CITY COUNCIL MEETING NOVEMBER 16, 2009
The City Council of the City of Van Buren, Arkansas met at 7:00 p.m. Monday,
November 16. 2009 at City Hall. The meeting was called to order by Mayor Freeman. On roll
call, the following Council members answered as their names were called: Alderman Swaim,
Parker, Moore. Ragsdale, Dodd, and Sagely. City Clerk- Treasurer Barbie Curtis and City
Attorney Donald Jenkins were present. This made a total of nine (9) present. A quorum was
declared.
The invocation was given by Chuck King, Music Minister at Heritage United Methodist
Church.
Next, Mayor Freeman led the Pledge of Allegiance.
On the agenda next, Mayor Freeman asked to adopt the minutes of the Council Meeting
on October 19, 2009. Alderman Swaim made a motion to approve the minutes. Alderman
Ragsdale seconded the motion. On roll call, the following Council members voted aye:
Alderman Swaim, Parker, Moore, Ragsdale, Dodd, and Sagely. The following voted nay: none.
On the agenda next was a Public Hearing on the abandonment of an alley within the
Fairmont Addition of the City of Van Buren, Crawford County, Arkansas. Kyle Salyer explained
that both of the abandonments are to facilitate the relocation of the existing King School to the
vacant lots to the east of the school, and was present to answer any questions regarding these
closings. There was no one that opposed this, or had any questions.
On the agenda next was to consider AN ORDINANCE VACATING AND
ABANDONING AN ALLEY WITHIN THE FAIRMONT ADDITION OF THE CITY OF
VAN BUREN, CRAWFORD COUNTY, ARKANSAS. The Clerk read the Ordinance in its
entirety. Alderman Swaim moved that the rules be suspended and the Ordinance be placed on its
second reading. The motion was seconded by Alderman Parker. On the Clerk's calling the roll,
the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Ragsdale. Dodd, and
Sagely. The Mayor declared the motion carried as there were six (6) ayes and (0) nays. Four (4)
votes being necessary for passage. The Clerk then read the Ordinance the second time.
Alderman Swaim moved that the rules be further suspended and the Ordinance placed on
the third and final reading. The motion was seconded by Alderman Dodd. On the Clerk's
calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Ragsdale,
Dodd, and Sagely. The Mayor declared the motion carried as there were six (6) ayes and (0)
nays. Four (4) votes being necessary for passage. The Clerk then read the Ordinance the third
and final time. The Mayor asked if there was any discussion. There was none.

WHEREAS, the City of Van Buren has determined that the bid of Randall Ford is the best bid:

SECTION 1. The City of Van Buren, Arkansas accepts the bid of 524,720.00 plus sales tax as
submitted by Randall Ford and set forth in Exhibit "A" attached hereto, to be paid out
of Street Department funds.

City Clerk read the Resolution in its entirety. Mayor Freeman asked if there was any discussion.
There was none. Alderman Swaim seconded by Alderman Sagely moved that the Resolution be
adopted. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim,
Parker, Moore, Ragsdale, Dodd, and Sagely. Nays none.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which

Next on the agenda was the Mayor's discussion of the Proposed 2010 Budget. Mayor
Freeman said that there won't be any action taken until December's meeting. Revenue estimates
are somewhat of a down estimate from what we saw last year. Two increases that are shown are
the federal funded Firefighter's Safer Grant and the new yard waste revenues. Expenditures are
up slightly because of the yard waste pickup. That will wash out. One major increase for $32,000
is for housing prisoners at jail. Mayor Freeman said that there is relatively no change from the
2009 budget. He is still projecting to fund for a Planning Coordinator. Funds for that position
will be made up of the positions vacated by Mr. Riggs in 2009 and Ms. Mitchell in March of
2010. There will be no across the board pay raises again for 2010. The money's just not there.
We will look at it on a monthly basis. There were no questions from the council at this time.
Next on the agenda was the Financial Statement. Motion was made by Alderman Swaim
and seconded by Alderman Parker to appropriate the sum of $1,381,330.99 to pay expenses and
salaries for October 2009, presented by the City Clerk. The Council followed with a unanimous
vote.

Next on the agenda was Miscellaneous and General Discussion. John Pope with Keep
Arkansas Beautiful and Keep Van Buren Beautiful spoke about the Cigarette Litter Prevention
Program. We have reduced the amount of litter by 60% by purchasing cigarette urns to place on
Main Street. Keep America Beautiful has an award program and Mr. Pope applied for that on
behalf of Keep Van Buren Beautiful. He will be traveling to Washington D.C. to accept the I
Place on a national basis for a Cigarette Litter Prevention Program. We've received that award
for our innovative approach. Keep Arkansas Beautiful has declared November as Recycle
Month.
Alderman Bill Swaim requested that the City Attorney prepare an Ordinance for
December's council meeting to restore the Mayor's approval amount from $10,000 to $20,000.
Alderman Donna Parker thanked Mr. Jenkins for preparing some documents for the new
city library.
Alderman Johnny Ragsdale asked if we'd heard anymore about the money from the
bonding company. Mayor Freeman said the last letter was sent out last week.
There being no further business, motion was made by Alderman Parker and
seconded by Alderman Swaim to adjourn. The Council followed with a unanimous vote.
