ORDINANCE NO. is -2004
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
AGREEMENT WITH ARKANSAS MISSOURI RAILROAD, DISPENSING
WITH THE COMPETITIVE BIDDING REQUIREMENT, AND OTHER
MATTERS.
WHEREAS, The City is in need of railroad crossing refurbishments at three
crossings within the City limits at 59 Highway and Knox Street, on
Cane Hill north of Main Street, and at 28 Street and Laura Lane;
and
WHEREAS, The crossings are owned by Arkansas Missouri Railroad and
the Railroad will complete the crossings for the cost of materials
only; and
WHEREAS, Because of the unique nature of the services to be provided by
Arkansas Missouri Railroad, the fact that the crossings are
owned by Arkansas Missouri Railroad, and since the Railroad is
only charging the City for the cost of the materials to refurbish the
crossings, it not feasible or practical to bid for services by a
competitive bidding procedure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF VAN BUREN, ARKANSAS:
SECTION 1: The Mayor is hereby authorized and directed to execute all
appropriate agreements and contracts with Arkansas Missouri
Railroad necessary to complete this project and the Clerk is
directed to issue payment to Arkansas Missouri Railroad in an
amount not to exceed $25,915.00.
SECTION 2: Because it is not feasible or practical to utilize the competitive
bidding process, competitive bidding is waived pursuant to A.C.A.
14- 58- 303(b)(2)(B).
SECTION 3: This Ordinance being necessary for the public health, safety, and
welfare of the citizens of Van Buren, Arkansas, an emergency is
hereby declared to exist, and this Ordinance shall be in full force
and effect from and after its passage.
