09 September 2009 Regular MINUTES OF THE VAN BUREN, ARKANSAS CITY COUNCIL MEETING SEPTEMBER 21, 2009 The City Council of the City of Van Buren. Arkansas met at 7:00 p.m. Monday, September 21, 2009 at City Hall. The meeting was called to order by Mayor Freeman. On roll call, the following Council members answered as their names were called: Alderman Swaim, Parker, Moore, Ragsdale. Dodd, and Sagely. City Clerk- Treasurer Barbie Curtis and City Attorney Donald Jenkins were present. This made a total of nine (9) present. A quorum was declared. The invocation was given by Kevin Hardcastle, Pastor of The Current Church. Next, Mayor Freeman led the Pledge of Allegiance. On the agenda next, Mayor Freeman asked to adopt the minutes of the Council Meeting on August 17. 2009. Alderman Swaim made a motion to approve the minutes. Alderman Parker seconded the motion. On roll call, the following Council members voted aye: Alderman Swaim, Parker, Moore, Ragsdale, Dodd, and Sagely. The following voted nay: none. Mayor Freeman next introduced Debbie Foliart Maryl Koeth to do a special presentation. Ms. Foliart and members of the Van Buren Advertising Promotion Commission were here tonight to show gratitude to Bill Swaim. Bill has faithfully served the City of Van Buren and it's residents for 20 years on the A &P Commission with only missing two meetings. They presented Mr. Swaim with a framed John Bell painting all while saying his invaluable service to the city will not go unnoticed. On the agenda next was to consider AN ORDINANCE AUTHORIZING THE MAYOR TO MAKE EXPENDITURES FOR RAILROAD CROSSING REPAIRS WITHIN THE CORPORATE CITY LIMITS, WAIVING BIDDING REQUIREMENTS, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. The Clerk read the Ordinance in its entirety. Alderman Swaim moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Alderman Ragsdale. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Ragsdale. Dodd, and Sagely. The Mayor declared the motion carried as there were six (6) ayes and (0) nays. Four (4) votes being necessary for passage. The Clerk then read the Ordinance the second time. Alderman Swaim moved that the rules be further suspended and the Ordinance placed on the third and final reading. The notion was seconded by Alderman Parker. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Moore, Ragsdale. Dodd, and Sagely. City Engineer, Brad Baldwin explained the reasoning is due to multiple duplexes being built on one site. Clarification was made that this is for all building structures on a site. Mayor Freeman added that this is against the law on the state highways and because of that these groups are moving to the city streets and it is becoming a problem. The bandit chipper is the one that's been bid on before by the State Highway Department. It is a heavier duty piece of equipment. Mayor Freeman had a few topics for discussion. 1-Ie thanked John Pope and everyone for their efforts to make the city shine. The City of Van Buren was awarded the Shine Award on Tuesday, September 15, 2009. Next, Mayor Freeman mentioned that the Intermodal Port Authority met for their first meeting last Wednesday. The representatives for the City of Van Buren are Mayor Freeman, Jay White with Peppersource. and Keith Hefner with Citizens Bank Trust. Mayor Freeman provided everyone with a notice he received last week from Land O'Lakes. They will be closing their facility in the City of Van Buren. Their 18 employees will be affected. He also provided everyone with a copy of Video After the Storm, a video about storm water and its effects on cities from California to New York. A note from City Engineer, Brad Baldwin and a map of the street inventory was provided next. The city started this quest over a year ago. This project is to try and determine the state of maintenance and prioritizing that maintenance. This is the first draft of that inventory. Lastly. Mayor Freeman mentioned that Gene Bell will be in surgery tomorrow. Please keep him and his family in your thoughts and prayers. Alderman Donna Parker mentioned the Fall Clean Up this Saturday at 10:00 a.m. at Lake Lou Emma, Crawford County Courthouse, and Van Buren City Park. She also gave a huge thanks to Ms. Vivian Mitchell. This is the best Volunteer Presentation and she wanted to say thank you for all her hard work. Vicki Davis had a few dates to mention. October 18` is the Tales of the Crypt, October 11` is the Fall Festival, and October 25 is the King Opera House Ribbon Cutting.
