('1 -2022 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: t AN ORDINANCE TO ABANDON A PUBLIC UTILITY EASEMENT ALONG LOTS 18 AND 19 IN THE TWIN CIRCLE COMMERCIAL PARK, PHASE I ADDITION INSIDE THE CITY LIMITS OF VAN BUREN, CRAWFORD COUNTY,ARKANSAS. E:" i WHEREAS, a petition has been filed with the City Council of Van Buren,Arkansas, by Simmons Foods,Inc.,represented by Hoffman&Associates to vacate and abandon the public t. utility easement along certain Lots 18 and 19 inside the Twin Circle Commercial Park, Phase I more particularly described as follows: t Description of Existing 15.00 Foot Utility Easement 1 See Exhibit"A"attached t ; and WHEREAS, after due notice as required by law,the Council has heard all persons desiring to be heard on the question of abandoning the easement in the hereinabove subdivision, and has ascertained that the easement hereinabove designated has therefore been dedicated to the public use as a public easement; and that the owners of the property abutting the t easement to be abandoned have filed with the City Council, or have expressed their consent to abandonment, and the public interest and welfare are not adversely affected by abandoning said easement; and r# l WHEREAS, the City Council of Van Buren, acting under the authority of A.C.A. 14-199-103 and A.C.A. 14-301-112,has the authority to abandon easements or segments thereof. I NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT: I t' 1 SECTION 1: The City of Van Buren,Arkansas,hereby releases, and abandons all its rights,together with the rights of the public generally, in and to the utility easement specifically described above. t SECTION 2: A copy of this Ordinance bearing original signatures and duly certified by the City Clerk shall be filed in the Miscellaneous Records of the Circuit Clerk of Crawford County, Arkansas. DATE: APRIL 12, 2022 ttk 5 Simmons Foods, Inc. is proposing significant improvements to its facility at 2101 Twin Circle Drive including a building addition,new parking, and a detention pond. To facilitate these improvements Simmons Foods has submitted a petition to abandon an existing utility easement. The existing utility easement has not been utilized by a utility for many years. Arkansas Code Annotated (A.C.A.) 14-199-103 gives cities such as Van Buren the power and authority to vacate public utility easements by following procedures found in A.C.A. 14-301-301 through 14-301-306. Simmons Foods, Inc. has submitted a petition in accordance with these E` requirements. T In accordance with A.C.A. 14-301-302 the City Council passed Resolution 03-03-2022 for the purpose of setting April 25, 2022, as the day for the public hearing of the petition. In accordance with the terms of the Resolution and Arkansas law,the notice of the public hearing has been published once a week for two consecutive weeks. The petition has also been reviewed by the City Departments and franchise utilities with no concerns from anyone. The Ordinance on the Council's agenda is the next step in the process to abandon the public utility easement. Following the Council's approval of the Ordinance the City clerk will file the Ordinance with the Circuit Clerk of Crawford County. Please contact me if you have any questions.
