ORD NO 05-2003 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. 5 -2003
AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE A VEHICLE
FOR THE POLICE DEPARTMENT, WAIVING BIDDING REQUIREMENTS
AND DECLARING AN EMERGENCY.
WHEREAS, The City has a need to purchase a vehicle for the Chief of the Van Buren
Police Department to replace his vehicle that was totaled in an accident;
and
WHEREAS, The vehicle to be replaced was a Chevrolet Impala with a police package;
and
WHEREAS, Police packages for Chevrolet Impalas will only be available for a period
of eight (8) more days, making the taking of bids not feasible; and
WHEREAS, Section 14 -58 -303 of the Arkansas Code Annotated provides that "The
governing body, by Ordinance, may waive the requirements of
competitive bidding in exceptional situations where such procedure is
deemed not feasible or practical";
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN, ARKANSAS:
SECTION I: THAT the City Council waives the requirements of competitive bidding in
this particular case as such procedure is not deemed feasible or practical.
SECTION 2: THAT the Mayor is authorized to purchase a 2003 Chevrolet Impala
Unmarked Police Package 9C3 at a price not to exceed $19,295.00 for the
Van Buren Police Department.
SECTION 3: THAT providing police services is necessary for the immediate
preservation of the public peace, health and safety, and an emergency is
declared and this Ordinance shall take effect and be in full force after its
passage and approval.
