CITY COUNCIL MEETING JUNE 26, 2017
The City Council of the City of Van Buren, Arkansas met at 5:30 p.m. Monday, June 26,
2017 at City Hall. The meeting was called to order by Mayor Freeman. On roll call,the
following Council members answered as their names were called: Alderman Petty, Swaim,
Wood and Sparkman. City Clerk-Treasurer Phyllis Thomas and City Attorney Candice Settle
were present. Aldermen Kneeland and Moore were absent. This made a total of seven(7)
present. A quorum was declared.
The invocation was given by Chief Kenneth Bell of the Van Buren Police Department.
Mr. Bell then led the Pledge of Allegiance.
Mayor Freeman then asked to adopt the minutes of the Council Meeting on May 15,
2017. Alderman Swaim made a motion to approve the minutes. Alderman Wood seconded the
motion. On roll call,the following Council members voted aye: Alderman Swaim, Wood,
Sparkman, and Petty. The following voted nay: none.
On the agenda next was to consider A RESOLUTION SETTING A PUBLIC
HEARING DATE FOR ABANDONING A PUBLIC RIGHT-OF-WAY IN THE
MOUNTAIN VIEW ADDITION INSIDE THE CITY OF VAN BUREN,
CRAWFORD COUNTY,ARKANSAS. The Clerk read the Resolution in its entirety.
Mayor Freeman asked if there was any discussion. There was none. Alderman Petty
seconded by Alderman Sparkman moved that the Resolution be adopted. On the Clerk's
calling the roll,the following vote resulted: Ayes—Alderman Swaim, Wood, Sparkman,
and Petty.Nays—None.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which
was attested by the City Clerk and impressed with the seal of the City.

WHEREAS, Erich Bauman,represented by Satterfield Surveying,has petitioned the City Council of
Van Buren,Arkansas,to vacate and abandon the public right-of-way along certain lots
inside the Mountain View Addition more particularly described as follows:
Description of Existing 60.00 Foot Right-of-Way
All that portion of the 60 feet platted Walnut Street Right-of-Way,lying between
Lots 7 thru 12 Block I,Mountain View Addition and Lots 1 thru 6,Block P,

way abandonment have consented by signed petition;and

A.C.A.14-301-302,has the authority to vacate public right-of-ways or segments thereof.

SECTION 1: A Public Hearing is set for July 24,2017,at 5:30 P.M.in the Van Buren City Council
Room,at which time said Petition shall be presented to the City Council and the City
Council will determine at that time if such portion of said public right-of-way should be
vacated and that all affected property owners and other persons directly interested have
consented to such vacating.
SECTION 2: The City Clerk of Van Buren,Arkansas,is hereby directed to give notice by publication
once a week for two consecutive weeks in some newspaper,published in Crawford
County,advising the property owners and others affected,of said date and time the
Council will hear said Petition.

TO REFER CHANGES TO THE PERMITTED & CONDITIONAL USE LEGEND •
TO THE PLANNING COMMISSION FOR STUDY AND
RECOMMENDATIONS. The Clerk read the Resolution in its entirety. Mayor •
Freeman asked if there was any discussion. Mayor Freeman explained that this allows the
Planning Commission to review the amendment and come back to the council with a
recommendation. This change would allow pharmacies to be a permitted use in the
Industrial zone rather than a conditional use that must be reviewed every year. Alderman •
Petty asked if we should broaden the scope. Mayor Freeman stated that it can be looked
at in the future, but for the time being he would like to focus on just having this reviewed.
Alderman Wood seconded by Alderman Swaim moved that the Resolution be adopted.

Wood, Sparkman, and Petty. Nays—None.

WHEREAS, the Police Department has been using Information Technologies,Inc.Records
Management software to draft and store police reports since 1998;and
WHEREAS, in 2007 the Van Buren City Council approved upgrading the software from the
Standard Edition to the Enterprise Edition;and
WHEREAS, the software subscription and software support payment is due for the annual
renewal.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF VAN
BUREN,ARKANSAS,THAT:
SECTION 1: The Mayor is authorized to renew the software subscription and software support
for the Enterprise Edition of Records Management at a price of$23,538.00.

PURPOSES. The Clerk read the Ordinance in its entirety. Alderman Petty moved that
the rules be suspended and the Ordinance be placed on its second reading. The motion
was seconded by Alderman Swaim. The council followed with a unanimous vote. The
Clerk then read the Ordinance the second time.
Alderman Petty moved that the rules be further suspended and the Ordinance
placed on the third and final reading. The motion was seconded by Alderman Swaim.
The council followed with a unanimous vote. The Clerk then read the Ordinance the
third and final time. The Mayor asked if there was any discussion. There was none.

Alderman Sparkman and seconded by Alderman Wood to adopt the Ordinance. On the Clerk's

Next on the agenda was Boards and Commissions. The Van Buren Housing
Authority recommended the appointment of Connie Beyerle to fill Lisa Hucklebury's
vacant position. Alderman Swaim seconded by Alderman Wood made a motion to grant
the nomination. The Council followed with a unanimous vote. The Van Buren Historic
District Commission recommended the re-appointment of Vickie Davis and Lisa Willis
to another three(3) year term. Alderman Wood seconded by Alderman Petty made a
motion to grant the nomination. The Council followed with a unanimous vote. The Van
Buren Municipal Utilities Commission recommended the appointment of Keith Heftier to
fill.John Barnwell's expired term. Alderman Swaim seconded by Alderman Wood made
a motion to grant the nomination. The council followed with a unanimous vote.
Next on the agenda was the Financial Statement. Motion was made by Alderman
Swaim and seconded by Alderman Petty to appropriate the sum of$ 1,498,025.19 to pay
expenses and salaries for May 2017,presented by the clerk. The Council followed with a
unanimous vote.

Next Police, Fire, Building Inspector, Public Works/Planning, and Ambulance Reports
were presented for filing. There being no further questions or changes, the reports were filed as
submitted.
Next on the agenda was Miscellaneous and General Discussion. The council had a street
closing request from The Old Town Merchant Association for their Vintage Junkin Fest on
September 1-3, 2017. Motion was made by Alderman Swaim and seconded by Alderman Wood
to approve the request. The council followed with a unanimous vote.
Carolyn Folsom, owner of The Soap Factory, addressed the council about the tunnel
constructed next to her business in the 800 block of Main Street. She suggested a roof and
column structure verses the closed in tunnel structure for aesthetic purposes. Mayor Freeman
asked Alderman Petty to review the issue and try to reach a compromise.
Mayor Freeman mentioned Alderman Moore had hip surgery which is why he is absent.
He also reminded everyone that the Freedom Park grand opening is Friday morning at 11:00 and
the city fireworks show, sponsored by the Williamson's, Kilgore's and the City of Van Buren,
will be at the Field of Dreams Tuesday, July 4th
Mayor Freeman asked for the council's approval to close the city offices Monday, July
3rd. Motion was made by Alderman Sparkman and seconded by Alderman Swaim to approve the
request. The council followed with a unanimous vote.
Alderman Wood asked about two issues that he has been contacted about recently. First
being an issue with roaming cats. Mayor Freeman replied that there is no practical solution to a)
keep the cats contained and b) enforce the containment of said cats. Secondly, Alderman Wood
questioned the city's panhandling ordinance. City Attorney Candice Settle stated they have been
studying recent case law to see what the best way to handle it would be and has set it on high
priority to bring to council next month.
There being no further business, motion was made by Alderman Sparkman and seconded
by Alderman Wood to adjourn. The Council followed with a unanimous vote. The meeting
adjourned at 6:22 p.m.
