ORD NO 21-2001 ORDINANCE NO. 2001 REPEALING ORDINANCE NO. 4 -2000 AND AMENDING ORDINANCE NO. 22 1997 ESTABLISHING MONTHLY RATES FOR MANDATORY RESIDENTIAL SOLID WASTE COLLECTION SERVICE FOR THE CITY OF VAN BUREN, ARKANSAS WHEREAS, The City of Van Buren has implemented a mandatory residential solid waste management system and recycling program pursuant to Ordinance No. 1992 -25; and, WHEREAS, it is the duty of the City Council of the City of Van Buren to approve rates, charges or contractual fees to be charged by residential solid waste disposal firms; and, WHEREAS, the cost of residential solid waste collection within the City of Van Buren, Arkansas, has increased since the same were established by Ordinance No. 22 -1997, passed and approved October 20, 1997; and Ordinance No. 4 2000 passed and approved January 24, 2000; and, WHEREAS, the Van Buren Municipal Utilities Commission acting as agent for the City has recommended a schedule of fees and charges for operation of the residential solid waste management program. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, that Ordinance No. 4 2000 is hereby repealed, and ORDINANCE No. 22 1997 is hereby amended as follows; SECTION 1: The monthly rate to be charged for each single family residential unit as defined in Ordinance No. 1992 -25 shall be ($10.20) ten dollars and twenty cents. The effective date of these charges shall be October 1, 2001. These charges shall cover at a minimum once a week residential solid waste collection (excluding removal of yard waste materials), twice monthly curbside recycling collection and the operation of a recycle drop -off center. SECTION 2: All other provisions of Ordinance 22 1997 shall remain in full force unless expressly modified herein. SECTION 3: That if any section or part of this Ordinance shall be held invalid or unconstitutional it shall not effect the remaining Sections thereof; and the Sections and parts of said Ordinance shall be treated severally. ti 0 SECTION 4: That due to the need to maintain and enforce a comprehensive city wide residential solid waste management system and recycling program, this ordinance being necessary for the preservation of public peace, health and safety shall be in full force and effect from October 1, 2001.
