 feet. (see the attached�crcicet afinfornaation fionz Mr. Balleger) The
Driveway/Access Ordinance allows for a 30 feet wide driveway. This dimension is the width of
the driveway as measured at the property/right of way line.
