12 December 2007 RegularMINUTES OF THE VAN BUREN, ARKANSAS CITY COUNCIL MEETING DECEMBER 17, 2007 The City Council of the City of Van Buren, Arkansas met at 7:00 p.m., Monday, December 17, 2007 at City Hall. The meeting was called to order by Mayor Freeman. On roll call, the following Council members answered as their names were called: Alderman Swaim, Parker, Moore, Dodd and Sagely. Alderman Johnson was not present. City Attorney Donald Jenkins and City Clerk- Treasurer Barbie Curtis were also present. This made a total of eight (8) present. A quorum was declared. The invocation was given by Kevin Bell with Citizens Bank. Next, Mayor Freeman led the Pledge of Allegiance. On the agenda next, Mayor Freeman asked to adopt the minutes of the Council Meeting on November 19, 2007. Alderman Swaim made a motion to approve the minutes. Alderman Sagely seconded the motion. On roll call, the following Council members voted aye: Alderman Swaim, Parker, Moore, Dodd and Sagely. The following voted nay: none. On the agenda next was to consider AN ORDINANCE TO AMEND ORDINANCE NO. 7 -1963 (VAN BUREN MUNICIPAL CODE NO. 14.04.01) FOR THE PURPOSE OF REZONING CERTAIN PROPERTY IN THE CITY OF VAN BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER PURPOSES. The Clerk read the Ordinance in its entirety. Alderman Swaim moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Alderman Moore. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Dodd and Sagely. The Mayor declared the motion carried as there were five (5) ayes and (0) nays. Four (4) votes being necessary for passage. The Clerk then read the Ordinance the second time. Alderman Swaim moved that the rules be further suspended and the Ordinance placed on the third and final reading. The motion was seconded by Alderman Dodd. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Dodd and Sagely. The Mayor declared the motion carried as there were five (5) ayes and (0) nays. Fire Chief McAdoo said the Van Buren Fire Department has solicited bids from three (3) Ford dealerships to purchase the vehicles. The three companies were sent specifications so all the dealerships bid on identical vehicles. The Mayor then put the question, "Shall the Ordinance pass Motion was made by Alderman Swaim and seconded by Alderman Dodd to adopt the Ordinance. CITY OF VAN BUREN ARKANSAS ORDINANCE NO. 40-2007 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, AR- KANSAS AN ORDINANCE TO BE ENTITLED: S AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE PURCHASE OF/ A CREW CAB, FOUR WHEEL; DRIVE, DIESEL PICKUP TRUCK AND A SUPERCAB, FOUR WHEEL DRIVE, DIESEL PICKUP TRUCK; FOR THE APPROPRIATION OF FUN DS: DECLARING AN EMER- GENCE; AND FOR OTHER PURPOSES. WHEREAS, the 'City of Van Buren is in immediate need of certain .vehicles for the safety of life and protection ,of property by the City of Van Buren Fire Department; and WHEREAS, after extensive research and inquiry, in- cluding solicitation of in- formation from three truck dealerships, specifi- cally Landers Ford, North Point Ford, and Randall Ford, the Fire Department has determined that Ran- dall Ford's bids for a crewcab, four wheel] ,drive, diesel_pickup truck, THE ORDINANCE WAS GIVEN THE NUMBER 40 -2007 and a SuperCab, four wheel drive, diesel pickup t k as set forth in at- ruc tachment "A" hereto are the best available bids to fit the fire department's needs; and WHEREAS, the cost of the two pickup trucks, which will be paid out of GIF funds designated for pub- lic safety, are $33,170 and $31,297 respectively, which each exceeds the limit for purchase without competitive bidding under A.C.A.§ 14 -48 -303' and Van Buren Municipal Code 03.04.01; and WHEREAS, the City Coun- cil has determined, pursu- ant to A.C.A, 1 4- 58- 303(b)(2)(B)' that exceptiorial,j, stances exist' which ren- der the competitive bid- ding process to not be practical or feasible; and WHEREAS, a state of emergency exists be- cause the equipment herein is needed immedi- ately to provide for the safety and welfare of the citizens of Van Buren. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, Mc AC TWAT. "SECTION_1; The partment is in immediate need of a crew cab, four wheel drive, diesel pickup truck and a SuperCab, four wheel drive, diesel pickup truck, as set forth in attachment "A" hereto. SECTION 2: Said equip- ment, is to be purchased from Randall Ford, lo- cated in .Fort Smith, Ar- kansas,•rtor the sums of $33,170 and $31,297 re- spectively. SECTION 3: That the City Council in accordance with the terms of A.C.A. 14- 58- 303(b)(2)(B), hereby waives the requirement of competitive bidding and authorizes and directs the Mayor to purchase the above described for the price set forth in Section 2 above, SECTION' 4: It is further found that due to immedi- ate need to .acquire this equipment, as emergency is declared to exist and this ordinance being nec- essary for the preserva- tion of the public health, safety, and welfare, shall take full effect from and after its passage and ap- proval. SECTION 5E-The Mayor and City Clerk are hereby authorized by the City Council for the City of Van Buren to execute all docu- ments, contracts, and agreements necessary to effectuate this Ordinance. SECTION 6: The various provisions and parts of this Ordinance are hereby declared to be severable, and, if any section or part of a section, or any provi- sion'or part of a provision herein, is declared to be unconstitutional, inappro- priate, or invalid by any court of competent juris- diction, such holding shall not invalidate or affect the remainder of this Or- dinance and to that extent the provisions hereto are declared to be severable. City Attorney Donald Jenkins spoke saying this is a nationwide movement. Van Buren is the eleventh (11) city in the state of Arkansas to do this. ATTORNEY, CITY; CLERK- TREASURER AND DISTRICT JUDGE WHEREAS, The City,Coun- cil desires to granta cost of living increases for the Mayor, City Attorney, City Clerk Treasurer, and Dis- trict Judge which would be, reflected on the city payroll for Januarys 15, 2008. NOW, THEREFORE, BE. IT ORDAINED BY THE CITY COUNCIL OF THE CITY. OF VAN BUREN, ARKANSAS:, Section 1: THAT beginning on the day of January 2008, the salary of the Mayor,. AN ORDINANCE PROVID- ING FOR RESTRICTIONS ON THE SALE AND PUR- CHASE OF NOVELTY LIGHTERS; IMPOSING FINES FOR VIOLATIONS OF THIS ORDINANCE, DE- CLARING AN EMERGENCY, AND FOR OTHER PUR- POSES. WHEREAS, juvenile fire setting, like the recent fire in Russellville Arkan- sas that led to the loss of life to two children, has been identified as a fast growing fire threat in the United States; and WHEREAS, novelty light- ers have features which are attractive to children, including visual effects, flashing lights, musical sounds and toy -like de- signs, examples of which have been shown to the Van Buren City Council; and WHEREAS, the Consumer Product Safety Commis- sion. has recalled thou- sands of novelty lighters since 1996 due to the dan- ger posed to public safety; and WHEREAS, functions of novelty lighters can be achieved without posing a danger to public health End safety; and WHEREAS, many public safety agencies support the prohibition of the sale and distribution of nov- elty lighters; the National Fire Protection Agency, National Volunteer Fire Council, Western Fire Chiefs Association, the National Association of State Fire Marshals, and the Van Buren Fire De- ipartment; and WHEREAS, the. Van Buren 'City Council finds that the dangers posed by these novelty lighters is a rave threat to the health, safety and welfare of the THE ORDINANCE WAS GIVEN THE NUMBER 41 -2007 citizens of the City of Van 'Buren and further finds that an emergency exists necessitating the immedi- ate adoption of this Ordi- nance. WHEREAS, the promulga- tion and adoption of this Ordinance is made pursu- ant to the City of Van Bu- ren's police power; and WHEREAS, the City of Van Buren has found that the purposes herein require immediate attention, for the protection of the health, welfare and safety of the. inhabitants of the City of Van Buren, and as herein set out, an emer- gency exists and is hereby declared to exist, and. this ordinance shall be and become effective immediately upon. this passage and adoption by the City Council: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: The retail, sale offer of retail sale, gift or distribution of any novelty lighter within the territo- rial jurisdiction of the City of Van Buren is prohib- ited. SECTION 2: The "novelty lighter" means a lighter that has entertaining audio or visual effect or that depicts, through the use of logos, decals, art work, or by other means„ or that resembles in physical form or function articles commonly recog- nized as appealing to or intended for use by chil- dren ten (10 years of age or younger. This includes, but is not limited to, light- ers that depict or resem- ble cartoon characters, toys, guns watches, musi- cal instruments, vehicles, toy animals, food or bev- erages, or that play musi- cal notes or have flashing lights or other entertain- ing features. A novelty fighter may operate on any fuel, including' butane or liquid fuel. SECTION 3: Exceptions: The term. "novelty lighter" shall exclude: (1) any lighter ..manufactured prior to 1980; and (2) any lighter which lacks fuel; or (3) any lighter which lacks a devise necessary to produce combustion or a flame. SECTION 4: Enforcement: The provisions of this.sec- tion shall be enforced by the fire marshal, any po- lice officer, any code en- forcement officer, and any other City official authorized to enforce any provision of the Van Bu- ren Code of Ordinances. SECTION 5: Violation; Pen alty: Any person or entity violating any provision of, this section is guilty of an infraction, and upon con- viction therefore„ shall be subject to a fine or pen- alty of not less that $50.00 nor more than $500.00. SECTION 6: 'Emergency Clause. The Van Buren City Council has deter- mined that an emergency exists and that the imme- diate" adoption and en- forcement of this ordi- nance being necessary for the public peace, health, safety and welfare, the provisions hereof shall be in full force and effect, from and, after its pas- sage. SECTION 7: The various' provisions and parts of this Ordinance are hereby declared to be severable, and, if any section or part of a section, or any provi sion or part of a provision; herein, -is declared to be unconstitutional, inappro- priate, or invalid by any court of competent juris- diction, such holding shall not invalidate or affect the remainder of this Or- dinance and to that extent the provisions 'hereto are declared to be severable. SECTION 8: All ordi- nances, resolutions or other acts of the City in conflict with the terms hereof are repealed to the extent of any such con- flict. The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was attested by the City Clerk and impressed with the seal of the City. ATTESTED THE RESOLUTION WAS GIVEN THE NUMBER 12 -1 -2007 CITY OF VAN BUREN, ARKANSAS RESOLUTION NO. 1 -2007 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, A RESOLUTION TO BE ENTITLED. A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE, A CERTAIN VEHICLE FOR THE CITY OF VAN BUREN FIRE DEPARTMENT THROUGH THE STATE PURCHASE CONTRACT. WHEREAS, the City of Van Buren is in immediate need of a certain vehicle for the safety of life and protection of property by the City of Van Buren Fire Department; and WHEREAS, the City of Van Buren, utilizing proceeds from the previous sale of an old fire t ruck, desires to purchase one (I) Dodge Durango truck for the price of $23,063.00, as set forth in attachment "A" hereto; and WHEREAS, the City is authorized to waive the expense and time of bidding by purchasing such vehicles though the state purchase contract, pursuant to ARK. CODE ANN. 19 249; and WHEREAS, the City has decided that it is in its best interest to purchase the above listed vehicle via the 2007 Arkansas State Contract, Award No. SP- 07- 0035 -R; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN, ARKANSAS, THAT: SECTION 1: The Fire Department of the City of Van Buren, Arkansas is in immediate need of a certain vehicle, as setforth above. SECTION 2: Said vehicle is to be purchased via the 2007 Arkansas State Contract, Award No. SP- 07-0035-R, from Lander's Dodge, for the sum of $23,063.00. SECTION 3: The Mayor and Cin Clerk are hereby authorized by the City Council for the City of Van Buren to execute all documents, contracts, and agreements necessary to effectuate this action. The Clerk read the Resolution in its entirety. Mayor Freeman spoke and said the budget was basically the same except the pool maintenance was pulled and 2.3% increase on wages except for targeted raises. Alderman Swaim seconded by Alderman Parker moved that the Resolution be adopted. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Dodd and Sagely. Nays none. The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was attested by the City Clerk and impressed with the seal of the City. Mayor Freeman received a recommendation to the City Council for an extension for Verna Moore's appointment for another term on the Fairview Cemetery Board. Alderman Swaim seconded by Alderman Dodd made a motion to grant the recommendation. The Council followed with a unanimous vote. Next on the agenda was a request from County Judge John Hall to appoint a representative that has been reviewed and approved by the Van Buren City Council to serve on the Crawford County Parks Board. The Mayor appointed David Martin. Alderman Swaim seconded by Alderman Moore made a motion to grant the request. The Council followed with a unanimous vote. Next on the agenda was the Financial Statement.
