BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 (VAN
BUREN MUNICIPAL CODE NO.14.04.01)FOR THE PURPOSE OF
REZONING CERTAIN PROPERTY IN THE CITY OF VAN
BUREN, ARKANSAS; AMENDING THE ZONING MAP OF THE
CITY OF VAN BUREN, ARKANSAS; AND FOR OTHER
PURPOSES.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the law of the State of
Arkansas,with all powers,authority and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963);and
WHEREAS, a request has been made by J&S Construction, to rezone certain property within the city
limits of the City of Van Buren; and
WHEREAS, notice of a public hearing was duly published in the Press Argus Courier on December 21,
2019, and a public hearing was conducted as required by law (A.C.A § 14-56-422) on
January 7, 2020; and
WHEREAS, as a result of this hearing,the Planning Commission has recommended that certain property
within the city limits of the City of Van Buren be rezoned from its previous classification
to the following:
Property Zoned New Zoning
C-2(Thoroughfare Commercial District) R-3 (Multi-Family Residential District)
Legal Description:
Part of Lot 33,Boatright's Subdivision to the City of Van Buren,Arkansas being more particularly
described as follows:
Commencing at an existing rebar marking the Northwest Corner of Lot 33. Thence along the North line of
said Lot 33, South 86 degrees 33 minutes 46 seconds East, 78.90 feet to a set rebar with cap and the Point
of Beginning. Thence continue along said North line, South 86 degrees 33 minutes 46 seconds East, 119.10
feet to an existing rebar marking the Northeast Corner of Lot 33,said point being on the West Right of Way
line of South 26th Street. Thence along the East line of Lot 33 and along said West Right of Way line,
South 03 degrees 11 minutes 37 seconds West, 183.00 feet to a set rebar with cap marking the Southeast
Corner of Lot 33. Thence leaving said West Right of Way line and along the South line of Lot 33,North
86 degrees 40 minutes 02 seconds West, 110.70 feet to a set rebar with cap. Thence leaving said South
line, North 00 degrees 34 minutes 09 seconds East, 183.43 feet to the Point of Beginning containing 0.48
of an acre and subject to any Easements of Record.

Commission, in accordance with A.C.A. § 14-56-422.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The above-described property is hereby rezoned from C-2 to R-3 and the Van Buren Zoning
Map is amended to reflect this rezoning.
IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass,
approve, and adopt, by a vote of (p for and fl against, the foregoing Ordinance at its regular meeting
held on the 27th day of January 2020.

4-duplex development is contiguous to this property on its north boundary.
Master Land Use Plan The 2009 Master Land Use Plan shows this property within a small
area of Single Family/Duplex surrounded by Commercial and Industrial.
Master Street Plan. South 26th Street is a local street.
Flood Plain. No
STAFF COMMENTS
The proposed R-3 zoning is more compatible with the master land use plan and the master street
plan than the Commercial-2 zoning. The 3-duplex multi-family development seems consistent
with the existing development next to this property.

I am requesting a rezoning of this C-2 property to be equal with the surrounding R-3 properties. Our plan is to build

I have been swamped and out of pocket today so I am cutting it close submitting my paperwork to get
on the planning commission agenda for the rezoning of this lot on 26 street.Stacy is coming by around
