CITY COUNCIL MEETING SEPTEMBER 23,2019
The City Council of the City of Van Buren, Arkansas met at 5:30 p.m. Monday,
September 23, 2019 at City Hall. The meeting was called to order by Mayor Joseph Hurst. On
roll call, the following Council members answered as their names were called: Council Member
Dodson, Kneeland, Petty, Sparkman, Swaim and Wood. City Clerk-Treasurer Phyllis Thomas
and City Attorney Candice Settle were also present. This made a total of nine (9)present. A
quorum was declared.
The invocation was given by Pastor Britt Brooks of First Assembly of God.
Mr. Brooks then led the Pledge of Allegiance.
Mayor Hurst then asked to adopt the minutes of the Regular Council Meeting on August
26, 2019. Council Member Wood made a motion to approve the minutes. Council Member
Swaim seconded the motion. On roll call, the following Council members voted aye: Council
Member Swaim, Wood, Sparkman, Kneeland, Petty and Dodson. The following voted nay:
none.
On the agenda next was to consider A RESOLUTION TO AUTHORIZE THE
MAYOR AND CITY CLERK TO REMOVE AND DISPOSE OF CERTAIN
FIXED ASSETS FROM THE CITY OF VAN BUREN'S FIXED ASSET
INVENTORY,BY SEALED BID,AUCTION, OR OTHER METHOD
AUTHORIZED UNDER THE LAW,AND FOR OTHER PURPOSES. The Clerk
read the Resolution in its entirety. Mayor Hurst asked if there was any discussion. There
was none. Council Member Swaim seconded by Council Member Dodson moved that the
Resolution be adopted. On the Clerk's calling the roll,the following vote resulted: Ayes
—Council Member Swaim, Wood, Sparkman,Kneeland,Petty and Dodson.Nays—None.
The Mayor thereupon declared the Resolution adopted and signed the Resolution,which
was attested by the City Clerk and impressed with the seal of the City.

WHEREAS, the City
of Van Buren has certain fixed assets on its Fixed Asset Inventory List which are
obsolete,and/or beyond repair,and are no longer cost effective,so as to no longer be needed by
the City;and
WHEREAS, after an inventory of fixed assets,it is therefore recommended by our State Auditor that said
items or item be removed from the City's Fixed Asset Inventory and disposed of by sealed
bid,auction or as otherwise authorized under A.C.A§14-54-302.

BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION APPROVING THE FINAL PAYMENT
FOR THE VALLEY FORGE DRAINAGE IMPROVEMENT
PROJECT;AND FOR OTHER PURPOSES.
WHEREAS, Hawkins-Weir Engineers, Inc. acting as the Construction Manager for
the City of Van Buren, Arkansas advertised for bids for drainage
improvements within the City;and
WHEREAS, the City Council approved the Mayor entering into a construction
contract with Goodwin and Goodwin,Inc.in the amount not to exceed
$347,181.00 by Resolution#09-01-2018;and
WHEREAS, the City's final payment schedule decreased the total amount of the contract
by$51,024.10.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL
OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The City of Van Buren, Arkansas accepts and approves the total final
payment of$14,807.84 to Goodwin and Goodwin,Inc. as set forth and
attached hereto.
SECTION 2: The Mayor and City Clerk are hereby authorized by the City Council for
the City of Van Buren to pay all expenses relating to the Valley Forge
Drainage Improvement Project and to execute all documents necessary to
effectuate said changes.

On the agenda next was to consider A RESOLUTION REGARDING
UNIFORM AND EQUIPMENT ALLOWANCES FOR THE VAN BUREN FIRE
AND POLICE DEPARMENTS. The Clerk read the Resolution in its entirety. Mayor
Hurst asked if there was any discussion. Chief Hammond clarified that the original
ordinance in 1991 stated the yearly allowance was $600.00/year,but somewhere along
the way it was increased to $700.00/year and we don't know when or why. So, in order to
be in compliance we wanted to clear that up. The major change comes in Section 4 where
the police department allowance will now go into a budgeted line item where the city will
pay for officers approved purchases instead of giving those directly to the officers on
their quarterly paycheck. The two-fold outlook is: 1)the officers won't be receiving
taxable funds, instead,they will have access to the full $175 quarterly to spend on their
items and 2) it makes the city better stewards of our money, ensuring those funds are
indeed being spent on uniforms and equipment. Council Member Petty questioned the
language used in Sections 1, 3, and 4. It sounds more like there will be separate
$700.00/year budgets for uniform and equipment. City Attorney Candice Settle agreed
that the language could stand to be more clear and uniform. Council Member Petty also
questioned why it is specific to after one year of service. Police Chief Hammond replied
that it is because they are furnished all new equipment upon being hired, therefore,the
logic is that they would not need to be replaced until after one year of employment.
Council Member Swaim asked if the fire department will be doing the same thing. Fire
Chief Arnold replied no.Council Member Swaim seconded by Council Member Petty
moved that the Resolution be adopted as amended. On the Clerk's calling the roll,the
following vote resulted: Ayes—Council Member Swaim, Wood, Sparkman, Kneeland,
Petty and Dodson.Nays—None.

A RESOLUTION REGARDING UNIFORM AND EQUIPMENT
ALLOWANCES FOR THE VAN BUREN FIRE AND POLICE

WHEREAS, the City of Van Buren's Fire and Police Departments are dedicated to the well-being and
safety of Van Buren citizens;and
WHEREAS, in order to properly serve,protect,and meet the emergency needs of Van Buren citizens,
updates to Resolution 003-03-1991,which approved uniform allowances and equipment
for the Van Buren Fire and Police Departments,are necessary.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF VAN BUREN,
ARKANSAS,THAT:
SECTION 1: After one year of employment, oefformed employees of the Van Buren Police
Department and the Van Buren Fire Department shall each receive a uniform and
equipment allowance in the amount of up to 5700(seven hundred dollars)per year.
SECTION 2• Uniformed employees of the fire department shall receive uniform allowances in
quarterly payments of 5175(one hundred seventy-five dollars)each.
SECTION 3' Upon being hired,uniformed employees of the police department,shall be furnished with
all uniforms and equipment necessary to perform his or her duties. Upon leaving the
department,each employee shall be responsible foe returning all equipment provided by
the police department
SECTION 4: After one year of employment,uniformed employees of the police department shall be
entitled to an annual uniform and equipment replacement budget of up to$700(seven
hundred dollars). Only items specified by the Chief of Police will be purchased,and s
record of all purchases will be maintained by the Chief of Police.

conflict with this Resolution,Shall hereafter be tug and void

Mayor Hurst asked if there was any discussion. Council Member Petty clarified that this
is outside the city limits,but within the planning jurisdiction. He then asked if they are
inspected as if they are within the city limits. Mayor Hurst stated in the past they were not
inspected. Council Member Petty asked how we could make sure they build it to
specifications of city code. City Attorney Candice Settle stated we do not have the
authority. City Planner Wally Bailey explained the regulations. Council Member
Sparkman seconded by Council Member Swaim moved that the Resolution be adopted.

Member Swaim and seconded by Council Member Dodson to appropriate the sum of
$1,253,873.49 to pay expenses and salaries for August 2019,presented by the clerk. The
Council with a unanimous vote.

Next, Police, Fire, Building Inspector, Public Works/Planning, and Ambulance
reports were presented for filing. There being no further questions or changes, the reports
were filed as submitted.
Next on the agenda was Miscellaneous and General Discussion. The council had a
request from Mr. Lonnie London, owner of The Vault, to close a block of 7th Street on
September 27, 2019 for the Bikes Blues and BBQ Firefighter Poker Run. Motion was
made by Council Member Swaim and seconded by Council Member Wood. The council
followed with a unanimous vote. Also, King Elementary School submitted a request to
close streets on February 22, 2020 for their annual Run with the Knights 5k. Motion was
made by Council Member Sparkman and seconded by Council Member Dodson. The
council followed with a unanimous vote.
Mayor Hurst spoke on the downtown streetscape grant. We applied a couple years
ago and were denied, so we reapplied this year and were awarded the grant. The grant
will cover the three blocks of Main Street at 6th, 7th and 8th Streets and totals $492,000.
The total project is estimated to cost$615,000, so the grant covers 80% of the project
cost.
Fred Allen,who resides at 3 Cowden Court, distributed to the council police
dispatch records and photographs from the area of 1319 Mulberry Street. Mayor Hurst
thanked him for his concerns and assured him that it is a priority of the city to control
nuisance situations and that City Planner Wally Bailey and himself will be continuing to
look into it.
There being no further business, motion was made by Council Member Dodson and
seconded by Council Member Swaim to adjourn. The Council followed with a unanimous vote.
