ORD NO 04-2000 a 0 ORDINANCE NO. —I -2000 ORDINANCE MODIFYING AND AMENDING ORDINANCE NO. 22 -1997 ESTABLISHING MONTHLY RATES FOR MANDATORY RESIDENTIAL SOLID WASTE COLLECTION SERVICE FOR THE CITY OF VAN BUREN, ARKANSAS WHEREAS, The City of Van Buren has implemented a mandatory residential solid waste management system and recycling program pursuant to Ordinance No. 1992- 25; and, WHEREAS, it is the duty of the City Council of the City of Van Buren to approve rates, charges or contractual fees to be charged by residential solid waste disposal firms, and, WHEREAS, the cost of residential solid waste collection within the City of Van Buren, Arkansas, has increased since the same were established by Ordinance No. 22- 1997, passed and approved October 20, 1997; and, WHEREAS, the Van Buren Municipal Utilities Commission acting as agent for the City has recommended a schedule of fees and charges for operation of the residential solid waste management program. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, that Ordinance No. 22 -1997 is hereby modified and amended as follows: SECTION 1: The monthly rate to be charged for each single family residential unit as defined in Ordinance No. 1992 -25 shall be ($7.89) seven dollars and eighty -nine cents. The effective date of these charges shall be January 1, 2000. These charges shall cover at a minimum once a week residential solid waste collection (excluding removal of yard waste materials), twice monthly curbside recycling collection and the operation of a recycle drop -of center. SECTION 2: The rate set out within Section 1 above shall remain in full force and effect until such time as the Van Buren Municipal Utility Commission has notified the Van Buren City Council that the City Administrator of Fort Smith, Arkansas, has certified to the Board of Directors of the City of Fort Smith that the scale system being 0 constructed at the Fort Smith City Sanitary Landfill is completed. Beginning the first day constructed at the Fort Smith City Sanitary Landfill is completed. Beginning the first day of the month of receipt of such notification by the Van Buren City Council the monthly rate to be charged for each single family residential unit as defined in Ordinance No. 1992 -25 shall be eight dollars and seventy cents ($8.70). SECTION 3: All other provisions of Ordinance No. 22 -1997 shall remain in full force and effect unless expressly modified herein. SECTION 4: That if any section or part of this Ordinance shall be held invalid or unconstitutional it shall not effect the remaining Sections thereof, and the Sections and parts of said Ordinance shall be treated severally. SECTION 5: That due to the need to maintain and enforce a comprehensive city wide residential solid waste management system and recycling program, this ordinance being necessary for the preservation of public peace, health, and safety shall be in full force and effect from January 1, 2000.
