ORDINANCE NO. )3 -1999
AN ORDINANCE ENACTING A FLOOD DAMAGE PREVENTION REGULATORY
CODE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,
ARKANSAS:
SECTION 1: Section 14.08.01 of the Van Buren City Code is hereby
amended to read as follows:
"There is hereby adopted by reference the 1989 Flood Damage
Prevention Regulatory Code for the City of Van Buren,
Arkansas, such flood damage prevention regulatory code having
been designated by the Legislature of the State of Arkansas and
set forth in A.C.A. 14- 268 -101 through 14- 268 -105. Three
copies of the referenced regulatory code shall be available in the
office of the Van Buren City Clerk for inspection and copying
by any person during normal office hours,"
SECTION 2: PENALTY: No structure or land shall hereafter be constructed,
located, extended converted, or altered without full compliance
with the terms of this ordinance and other applicable
regulations. Violation of the provisions of this ordinance by
failure to comply with any of its requirements (including
violations of conditions and safeguards established in
connections with conditions) shall constitute a misdemeanor.
Any person who violates this ordinance or fails to comply with
any of its requirements shall upon conviction thereof be fined
not more than $1000.00 or imprisoned for not more than 10
days, or both, for each violation, and in addition shall pay all
costs and expenses involved in the case. Nothing herein
contained shall prevent the (City of Van Buren) from taking
such other lawful action as is necessary to prevent or remedy
any violation.
SECTION 3: It is hereby found and declared by the Van Buren City Council
that severe flooding has occurred in the past within its
jurisdiction and will certainly occur within the future; that
flooding is likely to result in substantial injury or destruction of
property within its jurisdiction. In order to effectively comply
with minimum standards for coverage under the National Flood
Insurance Program; and in order to effectively remedy the
situation, it is necessary that this Ordinance become effective
immediately. Therefore, an emergency is hereby declared to
exist, and this Ordinance being necessary for the immediate
protection of the public peace, health and safety shall take effect
immediately on its passage and approval.
