ORD NO 16-2004 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. lip -2004 AN ORDINANCE APPROVING THE PURCHASE OF A NEW FIRE TRUCK, APPROVING SHORT -TERM FINANCING, WAIVING COMPETITIVE BIDDING, DECLARING AN EMERGENCY, AND FOR OTHER MATTERS. WHEREAS, The City is in need of an additional fire truck to serve and protect the citizens of the City of Van Buren; and WHEREAS, The Fire Department is currently in possession of a fire truck that it desires to purchase; and WHEREAS, That it would take approximately nine months to order and receive a new fire truck; and WHEREAS, Section 14 -58 -303 of the Arkansas Code Annotated provides that "The governing body, by Ordinance, may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical and 0 WHEREAS, It would be impractical to go through the bidding process and wait several months for a new truck to be built and delivered when one is available to serve the citizens of the City of Van Buren immediately. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: THAT the City Council waives the requirements of competitive bidding in this particular case as such procedure is not deemed feasible or practical. SECTION 2: The Mayor is hereby authorized to enter into an agreement with Pro -Fire Equipment, LLC to purchase a 2004 Pierce Enforcer Fire Truck with all equipment, currently in possession of the City of Van Buren, in the amount of $263,435.00. SECTION 3: That the Mayor is further authorized to enter into an agreement with Citizen's Bank Trust Company in order to finance payment of the fire truck pursuant to Amendment 78, Section 2 of the Constitution of the State of Arkansas. Payment shall be in four, semi annual payments in the amount of $68,034.37 for a period not to exceed four years and at an interest rate not to exceed 3.98 SECTION 4: Because the City of Van Buren is in need of an additional fire truck for fire protection, and this purchase being necessary for the public peace, health, safety and welfare, an emergency is declared to exist.
