12 December 2019 Regular MINUTES OF THE VAN BUREN,ARKANSAS CITY COUNCIL MEETING DECEMBER 16,2019 The City Council of the City of Van Buren, Arkansas met at 5:30 p.m. Monday, December 16, 2019 at City Hall. The meeting was called to order by Mayor Joseph Hurst. On roll call, the following Council members answered as their names were called: Council Member Dodson, Kneeland, Petty, Sparkman, Swaim and Wood. City Clerk-Treasurer Phyllis Thomas and City Attorney Candice Settle were present. This made a total of nine (9)present. A quorum was declared. The invocation was given by Mr. Jim Petty, Van Buren City Council member. Mr. Petty then led the Pledge of Allegiance. Mayor Hurst then asked to adopt the minutes of the Regular Council Meeting on November 25, 2019. Council Member Kneeland made a motion to approve the minutes. Council Member Wood seconded the motion. On roll call,the following Council members voted aye: Council Member Kneeland, Petty, Dodson, Swaim, Wood and Sparkman. The following voted nay: none. Mayor Hurst then asked to adopt the minutes of the Special Council Meeting on December 2, 2019. Council Member Sparkman made a motion to approve the minutes. Council Member Swaim seconded the motion. On roll call,the following Council members voted aye: Council Member Kneeland, Petty, Dodson, Swaim, Wood and Sparkman. The following voted nay: none. On the agenda next was to consider A RESOLUTION APPROVING THE FINAL PAYMENT FOR THE POINTER TRAIL SIDEWALK IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES. The Clerk read the Resolution in its entirety. Mayor Hurst asked if there was any discussion. Mayor Hurst noted this project came in under budget by about $1,400.00. Larry Yancey with Hawkins Weir was present to answer any questions the council may have. Council Member Petty asked City Attorney Candice Settle why we have to come back to approve a lower completion cost. City Attorney Settle stated it is because we approved a contract amount and the total costs ends up being different than what was approved. This action acknowledges that difference and helps keep accounting records straight. Council Member Petty seconded by Council Member Kneeland moved that the Resolution be adopted. On the Clerk's calling the roll,the following vote resulted: Ayes—Council Member Kneeland, Petty, Dodson, Swaim, Wood and Sparkman.Nays—None. The Mayor thereupon declared the Resolution adopted and signed the Resolution, which was attested by the City Clerk and impressed with the seal of the City. THE RESOLUTION WAS GIVEN THE NUMBER 12-1-2019 CITY OF VAN BUREN,ARKANSAS RESOLUTION NO./a- 1 -2019 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS,A RESOLUTION TO BE ENTITLED: A RESOLUTION APPROVING 1'111: FINAL PAYMENT FOR THE POINTER TRAIL SIDEWALK IMPROVEMENT PROJECT;AND FOR OTHER PURPOSES. WHEREAS, Hawkins-Weir Engineers,Inc. acting as the Construction Manager for the City of Van Buren,Arkansas advertised for bids to build a sidewalk on Pointer Trail;and WHEREAS, the City Council approved the Mayor entering into a construction contract with Harris United, LLC in the amount not to exceed $286,694.00 by Resolution#03-04-2019;and WHEREAS, the City's final payment schedule decreased the total amount of the contract by$1,456.49,resulting in a project total of$285,237.51. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN,ARKANSAS,THAT: SECTION 1: The City of Van Buren, Arkansas accepts and approves the total final payment of$20,315.60 to Harris United, LLC as set forth and attached hereto. SECTION 2: The Mayor and City Clerk are hereby authorized by the City Council for the City of Van Buren to pay all expenses relating to the Pointer Trail Sidewalk Improvement Project and to execute all documents necessary to effectuate said changes. On the agenda next was to consider AN ORDINANCE SETTING THE SALARIES OF THE MAYOR AND CITY CLERK-TREASURER; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. The Clerk read the Ordinance in its entirety. Council Member Wood moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Council Member Kneeland. The council followed with a unanimous vote. The Clerk then read the Ordinance the second time. Council Member Wood moved that the rules be further suspended and the Ordinance placed on the third and final reading. The motion was seconded by Council Member Dodson. The council followed with a unanimous vote. The Clerk then read the Ordinance the third and final time. The Mayor asked if there was any discussion. Council Member Swaim requested to increase the Mayor's salary to $86,000/year and the City Clerk's salary to $59,000/year to better align with other cities of similar size. Council Member Wood also commented this would also reflect the weight these positions carry. The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by Council Member Swaim and seconded by Council Member Kneeland to adopt the Ordinance as amended. On the Clerk's calling the roll, the following vote resulted: Ayes—Council Member . City Planner Wally Bailey explained this will not change anyone's existing driveway. This is just to help in designing subdivisions to keep the roadways safe and the flow of traffic moving. Council Member Swaim questioned the intent of Section 2 and asked about thoroughfares that already exist such as Rena Road and 11th Street that may have no other driveway option available. Mr. Bailey said if there were no other options then they will have to install a driveway on that road frontage. City Attorney Candice Settle stated the language suggested in Section 2 is intended for new subdivisions. Council Member Swaim asked about removing Section 2 from the ordinance. Council Member Wood seconded his suggestion. The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by Council Member Swaim and seconded by Council Member Wood to adopt the Ordinance as amended. There being no further questions or changes,the reports were filed as submitted. Next on the agenda was Miscellaneous and General Discussion. Mayor Hurst briefly discussed solar power and asked about looking into and researching what possible savings could be there by powering the city buildings with solar power. There being no further business, motion was made by Council Member Sparkman and seconded by Council Member Kneeland to adjourn. The Council followed with a unanimous vote.
