CITY COUNCIL MEETING MARCH 23,2020
The City Council of the City of Van Buren, Arkansas met at 5:30 p.m. Monday, March
23, 2020 at City Hall. The meeting was called to order by Mayor Hurst. The meeting was
conducted electronically, with all Council Members attending by remote connection, in response
to the COVID-19 pandemic guidelines. On roll call, the following Council members answered as
their names were called: Council Member Wood, Sparkman, Kneeland, Petty, Swaim and
Dodson. City Clerk-Treasurer Phyllis Thomas and City Attorney Candice Settle were present.
This made a total of nine (9)present. A quorum was declared.
The invocation was given by Mayor Joe Hurst.
Mayor Hurst then led the Pledge of Allegiance.
Mayor Hurst then asked to adopt the minutes of the Regular Council Meeting on
February 24, 2020. Council Member Wood made a motion to approve the minutes. Council
Member Swaim seconded the motion. On roll call, the following Council members voted aye:
Council Member Swaim, Wood, Sparkman, Kneeland, Petty and Dodson. The following voted
nay: none.
On the agenda next was to consider A RESOLUTION AUTHORIZING THE
MAYOR TO ENTER INTO A CONTRACT FOR ENGINEERING SERVICES
FOR THE CITY OF VAN BUREN,ARKANSAS, AND FOR OTHER PURPOSES.
The Clerk read the Resolution in its entirety. Mayor Hurst asked if there was any
discussion. There was none. Council Member Sparkman seconded by Council Member
Kneeland moved that the Resolution be adopted. On the Clerk's calling the roll, the
following vote resulted: Ayes—Council Member Swaim, Wood, Sparkman, Kneeland,
Petty and Dodson.Nays—None.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which
was attested by the City Clerk and impressed with the seal of the City.

professional engineering services for the development of plans and designs, cost
estimates,and supervision for said projects.

SIMTION I: The Mayor is authorized to enter into a contract(Exhibit itlA') with Hawkins-Weir
Engineers, Inc, in provide engineering services for the development of preliminary
engineering mud designs,and cost estimates for the above listed projects. Payment for
such engineering services shall not exceed$25,000.00 plus any applicable reimbursable
expenses,

Next,the council heard a public hearing on an alleyway abandonment. Mr. Ricky
Hill,representing the home owners, commented that it was a viable building site. There
were no other comments heard.
On the agenda next was to consider AN ORDINANCE TO ABANDON A
PUBLIC ALLEYWAY IN THE VISTA PLACE ADDITION, INSIDE THE CITY
OF VAN BUREN, CRAWFORD COUNTY,ARKANSAS. The Clerk read the
Ordinance in its entirety. Council Member Swaim moved that the rules be suspended and
the Ordinance be placed on its second reading. The motion was seconded by Council
Member Wood: The council followed with a unanimous vote. The Clerk then read the
Ordinance the second time.
Council Member Swaim moved that the rules be further suspended and the
Ordinance placed on the third and final reading. The motion was seconded by Council
Member Wood. The council followed with a unanimous vote. The Clerk then read the
Ordinance the third and final time. The Mayor asked if there was any discussion. Mayor
Hurst stated this has gone through the Planning Commission and been signed off on by
all utilities. City Planner Wally Bailey added that it has never been used as an alley and
therefore makes sense to abandon the alleyway.
The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by
Council Member Swaim and seconded by Council Member Kneeland to adopt the Ordinance.
On the Clerk's calling the roll,the following vote resulted: Ayes—Council Member Swaim,
Wood, Sparkman, Kneeland, Petty and Dodson. Nays—None. The Mayor declared the motion
carried as there were six (6) ayes and(0) nays. Four (4)votes being necessary for passage.

Council Member Wood moved that the rules be further suspended and the

Ordinance the third and fmal time. The Mayor asked if there was any discussion. City
Planner Wally Bailey explained that Van Buren residents will not be served and there
will be no revenue for this action. This fee is merely for the use of the right of way.
Council Member Petty asked if the language suggesting alley way was necessary or if it
could be clarified to rights-of-way. City Planner Bailey also stated that the attached
Exhibit A clarifies the path they intend to use. Council Member Petty asked if that$50.00
fee requires them to fix the road or if we have to fix the road. Mr. Bailey stated they
would be responsible for the repair of the street cut and are also required to put up a bond
to guarantee their work.
The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by
Council Member Petty and seconded by Council Member Wood to adopt the Ordinance as
amended. On the Clerk's calling the roll,the following vote resulted: Ayes—Council Member

following rules will be in place,and to the extent the City of VIM Boren Employee
Policy Manual as adopted by Resolution No.7.2.2001 and asrevised by Resolution
No.2.5-2003 and 7-3-2005 conRicts,the terns set forth in this Oetlinaoco shall

SGCT_ION 2: A.The fetlowing employees shall be paid their reg,dar pay lin up to fnurleea

transmission settings,personal contact with a presumptive case of COVlD-19,
or if the employee Iran observable symptoms consistent with the guidelines
published by the Centers for Disease Control- Employees identified by the
Muynr or Deprerunort Head will receive up to fourteen days of paid time all'

may be required to utilize sick leave rather than paid time off unless or until the

Next Police, Fire, Building Inspector, Public Works/Planning, and Ambulance Reports
were presented for filing. There being no further questions or changes, the reports were filed as

Next on the agenda was Miscellaneous and General Discussion. Mayor Hurst thanked the
city staff for all the work that went into making this meeting electronic. Crawford County was
added to the map of positive case for COVID-19 today and we are doing all that we should to be
proactive. He commended our community for meeting the needs of others.
