VARIANCE REQUEST:
From 25 feet to 8 feet from the right of way/property line next to the ARDOT right of
way of Interstate 540.
BOARD OF ZONING ADJUSTMENT PURPOSE:
To hear and decide applications for variance from the terms of this Ordinance in cases where a
specific place of property characterized by exceptional narrowness, shallowness or shape was a
lot or record at the time of adoption of this Ordinance; or where by reason of exceptional
topographic conditions or other extraordinary or exceptional situations or conditions of a piece of
property; provided that such relief may be granted without substantial detriment to the public
good and without substantially impairing the intent and purpose of this Ordinance as specifically
authorized in Article VI, Sections 1 and 3.
PURPOSE OF THE VARIANCE:
The variance will facilitate the relocation of an existing open canopy structure to accommodate the
expansion of the building. This will also help facilitate semi -truck circulation within the site.

RE: Building Setback Variance Request
Dear Mr, Wally Bailey:
Ryder Simmons Food Company is expanding upon their existing facility located at 2101 Twin Circle Drive,
Morrison -Shipley I Halff will be representing the owner (Simmons) for the proceedings. The existing facility's
use consists of poultry processing. The expansion is taking place on the northern portion of the lot
described as Part NW/4 SE/4 S30-T9N-R31 W. The property is currently zoned as Industrial-2 (k2) which
requires that buildings be set back from property lines a minimum of 25'. As part of the project, an open
canopy structure will need to be relocated to accommodate the expansion of the building. It would be most
ideal, for semi -truck circulation within the site, that this structure to be located on the north edge of the
pavement surface. Within the building setback line. We are requesting a variance from the 25' building set
back to 8' in order to locate the open canopy structure where it is shown on the attached preliminary site
plan. The canopy location is highlighted. I have also attached a picture of the existing canopy that is being
replaced for your benefit to know exactly what the structure will look like. Attached you will also find a
survey of the property completed by Hoffman Associates Inc.
