ORDINANCE NO. 9 -2018
BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO ABANDON PUBLIC RIGHTS-OF-WAY
AND AN ALLEYWAY IN THE MEYER'S ADDITION, INSIDE
THE CITY OF VAN BUREN, CRAWFORD COUNTY,
ARKANSAS.
WHEREAS, a petition has been filed with the City Council of Van Buren, Arkansas, by Larry
Breeden, represented by Satterfield Surveying, to vacate and abandon the public
rights-of-way and alleyway along certain lots inside the Meyer's Addition more
particularly described as follows:
Description of Existing Rights-of-Way and Alleyway
All that part of the platted right-of-way of Lee Street lying between South 13th
Street and Block "M", Meyer's Addition, and all that part of the right-of-way of
South 14th Street lying between Virginia Street and the South line of Meyer
Reserve between Blocks "K ", "L", and "M". All of the right-of-way of South
15th Street between Virginia Street and Meyer Reserve. All that part of a Platted
15.00 foot alleyway lying between lots 1 through 12, Block"M",within Meyer's
Addition to the City of Van Buren,Arkansas;
WHEREAS, after due notice as required by law, the Council has heard all persons desiring to
be heard on the question of abandoning the public rights-of-way and alleyway in
the hereinabove subdivision, and has ascertained that the public rights-of-way
and alleyway herein above designated has therefore been dedicated to the public
use as public rights-of-way and alleyway and that the same has not been used for
a period of more than five (5) years preceding this date; and that the owners of
the property abutting the public rights-of-way and alleyway to be abandoned
have filed with the City Council or have expressed their consent to such
abandonment and the public interest and welfare are not adversely affected by
abandonment of said public rights-of-way and alleyway; and
WHEREAS, the City Council of Van Buren, acting under the authority of A.C.A. 14-199-103
and A.C.A. 14-301-302, has the authority to abandon public rights-of-way and
alleyway or segments thereof.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,ARKANSAS,THAT:
SECTION 1: The City of Van Buren, Arkansas, hereby releases, vacates, and abandons all its
rights,together with the rights of the public generally, in and to the public rights-
! of-way and alleyway specifically described above.
SECTION 2: A copy of this Ordinance bearing original signatures and duly certified by the
City Clerk shall be filed in the Miscellaneous Records of the Circuit Clerk of
Crawford County,Arkansas.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas, by its City Council, did pass,
approve,and adopt, by a vote of CD for and 0 against the foregoing Ordinance at its regular meeting
held on the 26th day of March 2018.

the City of Van Buren Municipal Utilities approves the installation of one centrally
located access gate on South 13th Street to access water and sewer utilities,and does not
require an access gate at each individual water and sewer easement.

his/her agent shall be required to develop and submit a fully executed easement. No action
will be taken by the City Council on an abandonment request until said easement is on file
with the city staff and/or franchisees have determined that no utility easement is necessary.

Tuesday of the month in order to be placed on the City Council agenda. The petition will
be placed on the agenda for the City Council to set a public hearing for the next month's
City Council meeting. Before the public hearing, the petition will be referred to the
Subdivision Review Committee and then to the Planning Commission for recommendation
to the City Council.

Beginning at a set rebar with cap marking the Northwest Corner of Block "K",
said point being at the intersection of the South Right of Way line of Lee
Street and the East Right of Way line of South 13th Street. Thence along the
East Right of Way line of South 13th Street the following bearings and
distances: North 06 degrees 32 minutes 12 seconds West, 25 .23 feet to a set
rebar with cap. North 02 degrees 16 minutes 11 seconds West, 25.56 feet to the

Reserve within Meyer's Addition to the City of Van Buren, Crawford County,
Arkansas being more particularly described as follows:
Beginning at the Southeast Corner of Block "M", said point being at the
intersection of the North Right of Way line of Virginia Street and the West
Right of Way line of South 15th Street. Thence along the East line of said
Block "M" and along said West Right of Way line of South 15th Street to the
South line of Meyer Reserve. Thence along said South line to the Northwest
Corner of Block "P", said point being on the East Right of Way line of South
15th Street. Thence along the West line of said Block "P" to the Southwest
Corner of Block "P", said point being at the intersection of the North Right of
Way line of Virginia Street and the East Right of Way line of South 15th Street.
Thence along said North Right of Way line of Virginia Street, 50.00 feet to the
Point of Beginning.
All that part of a Platted 15.00 foot alleyway lying between Lots 1 through 12,
Block "M", Meyer's Addition to the City of Van Buren, Crawford County, Arkansas
being more particularly described as follows:
Beginning at the Southeast Corner of Lot 12, said Point being on .the North Right
of Way line of Virginia Street. Thence along the East lines of Lots 12, 10, 8,
6, 4, and 2, to the Northeast Corner of Lot 2 and the South line of Meyer
Reserve. Thence along said South line of Meyer Reserve, to the Northwest Corner
of Lot 1. Thence leaving said South line and along the West lines of Lots 1, 3,
5, 7, and 9, Block "M" to Southwest Corner of Lot 9 and the North Right of Way
line of Virginia Street. Thence along said North Right of Way line, 15.00 feet

PETITION TO VACATE Street and Alley's LOCATED IN Meyer's Addition, CITY OF
VAN BUREN,CRAWFORD COUNTY, ARKANSAS.
TO: Van Buren City Council
We,the undersigned,being all of the owners of the real estate abutting the South 14th,South 15th,Lee Street and Alley Way
herein sought to be abandoned and vacated, lying in Meyer's Addition City of Van Buren,
Crawford County,Arkansas,a municipal corporation,petition to vacate Street and Alley
which is described as follows:

That the abutting real estate affected by said abandonment of the streets and alley
Lots l&6 Blk L,Blocks K,M and P Meyers Addition are
and that the public interest and
welfare would not be adversely affected by the abandonment of the above-described
Street and Alley ,and that the Streets and Alley has not been used by the public
for a period of at least five(5)years.
The petitioners request that the City of Van Buren, Arkansas,abandon and vacate the above-described
real estate, subject to existing public utility easement,water line easements,sewer easements,or drainage
easements as required, and that the above-described real estate be used for the respective benefit and
purpose as now approved by law.
The petitioners further request that the above-described real estate be vested in the abutting property
owners as provided by law.
WHEREAS,the undersigned petitioners respectfully request that the governing body of the City of Van
Buren, Arkansas,abandon and vacate the above-described real estate,subject to existing public utility
easement,water line easements,sewer easements, or drainage easements as required, and that title to said
real estate sought to be abandoned be vested in the abutting owners as provided by law.
