CITY COUNCIL MEETING DECEMBER 17,2018
The City Council of the City of Van Buren, Arkansas met at 5:30 p.m. Monday,
December 17, 2018 at City Ilan. The meeting was called to order by Mayor Freeman. On roll
call, the following Council members answered as their names were called: Council Member
Wood, Sparkman, Kneeland, Petty,Moore and Swaim. City Clerk-Treasurer Phyllis Thomas and
City Attorney Candice Settle were present. This made a total of nine (9) present. A quorum was
declared.
The invocation was given by Mayor Bob Freeman.
Mayor Freeman then led the Pledge of Allegiance.
Mayor Freeman presented a key to the city to Council Member David Moore for his 30
plus years of service to the City of Van Buren.
Next, Council Member Alan Swaim presented Mayor Bob Freeman with a key to the city
for his 12 years of service.
Mayor Freeman then asked to adopt the minutes of the Regular Council Meeting on
November 26, 2018. Council Member Sparkman made a motion to approve the minutes.
Council Member Petty seconded the motion. On roll call, the following Council members voted
aye: Council Member Sparkman, Kneeland, Petty. Moore, Swaim and Wood. The following
voted nay: none.
On the agenda next was to consider A RESOLUTION ADOPTING A
PROPOSED BUDGET FOR THE FISCAL YEAR ENDING DECEMBER 31, 2019.
The Clerk read the Resolution in its entirety. Mayor Freeman asked if there was any
discussion. Mayor Freeman stated this was the same budget that was provided at the
November council meeting and as he said then the only major changes was the retirement
aspect for the new School Resource Officers. Council Member Swaim seconded by
Council Member Kneeland moved that the Resolution be adopted. On the Clerk's calling
the roll, the following vote resulted: Ayes—Council Member Sparkman, Kneeland,
Petty,Moore, Swaim and Wood. Nays None.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which
was attested by the City Clerk and impressed with the seal of the City.

SECTION I; The 2019 Proposed Expenditures of 516.087,156.00 (Sixteen Million,
Eighty-Seven 'Thousand, One hundred Fifty-Six Dollars) is hereby
appropriated and a copy of said Budget is attached hereto and made a part
hereof.
SECTION 2: The appropriations made herein include additional pay for
Holidays for all aeents, servants and employees of the City of Van
Buren including, but not limited to, uniformed employee, as
provided for by the laws of the State of Arkansas.

THE APPROPRIATION OF FUNDS; DECLARING AN EMERGENCY; AND
FOR OTHER PURPOSES. The Clerk read the Ordinance in its entirety. Council
Member Swaim moved that the rules he suspended and the Ordinance be placed on its
second reading. The motion was seconded by Council Member Kneeland. The council
followed with a unanimous vote. The Cleric then read the Ordinance the second time.
Council Member Swaim moved that the rules be further suspended and the
Ordinance placed on the third and final reading. The motion was seconded by Council
Member Kneeland. The council followed with a unanimous vote. The Clerk then read the
Ordinance the third and final time. The N4ayor asked if there was any discussion. Chief
Jamie Ilammond explained that the two traverse vehicles are for the School Resource
Officer supervisor and a new full time Public Information Officer position, and the
remaining six new vehicles are to equip the new SRO's that will be assigned in the
spring.
The Mayor then put the question, "Shall the Ordinance pass?" Motion was made by
Council Member Swaim and seconded by Council Member Moore to adopt the Ordinance. On
the Clerk's calling the roll, the following vote resulted: Ayes—Council Member Sparkman,
Kneeland, Petty, Moore, Swaim and Wood. Nays—None. The Mayor declared the motion
carried as there were six (6) ayes and (0) nays. Four(4) votes being necessary for passage.
Motion was made by Council Member Swaim and seconded by Council Member
Kneeland, that the emergency clause be adopted. On the Clerk's calling the roll, the following

Council Member Jim Petty questioned a water flow issue if that alley way was closed.
City Attorney Candice Settle stated issues were examined and discussed within the
Planning Commission meeting and everyone was satisfied with the information given.

ORDINANCE NO. 25-1997, TO RECLASSIFY HOGS, GOATS, SHEEP,
CATTLE,AND HORSES AS CONDITIONAL USES 1N CERTAIN ZONES, AS
SPECIFIED IN THE CITY OF VAN BUREN PERMITTED AND CONDITIONAL
USE LEGEND. The Clerk read the Ordinance in its entirety. Council Member Swaim
moved that the rules be suspended and the Ordinance be placed on its second reading.
The motion was seconded by Council Member Sparkman. The council followed with a
unanimous vote. The Clerk then read the Ordinance the second time.

Member Moore. The council followed with a unanimous vote. The Clerk then read the
Ordinance the third and final time. The Mayor asked if there was any discussion. Mayor
Freeman explained that a couple months back someone approached the council about
allowing pet pigs in the city, so they formed a working group to look at the repercussions.
Mayor Elect and City Planner Joe Hurst went on to say that there was a permitting system
in place for goats and sheep, but it wasn't used effectively. By allowing it to be a
conditional use that opens up for feedback from potential neighbors during a public
hearing. Council Member Jim Petty asked if it was permanent. Mr. Hurst replied no that
it was conditional meaning if concerns were raised or stipulations were not met, then it
could be revoked.

Council Member Swaim and seconded by Council Member Kneeland to adopt the Ordinance.

BUREN MUNICIPAL CODE CHAPTER 6.08, REGARDING ANIMALS AND
FOWL INSIDE THE CITY LIMITS. The Clerk read the Ordinance in its entirety.
Council Member Wood moved that the rules be suspended and the Ordinance be placed
on its second reading. The motion was seconded by Council Member Kneeland. The
council followed with a unanimous vote. The Clerk then read the Ordinance the second
time.

Attorney Candice Settle explained that the current application process is not being
utilized and this new system would give more oversight and control where it is needed.
Council Member Jim Petty asked how the word will get out to inform the public of this
change to give them notice. Mayor Elect Joe Hurst stated that the Code Enforcement
Officer's will not be sent out to each farm to evaluate the situations until a complaint or
question arises.

Council Member Sparkman and seconded by Council Member Kneeland to adopt the Ordinance.

Next on the agenda was the Financial Statement. Motion was made by Council
Member Swaim and seconded by Council Member Kneeland to appropriate the sum of
$1,119,719.91 to pay expenses and salaries for November 2018, presented by the clerk.
The Council followed with a unanimous vote.

Next Police,Fire, Building Inspector,Public Works/Planning, and Ambulance
Reports were presented Ior filing. There being no further questions or changes, the
reports were filed as submitted.
Next on the agenda was Miscellaneous and General Discussion. Stephanie Touuzen who
resides at 1114 Sandstone Drive appeared before the council with concerns of public health and
safety after the recent tornado asking the city for assistance with clean up. After much discussion
regarding insurance and private sector versus government sector funds, Mayor Bob Freeman
suggested Mayor Elect Joel lurst set up a meeting to try and come up with a dollar amount on
contracting some clean up assistance and to contact the Governor's office for finding assistance.
Council Member Tyler Wood asked if we could appoint a person to organize a volunteer group.
Council Member Jim Petty questioned whether putting a lot of pressure on an individual already
dealing with a disaster would be conducive. In the end, the public was urged to contact the
mayor's office with their insurance information either by phone, email, or providing it at the
council meeting and the city would again contact the Governor's office to look into contacting
clean up.
A representative from Area Agency on Aging briefly spoke to the council about some of
the ways they are able to service our area thanks to the contribution made by the city.
There being no further business, motion was made by Council Member Wood and
seconded by Council Member Swaim to adjourn. The Council followed with a unanimous vote.
The meeting adjourned at 7:04 p.m.
