ORD NO 01-2004 J CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. I -2004 AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE SOFTWARE TO UPGRADE AND MODERNIZE THE EMERGENCY DISPATCH SYSTEM FOR THE POLICE DEPARTMENT, WAIVING BIDDING REQUIREMENTS AND DECLARING AN EMERGENCY. WHEREAS, The Police Department is in need of upgrading and modernizing the Computerized Records Management System currently utilized in the Police Department and adding an Integrated Computer Aided Dispatch System to be used by the Police Department Emergency Dispatch Center in order to allow easier and quicker processing and dispatching of calls for assistance from citizens; and WHEREAS, Information Technologies, Inc., has offered to sell this software to the City for the amount of $39,256.00; and WHEREAS, Section 14 -58 -303 of the Arkansas Code Annotated provides that "The governing body, by Ordinance, may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical"; and WHEREAS, 1t is impractical to receive bids on this software because it complements already existing software used by the Police Department and obtaining software from a different company would require the current software to be completely revised at additional expense to the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION I: THAT the City Council waives the requirements of competitive bidding in this particular case as such procedure is not deemed feasible or practical. SECTION 2: THAT the Mayor is authorized to enter into a purchasing agreement for the purchase of Computer -Aided Dispatch Software from Information Technologies, Inc., in the amount of $39,256.00. The total cost of this software will be paid for from the federal drug forfeiture account. SECTION 3: THAT the purchase of the software immediately is necessary for the immediate preservation of the public peace, health and safety, in that the City will lose federal forfeiture funds if not used within a limited time period and an emergency is declared and this Ordinance shall take effect and be in full force after its passage and approval.
