PC Minutes 2-4-2020+ �' Amex I I North 12' Street 9 Van Buren, Arkansas 7295fr PLw41uV1kT1VG COUIIISSIOV ITULUTES February 43 2020 The Van Buren Plannntg Commission held its monthly meeting on Tuesday, February 4, 2020 at 5:30 P.M., in the City Council Room of the Municipal Complex. Members Present= Chairman Andy Dibble, Vice Chairman Philip Bagby, Mark Evans; Jason Myers; Jay White, Lynne Graham and Mason Shirey. Others Present -Planting Director Wally Bailey. David Martin, City Building Inspector, Candice Settle, City Attorney. The first item on the agenda was to approve the minutes from the last meeting. A motion was made by Jason Myers and seconded by Mark Evans to approve the meeting minutes. The motion was approved unanimously. Next item on the agenda was for Omar Figueroa 30-day extension fox mobile vending unit permit. Planning Director Wally Bailey stated after further review of the changes to the commercial trailer and mobile vending unit permit ordinance, extensions were no longer allowed. Mr. Figueroa can apply for a new 120-day permit since it is per calendar year and his permit expired in December of 2019. No action requited by the Planning Comnssion. The next item on the agenda was on a public hearing for an amendment to the sidewalk ordinance. Planning Director Wally Bailey stated the current sidewalk ordinance has a provision for a fee payment in lieu of construction. The provision states that the amount of the fee will be determined as the actual dollar value of sidewalk construction for sidewalks that are required. A recent variance request revealed that the actual dollar value of a sidewalk construction at some locations can be very expensive and maybe unreasonable to the applicant. After doing some research with two cities that have similar ordinances, I found that they ate using a specific cost to determine the dollar value of the fee payment. I also reached out to a local civil engineering firm to obtain their input on basic sidewalk construction costs. All three (3) gave me essentially the same cost figures which equates to about $20.00 a linear foot. I am proposing an Ordinance amendment that is similar to another local city's ordinance that establishes the fee at $20 per linear foot an establishes an annual review by the Planning Commission so that any changes to the fee can be recommended to the City Council. A motion was made by Philip Bagby and seconded by Lynne Graham to recommend the proposed amendments to the City Council. The motion was approved unanimously. Next item was on a public hearing for an amendment to the zoning ordinance concerning commercial communication towers. Planning Director Wally Bailey stated two proposed amendments. First amendment is for application submittal requirements adding "A building permit is required for any new tower construction, tower addition, tower alteration, and the addition or relocation of any antenna equipment on a tower. Prior to commencing development of any proposed work to the tower site, construction plans shall be submitted to the City's Building Department in accordance tithe the City's building permit review procedures and the requirements of this Ordinance. Second amendment is under exemption adding "and must be located on the same lot as the principal building or use. A building permit is required for accessory towers. The building permit fee for an accessory tower is $20.00, An antenna and tower that is not an accessory must comply with all the provisions of this ordinance including permits and fees." Add under exemptions "non-commercial," A motion was made by Marls Evans and seconded by Jason Myers to recommend proposed changes to the City Council. Lynne Graham abstained. Motion was approved. The next item was for a public hearing on an amendment to the zoning ordinance concerning pennits, height and setback requirements for accessory structures. Planning Director Wally Bailey stated the following proposed amendments to the ordinance: Accessory building or structure shall mean a building or structures that is incidental and subordinate to and serves a principal building or principal use and is located on the same site as the principal building or principal use. Accessory buildings or structures may be permanent or portable. Examples of an accessory building or a structure include site built or prefabricated buildings, shipping or cargo containers, and similar structures but does not include portable play equipment and containers or temporary buildings used on a construction project. Buses, mobile homes, manufactured homes, RV's, motor vehicles or trailers must comply with all applicable city ordinances. The proposed conversion of one of these to an accessory structure will require a conditional use permit from the Planning Commission. The requirements of this section do not apply to towers permitted by the commercial communication tower provisions of this ordinance. Twine: No accessory build ng or structure shall be erected or placed on any property prior to the iss fiance of the building permit for the principal structure, unless the accessory structure shall have been approved by the Planning Commission as a conditional use. The minimum building permit fee shall be based on the currently approved building permit fee schedule with a minimum fee of $20.00, Heieht: An accessory building or structure on residential property shall not exceed the height of the principal strgcture_or the permitted height limits of the zoning district, whichever is less, A _commercial or industrial accessory building or structure shall comply with the requirements of the zoning district. Setbacks: The accessory building ox structure shall comply with the required tviruitnum setbacks of the zoning district. Accessory buildings or structures cannot be in easements. No structure shall be closer to the street ROW principal structure. Separation: Accessory buildings or structures shall be setback ten (10) feet from a principal ox accessory building or structure unless this code or the Fire Code requires a greater separation. Size of Accessory Suuctuxe(sl: The cumulative total area of all residential accessory buildings ox structures shall not exceed 90% of the covered roof area of the principal building. Accessory buildings or structures in commercial or industrial zoning districts shall comply with the lot coverage requirements of this code, the Fire Code or other applicable codes. Compliance with Restrictive Codes: Any electrical, mechanical or plumbing installed in an accessory building require the necessary permits and inspections to ensure compliance with those respective codes. Covenants: Nothing in this Ordinance shall be construed as to allow an accessory building or structure which would otherwise violate the restrictive covenants of the subdivision, or other restrictions on use in the chain of title, of the principal structure. New/Old Business: Planxitug Director Wally Bailey stated to the Planning Commission the need for a public hearing on the Master Steeet Plan. He asked the commission if they wanted a special meeting or to have on out regularly scheduled commission meeting. The Planning Commission stated just to have a public hearing on the regular meeting.
