December 7, 2021
1. Call To Order. the Van Bwen Plaiming Cotmnission held its monthly meeting on
Tuesday, December 7, 2021, at 5:30 P.M. The meeting was held at the Municipal Complex in the City
Council Chambers.
2. Roll Call. The following Commissioners were present Chairman Andy Dibble, Vice-
Chai-man Philip Bagby, Mask Evans, Missy Hefner, Mason Shirey, John Symonds, Tiffany Webster,
and Jay White. City staff present were Planning Director Wally Bailey, City Inspector David Martin,
Secretary Jennifer Willoughby, and City Attorney Jacob Howell. Commissioner Jason Myers was
absent Present for Agenda hem #4: Allen Deaver and Isaiah Filley of Morrison -Shipley on behalf
of Ryder Shnmons Food. Present for Agenda Item #6: Kevin Hardcastte of The Current Church.
Present for Withdrawn Agenda Item #7: Darlene Bowers and Melinda Wynn. Present for Agenda
Item #8: James Damson of Risley Architects, Eric Pearson, and Joshua Lane.
3. Approval Of Minutes From November 2, 2021. A motion to approve was made by
Vice -Chairman Philip Bagby and seconded by Coi tr ssioner Jay White. The motion was approved
unanimously.
4. Public Hearing For Variance #3-2021—Ryder Simmons Food, 2103 Twin Circle
Drive; To Expand Inside 25' Yard Setback In I-2 Hcavy Industrial District. A mot on to
approve was made by Vice -Chairman Philip Bagby and seconded by Commissioner Mason Shhey.
The motion was approved unanimously.

5. Public Hearing For Zoning Code Amendment —Amend The R-313 Condominium
District To Add Churches As A Conditional Use. A motion to recommend City Council approve
an amendment to the zoning code was made by Commissioner John Symonds and seconded by
Commissioner Mark Evans. The motion was approved unanimously.
6. Public Hearing For Conditional Use Permit #5-2021-2020 Dora Rd —The Current
Church; To Allow Church And Church Expansion In R-3B. the motion to approve, contingent
upon the zoning code amendment passing City Council; was made by Commissioner Mark Evans and
seconded by Commissioner Tiffany Webster. The motion was approved unanimously.
The Current
Church has
purchased this
property which includes an
existing church facility. The
church wants
to construct
an addition to
one of the church buildings.

The zoning of this property is R-3B which does not allow churches. It was approved in the previous
agenda item for the Planning Commission to recommend City Council approve an amendment to the
zoning code that will allow churches as a conditional use in the R-313 zoning districts.
7. Public Hearing For Rezone 412-2021-406 North i —Satterfield Surveyors/Willie
Mooney; C-2 to 11-3. This agenda item was withdrawn by Willie Mooney.
8. Pubhc Hearing For Rezone #3-2021-2322 Dora Rd —Risley Architects/Z H
Siddiqui, LLC; R-2 to R-3. The motion to deny was made by Commissioner John Symonds and
seconded by Commissioner Mark Evans. The motion was denied unanimously.
This rezoning application was tabled at the November 2, 2021, mectuig. The applicant wants to
proceed with the proposed rezoning application as submitted with multiple duplexes and using one
drive coming off of Green Meadow Drive. If this is approved the Master Land Use Plan will need to
be changed. James Damron of Risley Architects stated that he believes it is safer to use one drive
coming off of Green Meadow. Chairman Andy Dibble brought up that in the last meeting the
surrounding property owners' main complaint was of multiple driveways; one drive fixes that issue.
Chairman Dibble asked if the public had anything to say. Eric Pearson, 1704 Kalei Lane, said he is
worried about future use because he does not want apartments next to his house. Mr. Damson said
the plan is to have duplexes with quality tenants, not apartments. Josh Lane, 2061 Green Meadow
Circle, asked can the property be rezoned back to R-2. Chairman Dibble and Planning Director Bailey
answered him: yes. Mr. Lane wanted clarity from Mr. Damson that they plan to have better quality
tenants in duplexes and not apartments. Mr. Damron answered yes. Commissioner Missy Hefner
noted that current owners cannot guarantee what will be built on the property if sold. Commissioner
Marls Evans, Commissioner Hefner, and Commissioner John Symonds all stated that they do not want
the property rezoned to R-3. Chairman Dibble told Mr. Damron that his client can appeal the decision
to the City Council.
