BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION APPROVING AND ACCEPTING THE REPLAT OF
1 FINAL PLAT OF "LEGACY PLACE, PHASE 1, LOTS 1-21" WITHIN
THE CITY OF VAN BUREN,CRAWFORD COUNTY,ARKANSAS.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the laws of the State of
Arkansas, with all powers, authority and duties of a city of the first class, and under such
authority has adopted the Subdivision Regulations for the City of Van Buren (Ordinance
No. 7-2003); and
WHEREAS, the Van Buren Planning Commission reviewed and approved this replat final plat on
October 6, 2020; and
1 WHEREAS, as a result of this meeting, the proposed Replat Final Plat hereto was recommended by a
majority vote of the entire Planning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,CRAWFORD COUNTY,ARKANSAS.
SECTION 1: Subject to the assurances provided in the Code of General Orders of the City of Van
Buren Subdivision Regulations Title 15 et sq., being executed to assure that all
improvements are put in and that all requirements of the Planning Commission are met,
the submitted Replat of Final Plat for Legacy Place, Phase 1,Lots 1-21 within the City of
Van Buren, is hereby approved and accepted.
SECTION 2: The Mayor is authorized and directed to sign said plat document and the City Clerk is
authorized and directed to attest to same upon acceptance by the City of the constructed
improvements or upon filing of any necessary bonds with the City Clerk.
IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass,
approve, and adopt, by a vote of Sfor and C) against, the foregoing Resolution at its regular meeting
held on the 26th day of October 2020.

SUBJECT: LEGACY PLACE PHASE I—CORRECTIVE REPLAT

Brixey Engineering has submitted a corrective replat for Legacy Place Phase I for the
purpose of removing a 20' drainage easement that was originally an off-site drainage
easement that was filed with the Legacy Valley Phase 1 Plat. The easement was originally
there to keep storm water off lots 1 through 10 of Legacy Valley Phase I. I have asked
Brixey Engineering to submit the necessary information for the Planning Commission to be
assured the drainage easement is no longer needed to protect Lots 1 through 10 from
storm water runoff.
The Planning Commission's recommendation on the abandonment of the Drainage
Easement and the corrective replat will be forwarded to the City Council.

RE: Drainage Easement Closure Request—Legacy Place Phase 1
Mr. Bailey:
The developers of Legacy Place Phase 1 have requested a drainage easement abandonment for a
20' drainage easement along the east boundary line. The original basis of design for the drainage
easement was to provide a corridor to cut-off drainage from the west,thus preventing an
unmanageable amount of off-site drainage from draining onto the Legacy Valley Phase 1 lots.
The easement was created with the filing of the Legacy Valley Phase 1 plat. The existing
easement was incorporated into the Legacy Place Phase lfinal plat.
The recently constructed improvements in Legacy Place Phase 1 have eliminated the need for the
drainage easement. A street has been constructed and lots have been graded to cut-off the pre-
development drainage from draining onto the Legacy Valley Phase 1 lots.
A 10' utility easement has been platted adjacent to the 20' drainage easement,along the west
side of the drainage easement. If the drainage easement is abandoned,the adjacent 10' utility
easement will be increased to 15'. This will occur with the re-platting of Legacy Place Phase 1.
I have attached pre-development and post-development drainage maps to show the change in
drainage that has occurred as a result of Legacy Place Phase 1 construction. Mimosa Street has
been designed to adequately convey, drainage from the west side of the Legacy Valley Phase 1
development. It is designed to convey all of sub-basins SB-5 and SB-8, as shown on the Post
Development Drainage Map. Please let me know if you have any questions.
