BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS, AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE AMENDING ORDINANCE NO. 15-1972;
AND FOR OTHER PURPOSES.
WHEREAS, Parking on certain streets within the City of Van Buren poses a danger to vehicles
utilizing the roadway and impedes access of emergency personnel; and
WHEREAS, The Planning Commission held a public hearing regarding restricting parking on
certain streets in addition to those listed in Ordinance No. 15-1972 within the City
of Van Buren; and
WHEREAS, After the public hearing, the Planning Commission recommends that parking on
additional streets in the City of Van Buren be prohibited; and
WHEREAS, Ordinance No. 15-1972 was previously enacted limiting parking on certain streets
within the City; and
WHEREAS, Ark. Code Ann. Section 27-49-106 provides that the City Council has the
authority to regulate the parking of vehicles on the streets and highways within
the City and to provide signs notifying the public of the regulation, and
WHEREAS, the City Council for the City of Van Buren desires to limit parking on additional
streets within the City to protect the health, safety and welfare of its citizens.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: Section 1 of Ordinance No. 15-1972 is amended to add the following:
Section 1(a): For the purposes of this Ordinance,the following definitions apply:
Cul-de-sac—the portion of a street (as defined by this ordinance)that is within
twenty feet of and including the circular turnaround at the end of a dead-end
street. Street-the roadway portion of a public street right of way that is
designed to accommodate traffic flow.
SECTION 2: Section 1 of Ordinance No. 15-1972 is further amended to designate the former
Section 1 as Section 1(b),and,pursuant to the authority granted by A.C.A. §27-49-
106,to add the following streets that parking is prohibited on within the City of
Van Buren:
Access Road -all blocks
All Cul-de-sacs within the city.
Alma Blvd - all blocks
Arkansas Street - from Knox Street to Prospect Avenue
Azure Hills-all blocks
Breckenridge Drive - from North 16th Street to Durango Drive.
Dora Road - all blocks
Durango - from Legacy Blvd to Breckenridge Drive.
Fir Drive - all blocks.
Flat Rock Drive -all blocks.
Industrial Park Road - all blocks
Legacy Blvd—all blocks
North Hills Blvd -from Pointer Trail West to Deer Trail
North Hills Blvd. -from Rena Road to Northridge Drive.
Northridge Drive—Quarry Drive to Oliver Springs Road
Pevehouse Road -from Rena Road to Sandstone Drive.
Poplar Street—from Arkansas Street to North 20th Street
Rena Road- all blocks
Sandstone Drive- from North Hills Boulevard to Pevehouse Road
Sandstone East- from Highway 59 to Legacy Drive.
Vista Hills- all blocks.
North 9th Street - from McKibben Street to Pointer Trail East
North 11 th Street- all blocks
North 16th Street- from Pointer Trail to the city limits
North 20th Street-all blocks
North 28th Street- all blocks
South 11 th Street-all blocks
South 28th Street-all blocks
South 40th Street- all blocks
SECTION 3: That Section 1(a) of Ordinance No. 15-1972 shall be amended to substitute "24th
Street from Alma Boulevard to Pointer Trail"with "North 24th Street- all blocks."
SECTION 4: That Section 2 of Ordinance No. 15-1972 is amended to read as follows:
"Appropriate signage shall be placed notifying the public of the restriction. After
signs prohibiting parking are erected upon said streets, boulevards or highways, no
person shall park a vehicle in any of the above designated places. Streets with City
designated parking spaces are exempt from the on-street parking prohibition."
SECTION 5: That Section 3 of Ordinance No. 15-1972 shall be amended to substitute fine
amount of"not more than twenty-five dollars"with"not more than two hundred
and fifty dollars."
SECTION 6: The various provisions and parts of this Ordinance are hereby declared to be
severable,and, if any section or part of a section,or any provision or part of a
provision herein, is declared to be unconstitutional, inappropriate,or invalid by
any court of competent jurisdiction, such holding shall not invalidate or affect the
remainder of this Ordinance and to that extent the provisions hereto are declared to
be severable.
IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did
pass, approve, and adopt, by a vote of 5 for and C7 against, the foregoing Ordinance at its
regular meeting held on the 23`d day of November, 2020.

SUBJECT: NO PARKING ON THE STREETS ORDINANCE

For several months the Planning Commission, City staff, and City Attorney have been working
on an Ordinance that restricts parking on certain city streets. The initiative was proposed by the
Fire and Police departments as they identified a number City streets that present problems and
potential problems with their ability to adequately respond to emergencies.
The Planning Commission held three(3)public meetings and two (2)public hearings on the
proposed Ordinance. Additionally the Press Argus Courier published an article on Saturday,
August 29, 2020. The only public input I have received were from citizens that wanted more
added because of problems in their neighborhood.
The Ordinance is amending an existing City Ordinance prohibiting on street parking on certain
streets and includes a new list of all applicable streets; a requirement that signage be placed on
all streets notifying the public of the parking restriction and amending the current fine amount
from not more than$25.00 to not more than$250.00.
After the public hearing at the October 6, 2020,public hearing the Planning Commission voted
to recommend the Ordinance to the City Council.
