ORD NO 07-2001 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 7 -2001 AN ORDINANCE AUTHORIZING A MORATORIUM ON THE PLACEMENT OF SIGNS IN THE CITY OF VAN BUREN. WHEREAS, A number of signs have recently been placed on I- lighway 59 and other locations in the City of Van Buren; and WHEREAS, A "sign" for purposes of this ordinance is any structure or part thereof, or any device attached to, painted on, or represented on a building or other structure, upon which is displayed or included any letter, work, model, banner, flag, pennant, insignia, decoration, device or representation used as, or which is in the nature of an announcement, direction, advertisement, or other attention directing device. A sign includes any billboard, but does not include the flag, pennant, or insignia of any state, city, or other political unit, or any political, charitable, educational, philanthropic, civic, professional, religious, or like campaign, drive, movement or event. A sign shall not include a similar structure or device located within a building except for illuminated signs within show windows; and WHEREAS, The City of Van Buren currently has no ordinance in place regulating the usage and location of signs in the City; and WHEREAS, Pursuant to its police powers, the City Council desires to place a moratorium on the erection, placement, or installation of signs within the City of Van Buren for a period of sixty (60) days so that this issue may be studied by the Planning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: TI -IAT no signs are to be placed, erected, located or otherwise within the City of Van Buren for a period of sixty (60) days from the date this Ordinance goes into effect. SECTION 2: THAT if any section or part of this Ordinance shall be held invalid or unconstitutional it shall not effect the remaining Sections thereof, and the Sections and parts of said Ordinance shall be treated severally. _.A, SECTION 3: THAT this ordinance being necessary for the preservation of public peace, health, and safety shall be in full force and effect from the date of its passage.
