07 July 2009 Special MINUTES OF THE VAN BUREN, ARKANSAS SPECIAL CITY COUNCIL MEETING HELD JULY 13, 2009 A special called meeting of the City Council of the City of Van Buren, Arkansas met at 5:30 p.m., on Monday, July 13, 2009 at City Hall. The meeting was called to order by Mayor Freeman. Council members present were Alderman Swaim, Parker, Ragsdale, and Dodd. City Attorney Donald Jenkins and City Clerk- Treasurer Barbie Curtis were also present. This made a total of seven (7) present. A quorum was declared. The Mayor ordered spread upon the minutes, the "NOTICE OF SPECIAL MEETING AND WAIVER OF REGULAR NOTICE OF AND CONSENT TO SPECIAL MEETING." The Clerk read the Ordinance in its entirety. Alderman Swaim moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Alderman Ragsdale. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Ragsdale, and Dodd. The Mayor declared the motion carried as there were four (4) ayes and (0) nays. Four (4) votes being necessary for passage. The Ordinance was read the second time. Alderman Swaim moved that the rules be further suspended and the Ordinance placed on the third and final reading. The motion was seconded by Alderman Ragsdale. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Ragsdale, and Dodd. The Mayor declared the motion carried as there were four (4) ayes and (0) nays. Four (4) votes being necessary for passage. The Clerk then read the Ordinance the third and final time. The Mayor asked if there was any discussion. Mayor Freeman mentioned that Crawford Construction was an original bidder on the library, so they are familiar with the project. He also said that the approach is to start the fire repairs and contract the completion of the construction separately. The Mayor then put the question, "Shall the Ordinance pass Motion was made by Alderman Swaim and seconded by Alderman Parker to adopt the Ordinance. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Ragsdale, and Dodd. The Mayor declared the motion carried as there were four (4) ayes and (0) nays. Four (4) votes being necessary for passage. Motion was made by Alderman Parker and seconded by Alderman Swaim, that the emergency clause be adopted. On the Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim. Parker, Ragsdale. and Dodd. The Mayor then declared the Ordinance duly passed and signed sane in open Council, duly attested by the City Clerk. J THAT: On the agenda next was to consider a proposed settlement between Cormack vs City of Van Buren from Mr. Comiack's attorney. The recommendation given to us from Municipal League Attorney, Mike Mosley, was to submit a counter offer of $7,500.00. Motion was made by Alderman Swaim to authorize Mayor Freeman to settle this issue without any further action from the city council. The motion was seconded by Alderman Parker. The council followed with a unanimous vote. There being no further business, motion was made by Alderman Parker seconded by Alderman Swains to adjourn. The Council followed with a unanimous vote.
