ORD NO 18-2004 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. 12. -2004
AN ORDINANCE AMENDING ORDINANCE NO. 24 -2001, GRANTING
RAZORBACK CAB COMPANY A PERMIT TO OPERATE A TAXICAB
SERVICE IN THE CITY, WAIVING A PUBLIC HEARING, DECLARING AN
EMERGENCY, AND FOR OTHER MATTERS
WHEREAS, This Council previously enacted Ordinance No. 24 -2001, an
ordinance regulating taxi cab services within the city limits; and
WHEREAS, Said Ordinance provides for privilege license taxes and fees to be
paid based upon the number of taxicabs an Operator has in service;
and
WHEREAS, At the time said Ordinance was enacted, Razorback Cab of Fort
Smith, Inc. was operating in the city and had been for many years;
and
WHEREAS, Currently no taxi service has a permit to operate in the City of Van
Buren; and
WHEREAS, The citizens of the City of Van Buren are in need of a taxi service;
and
WHEREAS, Razorback Cab of Fort Smith, Inc. should be granted a permit to
operate in the City of Van Buren, subject to the requirements of
Ordinance No. 24 -2001; and
WHEREAS, Ordinance No. 24 -2001 provides for permitting fees based on the
number of taxi's operated by a permitted service; and
WHEREAS, The permitting fees for Razorback Cab, Inc. should be waived
since they currently do not have an office in Van Buren.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN, ARKANSAS:
SECTION 1: The Council finds that the public convenience and necessity
requires the granting of a permit for Razorback Cab of Fort Smith,
Inc. to operate within the city limits of the City of Van Buren; and
SECTION 2: All permitting fees should be, and hereby are waived.

SECTION 3: That the requirement of a surety bond should be, and hereby is,
waived.
SECTION 4: That the Council waives the requirement of a public hearing as
required by Ordinance No. 24 -2001 since there is an urgent need
for taxi service in the City of Van Buren since there is currently no
taxi service currently operating in the City; and
SECTION 5: Because the City of Van Buren is in need of taxi services for its
citizens, this Ordinance is necessary for the public peace, health,
safety and welfare, and an emergency is declared to exist.
Therefore, this ordinance shall be in full force and effect from after
the date of the passage.
