BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 (VAN
BUREN MUNICIPAL CODE NO.14.04.01)FOR THE PURPOSE OF
REZONING CERTAIN PROPERTY IN THE CITY OF VAN
BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE
CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER
PURPOSES.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the law of the State of
Arkansas, with all powers, authority and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963);and
WHEREAS, a request has been made by Chad Cox to rezone certain property within the city limits of
the City of Van Buren; and
WHEREAS, notice of a Public Hearing was duly published in the Press Argus Courier on June 20,
2020, and a public hearing was conducted as required by law(A.C.A. 14-56-422)on July
7, 2020; and
WHEREAS, as a result of this hearing,the Planning Commission recommends that certain property
within the city limits of the City of Van Buren be rezoned from its previous classification
to the following:
Property Zoned New Zoning
R-2 (Two-Family Residential District) R-3 (Multi-Family Residential District)
Legal Description:
Commencing at an existing railroad spike marking the Southwest Corner of the Northwest Quarter of the
Southeast Quarter. Thence along the West line of said Forty,North 02 degrees 44 minutes 56 seconds East,
190.97 feet to a set p/k nail and the Point of Beginning. Thence continuing along said West line,North 02
degrees 44 minutes 56 seconds East, 85.00 feet. Thence leaving said West line, South 87 degrees 52
minutes 14 seconds East, 281.50 feet to an existing iron pin. Thence South 85 degrees 53 minutes 45
seconds East, 35.30 feet to a tree occupying the corner. Thence South 02 degrees 44 minutes 56 seconds
West, 85.00 feet to a set rebar with cap. Thence North 87 degrees 39 minutes 04 seconds West,316.78 feet
to the Point of Beginning,containing 0.62 of an acre and subject to Road Rights of Way and any Easements
of Record.

NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The above-described property is hereby rezoned from R-2 to R-3 and the Van Buren
Zoning Map is amended to reflect this rezoning.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council,did pass,
approve, and adopt, by a vote of L0 for and (') against,the foregoing Ordinance at its regular meeting
held on the 27`h day of July 2020.

SUBJECT: 420 NORTH 20TH REZONING 141-2020;R-2 TO R-3
DATE: JULY 13, 2020
The subject rezoning request was reviewed by the Van Buren Planning Commission on July 7,
2020. The rezoning application was submitted by Ricky Hill of Satterfield Land Surveyors as
agent for Chad Cox. The proposed rezoning will facilitate the combination of this property with
the property at 422 North 20"'Street to allow for the construction of five (5)duplexes.
The Planning Commission previously reviewed this rezoning application at their May 5th
meeting where it was denied. The applicant appealed the decision to the City Council at the June
22,2020 meeting,which after discussion the Council sent the rezoning application back to the •
Planning Commission based on new information.
Subsequent the Council meeting,the applicant held a neighborhood meeting on July 2,2020.
The attendance record and results of the meeting are included in this packet of information.
After discussion,the Planning Commission voted 8 in favor, 0 opposed, (1 member was absent)
to approve this request and recommend the City Council amend the City's zoning map as
requested.
A draft copy of the Planning Commission minutes,the application and packet of information is
enclosed for your review.

BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 VAN
BUREN MUNICIPAL CODE NO.14.04.01)FOR THE PURPOSE OF
REZONING CERTAIN PROPERTY IN THE CITY OF VAN
BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE
CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER
PURPOSES.
WHEREAS, the City of Van Buren,Arkansas,is duly incorporated under the law of the State of
Arkansas,with all powers,authority and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963);and
WHEREAS, a request has been made by Chad Cox to rezone certain property within the city limits of
the City of Van Buren;and
WHEREAS, notice of a Public Hearing was duly published in the Press Argus Courier on June 20,
2020,and a public hearing was conducted as required by law(A.C.A& 14-56-422)on
July 7,2020; and
WHEREAS, as a result of this hearing,the Planning Commission recommends that certain property
within the city limits of the City of Van Buren be rezoned from its previous classification
to the following:
Property Zoned New Zoning
R-2(Two-Family Residential District) R-3 (Multi-Family Residential District)
Legal Description:
Commencing at an existing railroad spike marking the Southwest Corner of the Northwest Quarter of the
Southeast Quarter. Thence along the West line of said Forty,North 02 degrees 44 minutes 56 seconds
East, 190.97 feet to a set p/k nail and the Point of Beginning. Thence continuing along said West line,
North 02 degrees 44 minutes 56 seconds East, 85.00 feet. Thence leaving said West line, South 87
degrees 52 minutes 14 seconds East,281.50 feet to an existing iron pin. Thence South 85 degrees 53
minutes 45 seconds East,35.30 feet to a tree occupying the corner. Thence South 02 degrees 44 minutes
56 seconds West, 85.00 feet to a set rcbar with cap. Thence North 87 degrees 39 minutes 04 seconds
West, 316.78 feet to the Point of Beginning,containing 0.62 of an acre and subject to Road Rights of
Way and any Easements of Record.

SECTION 1: The above-described property is hereby rezoned from R-2 to R-3 and the Van Buren
Zoning Map is amended to reflect this rezoning.

PLANNING COMMISSION MINUTES
Van Buren Public Library
July 7,2020
The Van Buren Planning Commission held its monthly meeting on Tuesday,July 7,2020 at 5:30
P.M.,in the Van Buren Public Library meeting room,due to the Covid-19 outbreak and CDC
guidelines,we were able to obtain the 6 foot distancing.Present: Chairman Andy Dibble,Vice
Chairman Philip Bagby,Lynne Graham,Jason Myers,Mason Shirey,Mark Evans,John Symonds,
Jay White,City Inspector David Martin, and Planning Director Wally Bailey and City Attorney
Candice Settle. Others present Ricky Hill, Satterfield Surveying,Chad Brixey,Brixey Engineering,
Ragan Clements,Frank Boltami and Wesley Moore.
The first item on the agenda was to approve the minutes from the last meeting. A motion was made
by Jay White and seconded by John Symonds to approve the meeting minutes. The motion was
approved unanimously.
Next item on agenda was the Public Hearing for the appealed Rezone by Chad Cox, Satterfield
Engineering,420 North 20"Street,R-2 to R-3. Wally Bailey,Planning Director stated the Planning
Commission voted to deny this rezoning at their May 5`1 meeting. The Planning Commission's
decision was appealed to the City Council. The City Council voted to send this rezoning application
back to the Planning Commission for further consideration because of new information that was
given at the City Council meeting. The new information consists of alternate plans for the property
which include multi-family structures being constructed on the existing R-3 property. At the
Planning Commission meeting it was said there would be no multi-family structures. Ricky Hill,
Satterfield Surveying,stated a meeting was held at King Elementary parking on July 2"d Mr. Hill
stated all that turned out for the meeting was in favor of the duplexes verses the two-story multi-
family units.Mr.Hill would like the commission to reconsider approving the rezone based on the
new concept. Chairman Dibble asked for public input. Public comments were as follows:
Wesley Moore,417 North 21st Street,stated: "I am against anything being built besides single-family
homes due to traffic,noise and trash."
Frank Beltrami,owner of Baldwin Apartments,stated: "I prefer the duplexes because it will help
with overall aesthetics of the neighborhood. I am more concerned about the flooding because my
property is lower. Needs to be a retaining wall built"
Chairman Dibble stated that would be addressed during the planning and development of the
duplexes. A motion was made by Jason Myers and seconded by Mason Shirey to approve the
rezone.The motion was approved unanimously.
Next item was a preliminary plat review for Legacy Place,Phase 2,Brixey Engineering.Wally Bailey,
Planning Director,stated the preliminary plat shows a Phase 2 that is Lots 22-48,Tracts A,B and C.
Barberry Street will dead end at Tract C. The street standards allow a dead-end street to be a
maximum of 600 feet. This proposed dead end has been approved by the Fire Department. Chad
Brixey,Brixey Engineering,stated the flood study and subsequent Letter of Map Revision to FEMA
will affect the future of Tracts A,B,and C. Mr. Clemens stated when that process is finished it will
likely become a 3`a phase of Legacy Place. A motion by John Symonds and seconded by Mark
Evans to approve the preliminary plat. The motion was approved unanimously.
No New or Old Business. A motion to adjourn was made by Philip Bagby and seconded by Mason
Shirey.
