ORD NO 12-1999 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. -1999 AN ORDINANCE ADOPTING THE 1999 ARKANSAS STATE FIRE PREVENTION CODE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: That Section 11.20.01 of the Van Buren City Code is hereby amended to read as follows: "There is hereby adopted by the City for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Arkansas State Fire Prevention Code, 1999 Edition, and the whole thereof, save and except such portions as are herein after deleted, modified or amended, of which code not Tess than three (3) copies have been and now are filed in the office of the City Clerk/Treasurer and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the corporate limits of Van Buren, Arkansas." SECTION 2: All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance are hereby repealed. SECTION 3: The City Council hereby declares that should any section, paragraph, sentence, or word of this ordinance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this ordinance independent of the elimination here from of any such portion as may be declared invalid. SECTION 4: PENALTY- Arkansas State law (Arkansas Code Annotated 15 -55- 102) empowers municipal corporations to adopt ordinances to provide for the safety, health, comfort, and convenience of inhabitants of the City. Violations of the Standard State Fire Prevention Code shall be punishable as a misdemeanor offense and shall be punishable by a fine of up to $250.00. Each day that said violation continues shall be a separate offense and each day subsequent to the first day of the violation shall be punishable by a fine of up to $250.00 per day. SECTION 5: It is urgent that the City of Van Buren have up -to -date and viable codes to protect the lives and property of the citizens of Van Buren, thereby an emergency is declared to exist and this Ordinance being necessary for the immediate protection of the public peace, health and safety shall take effect immediately on its passage and approval.
