PLANNING COMMISSION MINUTES
February 5, 2019
The Van Buren Planning Commission held its monthly meeting on Tuesday, February 5, 2019 at 5:30 P.M., in
the City Council Room of the Municipal Complex.
Members Present — Chairman Andy Dibble, Vice Chairman Philip Bagby, Mark Evans, Jason Myers, John
Symonds, Jay White, Tiffany Webster, Lynne Graham and Mason Shitey. Others Present -David Martin, City
Building Inspector, Candice Settle, City Attorney and Marvin Richesin.
The first item on the agenda was to approve the minutes from the last meeting. A motion was made by
Tiffany Webster and seconded by Philip Bagby to approve the meeting minutes. The motion was approved
unanimously.
Next item was for the public hearing on Rezone#1-2019, Marvin Richesin, 3103 Kibler Road, Van Buren.
Mr. Richesin stated his family lived on and owned this property since 1952, but has been empty since 2014. It
was only recently he found out it was zoned Industral-2 (Heavy Industrial District) because they are trying to
sell the property. Mr. Richesin is requesting the rezone from I-2 to R-3 thinking it will help in the sale of the
property. Chairman Andy Dibble stated he checked on the flood map concerning this property and noted it
was in the floodplain and floodway. Chairman Dibble asked the city building inspector if any calls from the
public were received. Mr. David Martin said some of the surrounding businesses were against the rezone.
The original zoning map of 1967 shows the property zoned I-2 so it was brought into the city as non-
conforming. No residential zoning is attached to the property; it is surrounded by major thoroughfares. After
further discussion, it was decided by Mr. Richesin that he would do further inquiring about whether to rezone
commercial or residential for selling purposes. A motion was made by Philip Bagby and seconded by Lynne
Graham to table the rezone for next meeting allowing the Richesins more time to consider their rezone
request. The motion was approved unanimously.
The next item on the agenda was for a public hearing on the Conditional Use Permit #1-2019, Heritage
United Methodist Church, 1604 East Pointer Trail. The church has authorized Mark Evans, E Squared
Architecture & Interior Design, to act as their agent. Mr. Evans asked for a Conditional Use Permit for the
construction of the new Phase-1 addition to their existing facility. There will be a total of six (6) phases to this
project. A motion was made by Mason Sbirey and seconded by Philip Bagby to approve the permit. Jason
Myers, John Symonds abstained. The motion passed.
