BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 (VAN
BUREN MUNICIPAL CODE NO.14.04.01)FOR THE PURPOSE OF
REZONING CERTAIN PROPERTY IN THE CITY OF VAN
BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE
CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER
PURPOSES.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the law of the State of
Arkansas,with all powers,authority and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963); and
WHEREAS, a request has been made by Aaron and Felicia Helms to rezone certain property within the
city limits of the City of Van Buren; and
WHEREAS, notice of a Public Hearing was duly published in the Press Argus Courier on August 17,
2019, and a public hearing was conducted as required by law (A.C.A 14-56-422) on
September 3,2019; and
WHEREAS, as a result of this hearing,the Planning Commission has recommended that certain property
within the city limits of the City of Van Buren be rezoned from its previous classification
to the following:
Property Zoned New Zoning
R-3(Multi-family Residential District) C-2(Thoroughfare Commercial District)

Lot 1A of Quail Creek Addition,Van Buren,Crawford County,Arkansas,being more particularly

WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire Planning
Commission,in accordance with A.C.A.& 14-56-422.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The above-described property is hereby rezoned from R-3 to C-2 and the Van Buren Zoning
Map is amended to reflect this rezoning.
IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass,
approve, and adopt, by a vote of (a for and () against, the foregoing Ordinance at its regular meeting

The subject rezoning request was reviewed by the Van Buren Planning Commission on
September 3, 2019. The subject rezoning was submitted by Aaron and Felicia Helms as agent for
the current owners, Timothy and Vickie Brown. The proposed rezoning will facilitate the
construction of a new self-service laundromat.
The property is approximately one half acre at the northeast corner of Oak Lane and North 28th
streets. A residential structure is currently located on the property.
The 2009 Master Land Use Plan identifies this property as Commercial. The Master Street Plan
identifies Oak Lane as a Collector Street, Class II and North 28th Street as a Collector Street
Class I. The proposed rezoning is consistent with the Master Land Use Plan and the Master
Street Plan.
The property was previously zoned Commercial-2 but was changed to Residential-3 in 2009.
This request will change the zoning back to the Commercial-2 designation.
No one was present to speak in opposition to the request.
The Planning Commission voted 6 in favor, 0 opposed, and 1 abstention(2 members were
absent)to approve this request and recommend the City Council amend the City's zoning map.

Requested Zoning. Commercial-2 Thoroughfare Commercial District which which permits a
number of retail, automotive,medical, office, churches and similar uses and some uses allowed with
a conditional use approval.
Adjacent Zoning and Land Uses Contiguous zoning is Residential-3 and Commercial-2 with
land uses that include a church, commercial building and residential
Master Land Use Plan The 2009 Master Land Use Plan Map shows this property has a

Master Street Plan. Oak Lane is classified as a Collector Street, Class II. North 28th Street is
classified as a Collector Street Class I.

STAFF COMMENTS
This property has a history of being zoned Commercial-2. In 2009,a zoning change was approved
by the City Council with the passage of Ordinance No. 25-2009.The Ordinance changed the
property from Commercial-2 to Residential-3.
The property has access to two Collector streets, and the proposed zoning of C-2 is consistent with
the Master Land Use Plan Map designation of Commercial.

4. COMMERCIAL AREAS
Van Buren functions as the retail and professional services provider for Crawford County. Van
Buren's commercial areas include grocery stores, dry cleaners,restaurants, day care, video
stores,banks, cafes, gas stations, and other similar types of commercial services that are
convenient and serve residents on a daily basis. It is vital to Van Buren's economy that
commercial businesses are accessible to their customers, and it is equally vital to manage
commercial development to minimize negative impacts on neighborhoods and the City's
transportation network. Appropriate sites for existing and future regional commercial attractions
are shown on the Land Use Plan Map.
•
Guiding Policies:
4.a Provide enough retail business and service space to enable Van Buren to realize its full
potential as a regional market.
4.b Encourage improvement and expansion of regional shopping and entertainment attractions.
4.c Ensure that the surface transportation network serving commercial areas meet acceptable
levels of service.
4.d Ensure that large commercial sites are designed and landscaped in a manner that minimize
negative impacts to the character of their surroundings. Protect adjoining properties from the
potential adverse impacts associated with commercial uses adjacent to and within residential
areas with proper mitigation measures that address traffic,noise, appearance, lighting, drainage,
and effects on property values.
4.e Encourage developers to designate and plan for"neighborhood" commercial areas at the time
of subdivision approval to properly plan for accessibility to these areas.

SECTION 2: The adopted rezoning shall be filed in the office of the City Clerk,in accordance with
