BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS,AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963 (VAN BUREN
MUNICIPAL CODE NO. 14.04.01) FOR THE PURPOSE OF REZONING
CERTAIN PROPERTY IN THE CITY OF VAN BUREN, ARKANSAS,
AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN,
ARKANSAS,AND FOR OTHER PURPOSES.
WHEREAS, the City of Van Buren,Arkansas, is duly incorporated under the law of the State of
Arkansas, with all powers, authority and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963); and
WHEREAS, a request has been made by TPC Partners, LLC represented by Jimmy Bell Real Estate,
to rezone certain property within the city limits of the City of Van Buren; and
WHEREAS, notice of a Public Hearing was duly published in the Press Argus Courier on November
18, 2017,and a public hearing was conducted as required by law(A.C.A. & 14-56-422)
on December 5,2017; and
WHEREAS, as a result of this hearing,the Planning Commission has recommended that certain
property within the city limits of the City of Van Buren be rezoned from its previous
classification to the following:
Current Zone New Zone
R-3 (Multi-Family Residential District) C-2 (Thoroughfare Commercial District)
Legal Description:
The Plaza Lot 4-B-1-B being a replat of The Plaza Lot 4-B-1,Van Buren,Crawford County,Arkansas;
and
WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire Planning
Commission, in accordance with A.C.A. & 14-56-422.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,ARKANSAS,THAT:
Section 1: The above described property is hereby rezoned from R-3 to C-2 and the Van Buren
Zoning Map is amended to reflect this rezoning.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council, did pass,
approve,and adopt, by a vote of /0 for and() against the foregoing Ordinance at its regular meeting
held on the 18th day of December 2017.

Honorable Mayor Freeman,Members of the City Council and Members of the Planning Commission,
I,acting as real estate agent for Firstar Bank(Buyer)and representative for TPC Partners, LLC
(Seller),am asking for a rezoning of the South 174'+-of Lot 4B-1,less and except the West 60'at the
Pointer Trail,Crawford County,Van Buren,Arkansas.Containing 1.5 acres more or less;of parcel
number 700-07061-108 from R-3 to C-2(See Exhibit"A"for legal description).
My client,Firstar Bank,is purchasing the property from TPC Partners,LLC and plans on building
a Bank Branch. The current zoning doesn't allow for a bank building to be constructed so they are asking
for it to be rezoned to C-2 to allow for the construction of the bank. As you can see from Exhibit"B",the
site in question is already surrounded by C-2 properties. Firstar Bank has signed below to give me the
authority to represent them in this request. I also have a letter attached from TPC Partners,LLC showing
their approval of this request. Currently there are NO existing structures on the property.

This letter is to authorize Mr.J. Kevin Bell to represent me to rezone part of my property(parcel
number 700-07061408)that I am selling to Firstar Bank. I am selling the South 174'+-of Lot 4B-1,less
except the West 60'at the Pointer Trail,Crawford County,Van Buren,Arkansas. The new parcel will
