MINUTES OF THE VAN BUREN,ARKANSAS
CITY COUNCIL MEETING OCTOBER 26,2020
The City Council of the City of Van Buren,Arkansas met at 5:30 p.m. Monday, October 26,
2020 at the Van Buren Public Library. The meeting was called to order by Mayor Hurst. On roll call,
the following Council members answered as their names were called: Council Member Dodson,
Kneeland, Petty, Swaim and Wood. City Clerk-Treasurer Phyllis Thomas and City Attorney Candice
Settle were present. This made a total of eight(8) present. A quorum was declared.
The invocation was given by Council Member Tyler Wood.
Council Member Wood then led the Pledge of Allegiance.

ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION APPROVING AND ACCEPTING THE REPLAT OF
FINAL PLAT OF "LEGACY PLACE, PHASE 1, LOTS 1-21" WITHIN
THE CITY OF VAN BUREN,CRAWFORD COUNTY,ARKANSAS.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the laws of the State of
Arkansas,with all powers,authority and duties of a city of the first class,and under such
authority has adopted the Subdivision Regulations for the City of Van Buren(Ordinance
No.7-2003);and
WHEREAS, the Van Buren Planning Commission reviewed and approved this replat fmal plat on
October 6,2020;and
WHEREAS, as a result of this meeting,the proposed Replat Final Plat hereto was recommended by a

SECTION 1: Subject to the assurances provided in the Code of General Orders of the City of Van

improvements are put in and that all requirements of the Planning Commission are met,
the submitted Replat of Final Plat for Legacy Place,Phase 1.Lots 1-21 within the City of
Van Buren,is hereby approved and accepted.

SECTION 2: The Mayor is authorized and directed to sign said plat document and the City Clerk is

items or item be removed from the City's Fixed Asset Inventory and disposed of by sealed
bid,auction or as otherwise authorized under A.C.A§14-54-302.

A RESOLUTION RELATING TO SIGNATURE CARDS FOR
THE CITY OF VAN BUREN.
WHEREAS, Administrative Assistant Jennifer Froud will be leaving her position effective October 1,
2020;and
WHEREAS, Julie Copple will start the position of Administrative Assistant effective October 2,2020;
and
WHEREAS, it is necessary to authorize signatures of certain individuals to draw vouchers on funds
deposited in various banks by the City of Van Buren,Arkansas;and
WHEREAS, it is also necessary to authorize signatures of certain individuals for entry into Safety
Deposit Box or Boxes now leased by the City of Van Buren,Arkansas, or leased by
• them in the future.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN,
ARKANSAS,THAT:
SECTION 1: Effective October 1,2020,the said bank or banks are hereby authorized to pay out funds
on deposits with them from time to time to be credited to the City of Van Buren,Arkansas,
upon vouchers drawn upon said banks and signed by any combination of the following two
persons:Mayor Joe Hurst,City Clerk-Treasurer Phyllis Thomas,Administrative Assistant
Julie Copple,or Deputy City Clerk Connie Hyatt.
SECTION 2: Effective upon passage of this resolution,the said bank or banks are authorized to allow
into Safety Deposit Box or Boxes now in the name of the City of Van Buren,Arkansas,by
the Mayor Joe Hurst, or the City Clerk-Treasurer Phyllis Thomas, or Administrative
Assistant Julie Copple,or Deputy City Clerk Connie Hyatt,or by any one of them.
SECTION 3: Mayor Joe Hurst,City Clerk-Treasurer Phyllis Thomas,Administrative
Assistant Julie Copple,and Deputy City Clerk Connie Hyatt,are authorized and
directed to sign signature cards with each of the banks to carry out the purposes of this
Resolution.
SECTION 4: The City Clerk-Treasurer is directed to furnish a copy of this Resolution under the Seal of
the City of Van Buren,Arkansas,to each of the banks with which the City has or will have
Depository arrangements and/or Safety Deposit Boxes.

On the agenda next was to consider A RESOLUTION SETTING A PUBLIC
HEARING DATE FOR VACATING AND ABANDONING A PUBLIC UTILITY
EASEMENT ALONG LOT 34, LEGACY PARK PHASE 1, AND LOT 79, OLIVER
SPRINGS HEIGHTS PHASE IV, IN THE CITY OF VAN BUREN,ARKANSAS. The
Clerk read the Resolution in its entirety. Mayor Hurst asked if there was any discussion. Mayor
Hurst explained that this is just setting the public hearing for this matter. In the meantime, it will
go to the Planning Commission to be evaluated for any issues. Council Member Petty seconded
by Council Member Swaim moved that the Resolution be adopted. On the Clerk's calling the
roll,the following vote resulted: Ayes—Council Member Wood,Kneeland, Petty, Dodson, and
Swaim.Nays—None.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was
attested by the City Clerk and impressed with the seal of the City.

Library,at which time said Petition shall be presented to the City Council and the

be vacated and abandoned and that all affected property owners and other persons
directly interested have consented to such vacating and abandoning.
SECTION 2: The City Clerk of Van Buren,Arkansas,is hereby directed to give notice by publication
once a week for two consecutive weeks in some newspaper,published in Crawford
County,advising the property owners and others affected,of said date and time the
Council will hear said Petition.

THE MILLAGE TAX FOR THE CITY GENERAL MUNICIPAL PURPOSES AND FOR
THE PUBLIC LIBRARY PURPOSES FOR THE YEAR 2020; DECLARING AN
EMERGENCY; AND FOR OTHER PURPOSES. The Clerk read the Ordinance in its
entirety. Council Member Wood moved that the rules be suspended and the Ordinance be placed
on its second reading. The motion was seconded by Council Member Dodson. The council
followed with a unanimous vote. The Clerk then read the Ordinance the second time.
Council Member Wood moved that the rules be further suspended and the Ordinance
placed on the third and final reading. The motion was seconded by Council Member Dodson.
The council followed with a unanimous vote. The Clerk then read the Ordinance the third and
final time. The Mayor asked if there was any discussion. Mayor Hurst stated that the maximum
allowed millage by the State of Arkansas is five (5) mil. The City of Van Buren is currently at
two (2)mil. He said in the future we might look at raising that millage, but right now doesn't
seem like the appropriate time to be doing so. Council Member Petty clarified that this is not a
raise in taxes. Mayor Hurst concurred.
The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by Council
Member Swaim and seconded by Council Member Kneeland to adopt the Ordinance. On the Clerk's
calling the roll, the following vote resulted: Ayes—Council Member Wood, Kneeland, Petty, Dodson,
and Swaim. Nays—None. The Mayor declared the motion carried as there were five (5) ayes and (0)
nays. Four(4) votes being necessary for passage.
Motion was made by Council Member Swaim and seconded by Council Member Wood,that the
emergency clause be adopted. On the Clerk's calling the roll, the following vote resulted: Ayes—
Council Member Wood, Kneeland, Petty, Dodson, and Swaim.Nays—none.

BUREN CIVIL SERVICE RULES AND REGULATIONS, AND DECLARING AN
EMERGENCY. The Clerk read the Ordinance in its entirety. Council Member Kneeland
moved that the rules be suspended and the Ordinance be placed on its second reading. The
motion was seconded by Council Member Petty. The council followed with a unanimous vote.
The Clerk then read the Ordinance the second time.

changes being the order in which they give the written and physical agility tests, the notification
requirements for offering the job to a prospective employee, and adding a polygraph test to
applicants who have been offered the job.

Member Swaim and seconded by Council Member Wood to adopt the Ordinance. On the Clerk's
calling the roll, the following vote resulted: Ayes—Council Member Wood, Kneeland,Petty, Dodson,

Next on the agenda was Miscellaneous and General Discussion. Connie Martin with the
Almost Home Shelter gave a quarterly report to the council. Council Member Swaim asked how
much they spend a year in medical expenses. Ms. Martin stated last year's vet expenses were in
excess of$ 55,000 which is paid for by donations and fundraisers. With budget season
approaching, Council Member Swaim urged the council to consider helping the Almost Home
Shelter.
Police Chief Jamie Hammond presented the Van Buren Police Department Lifesaving
Award to Nurse Anderson with the Van Buren School District, SRO Megan Slayton, and SRO
Heather Hoffsommer for their actions in saving someone's life during a severe allergic reaction.
There being no further business, motion was made by Council Member Swaim and seconded by
Council Member Wood to adjourn. The Council followed with a unanimous vote. The meeting
adjourned at 6:09 p.m.
