CITY COUNCIL MEETING JUNE 22,2020
The City Council of the City of Van Buren, Arkansas met at 5:30 p.m. Monday, June 22, 2020 at
the Van Buren Public Library. The meeting was called to order by Mayor Hurst. On roll call,the
following Council members answered as their names were called: Council Member Sparkman,
Kneeland, Petty, Swaim and Dodson. City Clerk-Treasurer Phyllis Thomas and City Attorney Candice
Settle were present. Council Member Wood was present, but arrived late. This made a total of nine (9)
present. A quorum was declared.
The invocation was given by Mayor Joe Hurst.
Mayor Hurst then led the Pledge of Allegiance.
The following items were on the June 2020 consent agenda:

create a passage-way between the Center and the King Opera House to
promote cross-utilization of the faeilitiea and to promote tourism;and

On the agenda next was to consider AN ORDINANCE TO ABANDON A PUBLIC
ALLEYWAY IN THE VISTA PLACE ADDITION, INSIDE THE CITY OF VAN
BUREN, CRAWFORD COUNTY,ARKANSAS. The Clerk read the Ordinance in its entirety.
Council Member Wood moved that the rules be suspended and the Ordinance be placed on its
second reading. The motion was seconded by Council Member Swaim. The council followed
with a unanimous vote. The Clerk then read the Ordinance the second time.
Council Member Wood moved that the rules be further suspended and the Ordinance
placed on the third and final reading. The motion was seconded by Council Member Swaim.
The council followed with a unanimous vote. The Clerk then read the Ordinance the third and
feral time. The Mayor asked if there was any discussion. City Planner Wally Bailey explained
that this is just another property along the alleyway that we have previously closed for other
property owners. AOG was the only utility company that commented on the closure as they have
an easement in that section. An agreement was made and filed with the Circuit Clerk's office to
accommodate this. There was also no one in the public attendance that had any objections.
The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by Council
Member Petty and seconded by Council Member Kneeland to adopt the Ordinance. On the Clerk's
calling the roll, the following vote resulted: Ayes—Council Member Kneeland, Petty, Dodson, Swaim,
Wood and Sparkman.Nays—None. The Mayor declared the motion carried as there were six (6) ayes
and(0)nays. Four(4) votes being necessary for passage.
The Mayor then declared the Ordinance passed and signed same in open Council, duly attested

matter. Instead, she suggested it be amended to include a notice of violation before being
charged with a misdemeanor.

Member Petty and seconded by Council Member Swaim to adopt the Ordinance as amended. On the
Clerk's calling the roll,the following vote resulted: Ayes—Council Member Kneeland, Petty, Dodson,

main reason for this change is due to some issues with access of emergency vehicles and
response time. Fire Chief Tim Arnold state ISO requires it to be under 1.5 miles from the closest
station which is currently a problem in this area. City Attorney Candice Settle spoke to the
council in her capacity as a resident of the neighborhood in question. She said that many people
i from that neighborhood attended the Planning Commission meeting back before the COVID-19
outbreak and they were all in agreeance this plan would have the least amount of impact on the
residents, but the best option in respect of increasing safety measures. Also, although not related
to the Master Street Plan, she asked the council to reevaluate options for speed control in the
neighborhood.

On the agenda next was to consider AN ORDINANCE TO AMEND ORDINANCE NO. 7-
1963 VAN BUREN MUNICIPAL CODE NO. 14.04.01 FOR THE PURPOSE OF REZONING
CERTAIN PROPERTY IN THE CITY OF VAN BUREN,ARKANSAS,AMENDING THE
ZONING MAP OF THE CITY OF VAN BUREN, ARKANSAS,AND FOR OTHER PURPOSES.
The Clerk read the Ordinance in its entirety. City Planner Wally Bailey explained to the council the
original plan for the property presented to the Planning Commission was for duplexes, however, since
the Planning Commission meeting Mr. Cox has changed his plan to be a multi-family 4-plex, which has
not been presented to the Planning Commission. Due to the change in plans, Mr. Bailey suggests it go
back to the Planning Commission for further review. Ricky Hill, representative from Satterfield Land
Surveyors spoke to the council. He asked the council to send it back to the Planning Commission so that
they may ask the neighborhood which option they would like to see. Mr. Hill reiterated they are not
asking the council to approve or deny the plans at this time. Council Member Swaim made a motion to
send this back to the Planning Commission. The motion was seconded by Council Member Kneeland.

Next on the agenda was the Financial Statement. Motion was made by Council Member
Swaim and seconded by Council Member Kneeland to appropriate the sum of
$ 1,210,522.60 to pay expenses and salaries for May 2020,presented by the clerk. The Council

Next on the agenda was Boards and Commissions. The Van Buren Library Board
recommended the reappointment of Robin Holt Wright to serve another term, the Van Buren
Planning Commission recommended the reappointment of Lynne Graham to serve another term,
and the Van Bure Historic District Commission recommended the reappointment of Lonnie
London and Vickie Davis to each serve another term. Council Member Kneeland, seconded by
Council Member Dodson made a motion to grant the nominations. The Council followed with a
unanimous vote.
Next Police, Fire, Building Inspector, Public Works/Planning, and Ambulance Reports were
presented for filing. There being no further questions or changes,the reports were filed as submitted.
Next on the agenda was Miscellaneous and General Discussion. Connie Martin gave a
report to the council for the Almost Home Shelter. Council Member Swaim distributed
additional information about the shelter to be studied for discussion at the next council meeting.
He would like to see it put in the budget for a full-time shelter employee.
There being no further business,motion was made by Council Member Sparkman and seconded
by Council Member Petty to adjourn. The Council followed with a unanimous vote. The meeting
