CITY COUNCIL MEETING HELD FEBRUARY 27, 2006
The City Council of the City of Van Buren, Arkansas met at 7:00 p.m., Monday, February 27, 2006 at City Hall.
The meeting was called to order by Mayor Riggs. On roll call the following Council members answered as Phew nines
were called: Alderman Swaim Parker, Moore, Spoon, Dodd and Sagely. City Attorney Candice Settle and Depth,
City Clerk Carolyn Marston were also present. This made a total of nine (9) present. A quorum was declared.
The Invocation was given by M.. David King with PAC Printers.
Next :\,dayor Riggs led the Pledge of Allegiance.
On the agenda fast was the State of the City Report. Mayor Riggs said he would let everyone read the report
instead o f him reading word for word. The Mayor thanked each department for the near they had and the process ti
had Iasi year. Mayor Riggs said they had been through some trials and tribulations this past year, with the trip to China
and different tugs going on in their lives. He said they all have obstacles in their lives and he wanted to thank the
Council and the Departn heads for the leadership they had shown. Mayor Rigs said he was looking forward to
working with everyone in the future. The Mayor said he would like to submit the report.

STATE OF THE CITY 2005
Van Buren has grown and taken many strides in 2005. From commercial growth to the
residential boom, from the completion of the Phase IX Street Program to the over eleven
thousand volunteers who donated their time and helped Van Buren in being named one of
twelve Volunteer Communities of the Year for 2005. Also the voters approved a bond
issue to build Van Buren a brand new library. The following reports from our Department
Heads will show us how far we have come in 2005 and what we have to look for in 2006.
The City Clerk's Office reports revenues for 2005 totaling $5,083,282.87 with Interest
Income totaling $57,521.84 and City Sales Tax proceeds totaling $3,367,843.09 and
County Sales Tax proceeds totaling $1,879,420.46. Other revenues included Franchise
Taxes $1,217,988.59; Privilege Licenses $133,901,50; Inspection Fees $151,348.63;
District Court Fees $396,678.48; New Library Bond Issue $1,980,359.14 for a total of
all revenues $14,268,344.60. The 2005 Budget was $11,629,718.00 with carry over
amounts of $3,599,039.24 (including the new Library Bond Issue) totaling
$15,228,757.24. Expenditures for 2005 were $14,402,867.64 leaving a balance as of
December 31, 2005, in the amount of $825,889.60. The investment balances were
$1,419,350.40 as of December 31, 2005. There were 902 Privilege Licenses purchased
from the City Clerk's Office in 2005. Of this total, 128 were new businesses.
The Field of Dreams reaped the benefits of the 2004 Babe Ruth World Series in 2005 by
installing lights on the McDonald's Field and installing sprinkler systems on four fields.
We also received a very generous donation of $112,000.00 from Helen and Richard Hodo
to light another full -sized field, which will enable Van Buren High School to bid on the
high school state baseball tournaments in the future. The Contract was signed in 2005 to
host the eight -year -old Cal Ripken, Ir. Regional Tournament in 2006. This tournament
will consist of 24 teams from eight states.

On the agenda next, Mayor Riggs asked to adopt the minutes of the Council Meeting on January 23, 2006 and the
Special Called Meeting on January 30, 2006. Alderman Moore made a motion to approve the minutes. Alderman
Swaim seconded the motion. On roll call the following Council members voted aye: Alderman Swaim, Parker, Moore,
Spoon, Dodd and Sagely. The following voted nay: none.
On the agenda next was to consider A RESOLUTION AUTHORIZING THE PURCHASE OF FIVE POLICE
VEHICLES UNDER TI -IE STATE CON TRACT. Mayor Riggs asked if there were five vehicles. City Attorney
Candice Settle said she would revise the resolution to read four (4) Crown Victoria instead of three (3). The Deputy
Clerk read the Resolution in its entirety. Mayor Riggs asked if there was any discussion. There was none. Alderman
Swaim seconded by Alderman Dodd moved that the Resolution be adopted. The question was put by Mayor Riggs on
the adoption of the motion and the roll being called, the following voted aye: Alderman Swaim, Parker, Moore, Spoon,
Dodd, and Sagely. And the following voted nay: none.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was attested by the Deputy
City Clerk and impressed with the seal of the City.

A RESOLUTION AUTHORIZING THE PURCIIASE OF FIVE POLICE VEHICLES
UNDER TIIE STATE CONTRACT.
WHEREAS, Under authority of A.C.A. 19 -11 -201, and following, and Resolution 2 -2-
1993, the City of Van Buren, Arkansas is authorized to purchase certain
equipment including cars, under state procurement contracts and that such
purchases are exempted from the requirements of competitive bidding.
NOW, TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN,
ARKANSAS:
SECTION 1: The Mayor is authorized to enter into a purchasing agreement for four (4)
2006 Ford Crown Victoria vehicles for the following prices: three for
$20,708.00, one for $21,240.00, and one (1) Ford F250 Pickup Truck for
the price of $21,940.00, totaling $105,304.00 under the
state procurement contract subject to Resolution 2 -2 -1993. Three of the
cars and the truck will be purchased with federal drug forfeiture funds.

A RESOLUTION CERTIFYING A LIEN AGAINST PROPERTY TO THE CRAWFORI)
COUNTY TAX COLLECTOR.
WHEREAS, That Larry !-Tempel is the owner of certain property in the City of Van
Buren located at 410 South 12' street; and
WHEREAS, That the property owner allowed the house on the property to fall into
disrepair and the lot to become overgrown and covered with trash; and
WHEREAS, That this Council declared the properly to be a nuisance pursuant to
Resolution 9 -2 -2003 and ordered the structure on the property to be
removed and the lot cleaned up; and
WIIEREAS, That the property owner failed to remove the structure or clean up the lot
and the City of Van Buren was forced to do so at a cost of $5,200.00; and
WHEREAS, Pursuant to A.C.A. Section 14 -54 -90 and Ordinance No. 26 -1997, the City
may certify the amount expended plus a 10% penalty for collection to the
Crawford County Tax Collector to be placed on the tax books as
delinquent taxes and collected accordingly.
NOW, THEREFORE, DE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN,
ARKANSAS:
SECTION 1: That the Council hereby certifies that the City of Van Buren expended
$5,200.00 to remove the structure on and clean up the aforesaid property,
and certifies a 10% penalty thereon, for a total of $5,720.00 to be placed
on the tax books as delinquent taxes and collected accordingly, and
remitted to the City of Van Buren upon collection less 3

WIIEREAS, That Buddy and Rebecca Dye are the owners of certain property in the
City of Van Buren described as Lots 12 and 13 of Block 3, Knox
Addition; and
WHEREAS, The structure on the property burned and the property became overgrown
and covered with debris and refuse; and
WHEREAS, That on March 27, 2003 the property owners were delivered a notice to
clean up the property; and
WIIEREAS, That the property owners failed to clean up the lot and the City of Van
Buren was forced to do so at a cost of $8,000.00; and
WHEREAS, Pursuant to A.C.A. Scction 14 -54 -90 and Ordinance No. 26 -1997, the City
may certify the amount expended plus a 10% penalty for collection to the
Crawford County Tax Collector to be placed on the tax books as
delinquent taxes and collected accordingly.

Next on the agenda was time for Boards and Commissions. The Tree City USA Board Members recommended the
re-appointment of Martin Duckworth, Joanna Garrett and Ross Robinson to serve another two (2) year term on the Tree
City USA Board. Alderman Parker seconded by Alderman Swaim made a motion to accept the recommendation
of the Tree City USA Board. The Council followed with a unanimous vote.
Next on the agenda was a request by ling School to close certain streets for one (1) hour to host a 5K run on April
l 2006 at 8:30 an:. _A.lderman Swaim seconded by Alderman Parker made a motion to grant their request. The
Council ibilowed with a unanimous VOW.

9-10. 2006. Alderman Swaim seconded Alderman Moore made a motion to grant their request. The Council followed

Next on the agenda was the Financial Statement. Motion was made by Alderman Swaim and seconded by
Alderman Parker to appropriate the sum of $1 011.530.31 to par expenses and salaries for January 2006 presented by
the Deputy Call Clerk Treasurer. The Council followed with a unanimous vole.

Next Police. Fire. Building Inspector, District Court and Engineer Reports were presented for filing.
Next was time for Miscellaneous and General Discussion. Alderman Parker said from herself and all the Library
Board members they appreciate all the great work the Street Department had done by cleaning up 15 and Main.
Mayor Riggs said the guys were phenomenal. He said they had done a job that should have taken a month and they did
it in two (2) weeks. The Mayor said the low bid had been 539,000.00 and the Street Department did it for 518,800.00.
Alderman Swaim said they deserve a hand. Everyone applauded.
P Alderman Parker seconded by Alderman Spoon made a motion to adjourn. The Council followed with a unanimous
vote. The meeting adjourned at 7:17 p.m.
