PLANNING COMMISSION MINUTES
August G, 2019
The Van Buren Planning Commission held its monthly meeting on Tuesday, August 6, 2019 at 5:30 P.M., in
the City Council Room of the Municipal Complex.
Members Present — Chairman Andy Dibble, Philip Bagby, Mark Evans, John Symonds, Jay White, Mark
Evans, Tiffany Webster, Jason Myers and Mason Shirey. Others Present -Wally Bailey, Planning Director,
David Martin, City Building Inspector, Candice Settle, City Attorney and Ricky Hill, Satterfield Surveying.
The first item on the agenda was to approve the minutes from the last meeting. A motion was made by John
Symonds and seconded by Tiffany Webster to approve the meeting minutes. The motion was approved
unanimously.
Chairman Andy Dibble recommended the commission hear item#3 on the agenda first due to time
constraints. The item on the agenda was Ricky Hill from Satterfield Surveying for the Ballentine Tracts 2A,
2B &2C, and Moses Tracts 1A & 2A for review. Mr. Ricky Hill presented the Ballentine Tracts first to the
commission. Tract 2B needs access across tract 2A. The subdivision review committee requested a 20'
easement between tracts 2B & 2C, along with a 15' utility easement on the front lots of 2A and 2C. The
Arkansas Department of Transportation's ROW on 282 is 25' off center line. Next was the Moses Tracts 1 &
2, needing access easement on eastside of Tract 1. Nothing in the subdivision regulation addresses off site
easements. A motion to approve the plat by Philip Bagby and seconded by Jason Myers with the condition
that the access easement be shown inside west side of Tract 1, and any additional subdividing of this plat, the
owner would have to come before the Planning Commission so the street will be developed. The motion was
approved unanimously.
Next item was the public heating to consider an ordinance concerning small wireless facilities. Wally Bailey,
Planning Director, presented a power point to the commission concerning Act 999, which is an Act to
Establish the Small Wireless Facility Deployment Act. The purpose of the Act is to establish state wide
consistency and fairness with regard to procedures, rates and fees for new small wireless facilities. The Act
has an effective date of September 1, 2019. A motion was made by Philip Bagby and seconded by John
Symonds to recommend the City Council review and approve an ordinance creating strong regulations for
small wireless facilities. The motion was approved unanimously.
A motion was made by Jason Myers and seconded by Tiffany Webster to adjourn.
